About features of legal status of separate categories of foreign citizens and stateless persons in the Russian Federation

1. Determine that citizens of Ukraine, the faces consisting in nationality of the Donetsk People's Republic or the Luhansk People's Republic and persons without citizenship are recognized since September 30, 2022 the foreign citizens and persons without citizenship who are constantly living in the Russian Federation if they correspond to at the same time following conditions:

a) such citizens and persons constantly lived as of the specified date in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region or earlier constantly lived in these territories and left to the Russian Federation, including through the territories of the third states;

b) such citizens and persons declared the desire to keep the nationality which is available for them or to remain stateless persons, did not take the Oath of the citizen of the Russian Federation or according to the procedure, No. 951 established by the Presidential decree of the Russian Federation of December 26, 2022 "About some questions of acquisition of citizenship of the Russian Federation", refused its bringing.

2. The foreign citizens and stateless persons which arrived to the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region and constantly living as of September 30, 2022 in these territories based on the document confirming the right of the foreign citizen or stateless person to permanent residence and issued by authorized body of Ukraine, the Donetsk People's Republic or the Luhansk People's Republic (including effective period of which expired) having the right to live constantly in these territories based on such documents till December 31, 2024 inclusive.

3. The citizens of Ukraine, faces consisting in nationality of the Donetsk People's Republic or the Luhansk People's Republic and the persons without citizenship who were constantly living as of September 30, 2022 in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region or earlier constantly living in these territories and left to the Russian Federation including through the territories of the third states having the right in the presence of the certificate of the refugee, the certificate on provision of provisional asylum in the territory of the Russian Federation, permissions to temporary residence or the residence permit to take part in the State program on rendering assistance to voluntary resettlement to the Russian Federation the compatriots living abroad, the Russian Federation approved by the Presidential decree of June 22, 2006 No. 637 "About measures for rendering assistance to voluntary resettlement to the Russian Federation of compatriots living abroad".

4. Persons called in Items 1 and 2 of this Decree:

a) has the right to address to territorial authority of the Ministry of Internal Affairs of the Russian Federation in the place of the actual stay with the statement for issue of the residence permit;

b) in case of the address with the statement for issue of the residence permit undergo obligatory state dactyloscopic registration and photography and represent:

the identity document and nationality (in the presence) including if the term of its action expired;

the document confirming the right of the foreign citizen or stateless person to permanent residence and issued by authorized body of Ukraine, the Donetsk People's Republic or the Luhansk People's Republic including if the term of its action expired (in the presence of such document);

the document confirming the fact of permanent residence in the territory of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region or the Kherson region (except as specified if these data contain in the identity document, or the document confirming the right to permanent residence);

two photos of 35 x 45 mm in size conforming to the requirements established by the Ministry of Internal Affairs of the Russian Federation;

c) attach to the statement for issue of the residence permit of the copy of the documents specified in paragraphs the second - the fourth the subitem "b" of this Item. Compliance of copies to originals is checked by the official of territorial authority of the Ministry of Internal Affairs of the Russian Federation and certified by the signature of the official and seal of territorial authority. The original document, the subitem "b" of this Item specified in paragraph three, in case of issue of the residence permit is subject to transfer to the official for attaching to case papers about consideration of the application;

d) submit the documents executed not in Russian with the translation into Russian. Fidelity of the translation or authenticity of the signature of the translator shall be attested in accordance with the legislation of the Russian Federation about notariate. In the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region the requirement about certification of the translation or authenticity of the signature of the translator is not applied before the end of transition period;

e) in case of the appeal to territorial authority of the Ministry of Internal Affairs of the Russian Federation concerning registration at the place of residence or registrations in the place of stay have the right to submit the identity document and nationality (in the presence) including if the term of its action expired.

5. The persons called in Items 1 and 2 of this Decree, registered as of September 30, 2022 at the place of residence in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region and which do not have registration at the place of residence in the territory of other subject of the Russian Federation are equated to registered at the place of residence in the territory of the Russian Federation from registration date at the place of residence in the corresponding territory. The mark about registration at the place of residence is put down in the residence permit.

6. The persons called in Items 1 and 2 of this Decree, registered as of October 5, 2022 at the place of residence in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region and at the same time in the territory of other subject of the Russian Federation, which did not submit till October 5, 2023 to territorial authority of the Ministry of Internal Affairs of the Russian Federation the statement for the choice of the residence are struck off the registration register at the place of residence to the address to which registration date is earlier.

7. The term of consideration of the application about issue of the residence permit shall not exceed 20 working days.
