About approval of the Single regulations on procedure for licensing of separate types of activity by means of special electronic system

1. Approve:

Single regulations on procedure for licensing of separate types of activity by means of special electronic system according to appendix No. 1;

Standard structure of Appeal council on consideration of claims of the authorized bodies of republican level making decisions on licensing or on refusal in licensing (further - Appeal council), according to appendix No. 2.

2. Determine that heads of the relevant state bodies and organizations bear the personal responsibility for reliability of the information provided by state bodies and the organizations through information systems for the requests arriving through the Single portal of interactive state services and the information system "License".

3. To the authorized bodies of republican level making decisions on licensing or on refusal in licensing in a month to approve structure of Appeal council on consideration of claims.

4. Approve the schedule of reduction of the separate regulatory legal acts establishing procedures of licensing in compliance with the Law of the Republic of Uzbekistan "About licensing, allowing and notifying procedures", and entering into the Cabinet of Ministers according to appendix No. 3.

Determine that the personal responsibility for entering into the Cabinet of Ministers of relevant proposals into the terms established by the schedule is conferred on heads of the responsible ministries and departments specified in appendix No. 3 to this resolution.

5. This resolution becomes effective since March 1, 2022.

The licensed requirements and conditions established by this resolution for the legal entities or physical persons (licensee) having the license for implementation of the licensed type of activity or its subspecies become effective since June 1, 2022.

In three-months time to provide to the authorized bodies performing licensing of separate types of activity reduction of activities of the acting licensees in compliance with the licensed requirements and conditions established by this resolution.

6. To the Ministry of Justice of the Republic of Uzbekistan:

a) hold address and subject propaganda events for the population and subjects of entrepreneurship in connection with transition of implementation of procedures of licensing through the information system "License" and the Single portal of interactive state services;

b) together with the interested ministries and departments:

provide entering into the Cabinet of Ministers at the scheduled time of the separate regulatory legal acts establishing procedures of licensing according to appendix No. 3 to this resolution;

in a month to bring the regulatory legal acts adopted by them into accord with this resolution.

7. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 4.

8. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan on financial and economic questions and reducing poverty - the Minister of Economic Development and reducing poverty of Kuchkarov D. A. and Minister of Justice of the Republic of Uzbekistan Davletov R. K.

Single regulations on procedure for licensing of separate types of activity by means of special electronic system

Chapter 1. General provisions

Licensing of activities on which implementation receipt of the license is required by means of the information system "License" or through the Single portal of interactive state services of the Republic of Uzbekistan, is performed according to the scheme according to appendix No. 1 to this Provision.

Rules of this provision extend concerning the licensed types of activity provided by passports of the licensed types of activity according to the appendices N№2 - 33*.

Occupation is forbidden by types of activity on which implementation receipt of the license, without receipt of the license is required.

3. In this Provision the following basic concepts are used:

the licensee - the legal entity or physical person having the license for implementation of the licensed type of activity or its subspecies;

the license - the document issued to physical person or legal entity, granting the right to implementation of the licensed type of activity or its subspecies in case of obligatory observance of licensed requirements and conditions;

licensing - complex of the procedures connected with process of giving, acceptance and consideration of the application about licensing, issues, prolongation of term, suspension, renewal and cancellation of the license, and also cancellation and renewal of the license;

the licensed type of activity - the type of activity determined by the law on which implementation in the territory of the Republic of Uzbekistan receipt of the license is required;

subspecies of the licensed type of activity - the direction of the type of activity included in structure of the licensed type of activity;

the job seeker - the physical person or legal entity which addressed for receipt of the license;

the licensing body - state body (its territorial subdivision) or other organization performing licensing of separate types of activity;

the information system "License" (further - IS "License") - the special electronic system with possibility of interdepartmental electronic interaction covering all processes connected with licensing, allowing and notifying procedures;

licensed requirements and conditions - set of the requirements and conditions established by this Provision and Passports approved by it, which accomplishment by the licensee surely when implementing of the licensed type of activity;

the register of licenses - the databases containing data about the issued, extended, suspended, renewed, renewed, stopped, cancelled licenses.

4. The job seeker directs the application for licensing and documents attached to it electronically through IS "License" or the Single portal of interactive state services of the Republic of Uzbekistan (further - EPIGU).

Applications can be directed through IS "License" or EPIGU daily within 24 hours, irrespective of days off and holidays.

At the same time in case of receipt of statements after working hours or in days off and holidays, day of receipt of statements in the licensing body and acceptances by the licensing body the next working day is considered.

5. The relevant document (mark) confirming registration of a statement and the documents attached to it, automatically goes to the job seeker through IS "License" or EPIGU.

The job seeker can trace condition of consideration of the submitted application for licensing in online the mode through IS "License".

6. The license is granted by the licensing body. In Passports need of approval of licensing of the relevant authorized body can be specified (further - the approving body).

7. The license is granted for unrestricted term, except as specified, established by the Law of the Republic of Uzbekistan "About licensing, allowing and notifying procedures".

Chapter 2. Requirements and conditions of implementation of activities

8. Requirements and conditions of implementation of the licensed type of activity are:

observance of requirements and conditions, stipulated in Item 9 Passports;

providing that the data represented for obtaining, renewal and prolongation of term of the license are not counterfeit, false and doubtful;

registration of cases of the conclusion of new employment contracts with workers, modification of employment contracts and their terminations, and also information on the existing employment contracts in interdepartmental hardware and software system "Single national system of work" - in case of availability in Passports of the requirement to employees for implementation of the related activity (actions);

in case of transformation of the licensee - the legal entity, change of its name or the location (postal address), the licensee or his legal successor shall within five working days after passing of re-registration address to the licensing body through IS "License" or EPIGU about renewal of the license with appendix of the relevant documents confirming the specified data;
