About approval of the Regulations on levels of terrorist danger, procedure for their introduction and additional measures for safety of the personality, society and state

For the purpose of implementation of articles 6 and 18 of the Law of the Kyrgyz Republic "About counteraction to terrorism", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

- Regulations on levels of terrorist danger, procedure for their introduction and additional measures for safety of the personality, society and state according to appendix 1;

- The instruction (instruction sheet) for actions of citizens in case of introduction of levels of terrorist danger according to appendix 2;

- The instruction (instruction sheet) for actions of heads of organizations and the organizations in case of introduction of levels of terrorist danger according to appendix 3.

2. To the ministries, state committee and administrative departments of the Kyrgyz Republic:

- take the necessary measures following from this resolution;

- to perform selling expenses of the actions provided in the above-stated Provision within the means provided in the republican budget for the corresponding financial year.

3. In case of introduction of levels of terrorist danger to recommend to be guided:

- to physical persons - the Instruction (instruction sheet) for actions of citizens in case of introduction of levels of terrorist danger;

- to the organizations, the companies and organizations irrespective of patterns of ownership - the Instruction (instruction sheet) for actions of heads of organizations and the organizations in case of introduction of levels of terrorist danger.

4. This resolution becomes effective after ten days from the date of official publication.

Regulations on levels of terrorist danger, procedure for their introduction and additional measures for safety of the personality, society and state

1. This Provision establishes types of levels of terrorist danger, procedure for their introduction, and also determines content of additional measures for safety of the personality, society and state in case of introduction of levels of terrorist danger.

2. Introduction of levels of terrorist danger is performed for the purpose of timely informing the population on emergence of threat of the act of terrorism, the organization by state bodies of activities for counteraction of its making and acceptance of additional measures for safety of the personality, society and the state.

3. Depending on nature and accuracy of the information about possible making or assassinated on certain sites of the territory of the Kyrgyz Republic (objects) the following levels of terrorist danger can be entered:

a) raised ("blue");

b) high ("yellow");

c) critical ("red").

4. Level of terrorist danger on certain sites of the territory (objects) of the Kyrgyz Republic is entered:

a) raised ("blue") - in the presence of information on real possibility of making of the act of terrorism requiring confirmation;

b) high ("yellow") - in the presence of the confirmed information on real possibility of making of the act of terrorism;

c) critical ("red") - in the presence of information about assassinated or about making of the actions creating direct threat of the act of terrorism.

5. The level of terrorist danger entered on the certain site of the territory of the Kyrgyz Republic (object) is subject to cancellation if the threat of terrorist danger is eliminated.

6. The decision on introduction, change or cancellation raised ("blue"), high ("yellow") levels of terrorist danger on certain sites of the territory (objects) within administrative borders of area is accepted by the chief of regional territorial subdivision of authorized state body in the sphere of ensuring national security of the Kyrgyz Republic (further - authorized body).

The decision on introduction, change or cancellation raised ("blue"), high ("yellow") levels of terrorist danger on certain sites of the territory (objects) within administrative border of the city of Bishkek is accepted by the chief of the Bishkek city territorial subdivision of authorized body.

The chief of regional territorial subdivision and the chief of the Bishkek city territorial subdivision of authorized body without delay inform on the made decision of the head of authorized body, the Director of the Anti-terrorist center of authorized body and the corresponding plenipotentiary of the President of the Kyrgyz Republic in area, mayors of the cities of Bishkek or Osh.

7. The term for which in certain sites of the territory (objects) the increased ("blue"), high ("yellow") level of terrorist danger, borders of the site of the territory (objects) within which (on which) the level of terrorist danger and the list of additional measures is entered, stipulated in Item the 15th this provision is entered are determined by the official who enters this level if the head of authorized body does not make other decision.

8. The decision on introduction, change or cancellation of critical ("red") level of terrorist danger on certain sites of the territory (objects) is accepted by the head of authorized body based on representation of the chief of regional territorial subdivision or the chief of the Bishkek city territorial subdivision of authorized body (in cases of introduction of level in the territory within administrative border of area or the city of Bishkek) or representation of the Director of the Anti-terrorist center of authorized body (in cases of introduction of level in the territory located in the territory of two or more areas).

Representation shall contain information, stipulated in Item 4 this provision, and also offers on term for which the level of terrorist danger, about borders of the site of the territory is entered (about object), within which (on which) it is entered, and the list of additional measures, stipulated in Item the 15th this provision.
