About approval of Conditions and rules of forced treatment in specialized medical institution

(In edition of the Resolution of the Cabinet of Ministers of the Azerbaijan Republic of 15.02.2016 No. 46)

For the purpose of ensuring execution of Item 1.19 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About drug trafficking, psychotropic substances and their precursors" of August 9, 2005 the No. 280 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Conditions and rules of forced treatment in specialized medical institution" (are attached).

2. This resolution becomes effective from the date of signing.

Conditions and rules of forced treatment in specialized medical institution

1. General provisions

1.1. These rules establish conditions and rules of forced treatment of patients with drug addiction in specialized medical institutions.

1.2. For the treatment of the persons condemned on serving sentence, which is not connected with imprisonment to which measures of forced treatment are also applied, exempted from the detention centers needing continuation of treatment and which did not make in addition to application in its relation of collection in the form of administrative detention for which administrative offense forced treatment for drug addiction or, the providing criminal or administrative detention, but to the close relatives who exerted adverse effect on education of the children who roughly violated their rights, patients with drug addiction and repeatedly refused voluntary treatment, persons concerning whom are applied enforcement medical powers, under the Ministry of Health of the Azerbaijan Republic are effective the specialized medical institutions (SMI) which repeatedly caused with the behavior and actions material and moral damage is appointed.

1.3. Application of forced treatment is allowed only on the basis of the judgment.

1.4. The following plan of treatment is applied to the patient who is on forced treatment:

1.4.1. once a year X-ray inspection;

1.4.2. time in six months general and clinical laboratory inspections;

1.4.3. once a year tool inspections;

1.4.4. inspection regarding the transmitted diseases (AIDS, hepatitises, cholera, etc.);

1.4.5. inspection of the somatic status and in case of detection of any disease, ensuring its treatment in the appropriate order;

1.4.6. in case of need, carrying out inspection by other specialists;

1.4.7. within the two first months maintaining diaries about the patient's condition every 3 day. In the next month once a week, in remaining period of treatment - once a month can be conducted.

2. Basic rights and obligations of persons containing in SMU

2.1. Persons containing in SMU along with the restrictions set by these rules have rights and obligations established by the laws for citizens of the Azerbaijan Republic.

2.2. Persons containing in SMU shall:

* precisely and strictly to fulfill requirements of the current legislation, and also the rule of internal discipline of department;

* to honesty work and fulfill requirements of medical personnel for special treatment;

* conform to the rules of labor discipline, labor protection and safe engineering;

* to handle with property with care, to observe purity and procedure in residential and factory buildings and in the territory of SMU;

* be polite.

2.3. Heads of medico-narcological organizations shall ensure safety of the medical personnel working at these companies and other persons which are in contact with patients from dangerous actions which narcological patients can make.

2.4. To the patient brought for forced treatment the medical card of the inpatient according to the form approved by the Ministry of Health of the Azerbaijan Republic opens and it is filled in the appropriate order.

2.5. SMU is included into narcological service of the Ministry of Health of the Azerbaijan Republic.

2.6. Or serious illness, life-threatening, or during the natural disaster which caused significant material damage, to this person or his relative no later than 10 days after liquidation of natural disaster short-term permission to exit from SMU can be this to persons which are in SMU, in exceptional cases, in case of the death of the close relative. For short-term leaving it is granted permission by judicial authorities and the administration taking into account the personality and behavior of person containing in SMU.
