Standard conditions of public contracts on rendering services in storage of the property turned into property of the state

I. Conditions about the rights and about the customer's obligations

1. The customer has the right:

a) perform checks of the course and quality of rendering services in storage of the property turned into property of the state, the order by which it is performed according to Regulations on the order the property turned into property of the state, approved by the order of the Government of the Russian Federation of September 23, 2019 No. 1238 "About the order the property turned into property of the state" (further - property) on the storage location of property without intervention in economic activity of the contractor;

b) make the decision on unilateral refusal of execution of the public contract on rendering services in storage of property (further - the public contract) on the bases provided by the Civil code of the Russian Federation for unilateral refusal of execution of separate obligation types.

2. The customer shall:

a) direct to the contractor written orders about rendering services in storage of property (further - the order to acceptance of property) in time no more than 10 working days from the date of receipt of the notifications of the readiness to cession of property directed by state bodies (their territorial authorities) owning property (further - authorized body), and also judicial police officers-contractors according to Item 5 of the Regulations on the order the property turned into property of the state approved by the order of the Government of the Russian Federation of September 23, 2019 No. 1238 "About the order the property turned into property of the state";

b) issue for the purpose of acceptance of property from authorized bodies and (or) judicial police officers-contractors, and also from other persons to the contractor the power of attorney providing making on behalf of the customer of actions for acceptance of property, and also other actions provided by the public contract.

II. Conditions about obligations of the contractor

3. The contractor shall:

a) inform the customer on the acceptance date of property planned or approved with authorized body and (or) the judicial police officer-contractor on storage in case of acceptance of property from authorized bodies and (or) judicial police officers-contractors within 5 working days after day of receipt of the order on acceptance of property;

b) accept property on storage under the delivery-acceptance certificate from authorized bodies and (or) judicial police officers-contractors within no more than 20 working days from the date of receipt of the order on acceptance of property if other shorter term is not established by the order on acceptance of property;

c) accept property on storage under the delivery-acceptance certificate from other persons in time, established by the order on acceptance of property;

d) not accept property on storage from authorized bodies and (or) judicial police officers-contractors in case of its discrepancy to the name specified in the order acceptance of property;

e) be guided in case of acceptance of property from authorized bodies and (or) judicial police officers-contractors by procedure and conditions of interaction in case of cession of property which are provided by the paragraph the second Item 2 of the order of the Government of the Russian Federation of September 23, 2019 No. 1238 "About the order the property turned into property of the state";

e) inform in writing the customer on the circumstances interfering acceptance of property on storage at the scheduled time no later than one working day from the date of identification of such circumstances with appendix of the document (the act, the protocol or other document) fixing the reasons of rejection of property at the scheduled time;

g) provide specifying in the delivery-acceptance certificate of property the name, quantity and the description of the property including its individual signs and parameters, and also visible defects (quality shortcomings) of property (in the presence);

h) make in case of receipt of property its recalculation (overweight) according to the units of measure specified in the delivery-acceptance certificate, and also determine its amount (in cubic meters with accuracy at least one tenth) taking into account packaging. In cases if the property arrives in the closed container and (or) packaging, to perform their opening in case of acceptance of property on storage. In the delivery-acceptance certificate in addition to the specified units of measure to reflect amount of the accepted property (in cubic meters);

i) perform photographing of the property arriving on storage at the time of its acceptance, including its packaging, individual signs and parameters, and also visible defects (quality shortcomings) (in the presence). Photographic materials shall allow to distinguish such property from others, including similar, objects;

j) place property on storage, proceeding from its consumer properties and signs according to the requirements established by technical regulations and (or) state standards. Exclude storage of property in the conditions capable to lead to its loss, deterioration in consumer properties and other characteristics;

k) provide in writing within 3 working days from the date of the conclusion of the public contract to the customer information:

about storage facilities, about open parking, about the areas and about other storage locations in which the contractor plans to place property on storage, with appendix of verified copies of documents of title on them. In case of the planned change of storage locations of property in writing to inform on it the customer at least in 3 working days prior to movement of property;

about persons authorized on acceptance of property on storage with appendix of verified copies of the documents confirming their powers;
