About prohibition of the cabin, transportation, acquisition and sale, procurement and use, export especially valuable (nut and archovy) tree species in the Kyrgyz Republic

This Law is directed to protection of especially valuable tree species in the Kyrgyz Republic.

Article 1.

In the territory of the Kyrgyz Republic ban on the cabin, damage to extent of the termination of growth, transportation, acquisition and sale, procurement and use, production of products, export especially valuable (nut and archovy) tree species till 2030 including on the sanitary cabin, except for cabins of leaving and cleaning of the wood of clutter without cabin is imposed.

The cabin especially valuable (nut and archovy) tree species is allowed in case of production of construction and explosive works, laying of cables, pipelines, thoroughfares and other communications, carrying out scientific research, geological studying and industrial development of subsoil within the territories provided for these purposes in the territory of the Kyrgyz Republic in case of reasonable impossibility of their preserving with the subsequent indemnification (including lost profit) and losses of forestry and landscape production.

The cabin of especially valuable tree species is performed according to the Rules approved by the Government of the Kyrgyz Republic according to the conclusion of specially authorized state body of management of forestry.

The means which arrived according to the procedure of compensation of losses of forestry and landscape production and also from realization of the prepared wood, are used according to the Provision approved by the Government of the Kyrgyz Republic for protection, protection, afforestation, increase in productivity of the woods and reproduction of the trees which are subject to the cabin using countervailing measures in proportion: instead of one cut-down tree of certain type to plant 100 saplings of the corresponding type.

Article 2.

In case of the illegal cabin, transportation, acquisition and sale, procurement and use, production of products, export especially valuable (nut and archovy) tree species of confiscation the objects which were the tool of making or direct object of these activities (especially valuable tree species, the made products, the built buildings and constructions, etc.) or participating in conversion, production of products and raw materials (workshops, power-saw benches, motor transport), construction of buildings and constructions (window frames, doors, different designs from especially valuable are subject (nut and archovy tree species).

The confiscated nut roots, caps and wood can be used, implemented or destroyed according to the procedure, established by the Government.

Income gained from illegal activities is subject to withdrawal and transfer in the republican budget.

Persons guilty of violation of requirements of this Law bear responsibility according to the legislation of the Kyrgyz Republic.

Article 3.

In case of contradiction of the regulations containing in regulatory legal acts of the Kyrgyz Republic, to this Law provisions of this Law are applied.

Article 4.

This Law becomes effective from the date of publication.

The CBM and nut caps confiscated (sequestered) before adoption of this Law and being on safe custody at authorized state body on environmental protection and forestry nut wood in amount of 186,3 of 7 tons are subject to realization, transportation and use or destruction in the territory of the Kyrgyz Republic according to the procedure, established by the Government, within twenty two months from the date of entry into force of this Law.

To the government of the Kyrgyz Republic to bring the regulatory legal acts into accord with this Law.
