In pursuance of part eight of article 17 of the Law of the Republic of Belarus of July 15, 2015 "About fight against corruption" the Council of Ministers of the Republic of Belarus DECIDES: No. 305-Z

1. Approve Regulations on procedure for delivery, accounting, storage, cost determination and realization of property, including the gift provided to the state official or equated to it face, to his spouse (spouse), close relatives or cousins-in-laws it (is applied).

2. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of January 22, 2016 No. 45 "About approval of the Regulations on procedure for delivery, accounting, storage, assessment and realization of the property, including gifts received by the state official or equated to it person with violation of the procedure established by legal acts in connection with execution of the service (labor) duties by it";

subitem 1.10 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of June 20, 2018 No. 466 "About introduction of amendments to resolutions of Council of Ministers of the Republic of Belarus".

3. This resolution becomes effective after its official publication.

Regulations on procedure for delivery, accounting, storage, cost determination and realization of property, including the gift provided to the state official or equated to it face, his spouse (spouse), close relatives or cousins-in-laws

1. This Provision determines procedure for delivery, accounting, storage, cost determination and realization of property, including the gift provided to the state official or equated to it face, his spouse (spouse), close relatives or cousins-in-laws, accepted in connection with execution state official or person of service (labor) duties equated to it.

2. This Provision does not extend the action to the following cases:

the receipt of property, gifts which is not connected with labor (office) activity of the state official or equated to it person;

acceptance of the gifts received when holding hospitality and other official events if the cost of each of them does not exceed the twentyfold size of basic size on the date of receipt of such gift, flowers;

other cases when acceptance of property, including gift, the state official or equated to it person, his spouse (spouse), close relatives or cousins-in-laws in connection with execution by the state official or equated to it person of service (labor) duties is allowed according to the paragraph the fourth parts seven of article 17 of the Law of the Republic of Belarus "About fight against corruption".

3. For the purposes of this provision terms and their determinations in the values established in the Law of the Republic of Belarus "About fight against corruption" are used.

4. The state official or equated to it person in case of obtaining by it, his spouse (spouse), close relatives or cousins-in-laws of property in connection with execution by the state official or equated to it person of service (labor) duties, including acceptances of the gifts received when holding hospitality and other official events, the cost of each of which exceeds the twentyfold size of basic size on the date of receipt of such gift (further if other is not determined, - property, gift), shall notify by the written application on receipt of property, gift state body, other organization in which (which) serves (works).

The statement for receipt of property, gift is drawn up in any form and within three working days from the date of their obtaining (when obtaining in the time spent on official journey - within three working days after return from it, excepting day of arrival) it is submitted:

in state bodies, other organizations in which according to the Law of the Republic of Belarus "About fight against corruption" the commissions on anti-corruption are created, - to the official authorized by the head of state body or other organization from among members of such commission;

in state bodies in which according to legal acts special divisions on fight against corruption are created or in structure of central offices of which there are divisions of own safety, - to the official of this division authorized by the head of state body;

in other state bodies, the organizations - to the official authorized by the head of state body or organization.

In case of impossibility of filing of application at the scheduled time for the reason which is not depending on the state official or equated to it person, the application is submitted no later than the next working day after elimination of the corresponding reason.

The documents (in case of their availability) confirming property value, gift (the payment document, the sales receipt, other document) are enclosed to the application.

5. Registration of a statement is made by the authorized officers specified in paragraphs the second or fourth to part two of item 4 of this provision (further - the authorized person), in day of its giving in the magazine of registration of statements about receipt of property, gift. The magazine shall be stitched, numbered and certified by the authorized signature.

In the magazine of registration of statements about receipt of property, gift the name of property, gift, their short description and circumstances of obtaining, position, surname, own name, middle name (if that is available) the state official or equated to it person and the authorized person are reflected, their signatures are put down, in the note the additional information (is reflected in case of its availability).
