Procedure for confirmation of the periods of work which are enlisted in years of service for award of pension

1. This Procedure determines the procedure of confirmation of the periods of work which are set off in length of service:

for award of pension on favorable terms or for long service, established for separate employee category, in case of liquidation of the company, organization, the organization without determination of the legal successor;

till January 01, 2004 if in the service record there are records with corrections either doubtful or inexact records about the work periods at the companies, in organizations, the organizations (their legal successors) located in temporarily occupied territories in the Donetsk and Luhansk regions, the Autonomous Republic of Crimea and the city of Sevastopol (further - the companies located in temporarily occupied territory).

2. Action of this Procedure extends to persons who worked:

at underground works, at works with especially harmful and especially severe conditions of work on the list No. 1 and at other works with harmful and severe conditions of work on the list No. 2 of the productions, works, professions, positions and indicators approved by the Cabinet of Ministers of Ukraine;

at the works granting the right to award of pension on age on favorable terms;

on the positions granting the right to award of pension for long service;

during the period till January 01, 2004 at the companies located in temporarily occupied territory and if in the service record there are records with correction either doubtful or inexact records about the work periods (further - the work periods at the companies which are located in temporarily occupied territory).

3. Confirmation of the periods of work which are set off in length of service for award of pension on favorable terms or for long service and the work periods at the companies which are located in temporarily occupied territory is performed by the commissions on questions of confirmation of the length of service granting the right to award of pension (further - the Commissions).

4. The commissions are created under head departments of the Pension fund of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol which structure surely joins representatives of social security authorities of the population, bodies of the Pension fund of Ukraine, Public service of Ukraine concerning work. The Commissions on coordination are included trade union representatives and the organizations of General representative body of the representative All-Ukrainian Unions of labor unions at the national level and the regional organizations of employers and their associations.

5. The commissions are effective in connection therewith with Procedure. The structure of the Commissions affirms the chief of head department of the Pension fund of Ukraine as the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol. Commission chairman is the chief of head department of the Pension fund of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol.

6. The main objective of the Commission is consideration of the applications about confirmation of length of service and acceptance by results of their consideration of decisions on confirmation (refusal in confirmation) length of service.

7. For accomplishment of the tasks assigned to the Commission it is granted the right:

hear at the meeting person who submitted the application for confirmation of length of service (further - the applicant) either her legal representative, or the representative who is acting on the basis of the power of attorney issued to it certified notarially;

invite to meetings as consultants and experts of specialists central and local executive bodies, the companies, organizations and the organizations;

obtain from the interested bodies information necessary for confirmation of length of service, in accordance with the established procedure;

inform territorial authorities of the Pension fund of Ukraine on the questions entering competence of the Commission.

8. Commission session is held as required, but at least once a month. The commission competent to make the decision with participation in meeting it is at least as 2/3 of her members.

9. The commissions report to the applicant about time, date and the place of consideration of the application about confirmation of length of service and consider it no later than two months from the date of the request for confirmation of length of service.

10. The decision on results of consideration of the application on confirmation of length of service (annex 1) is adopted by a majority vote the members of the commission who are present at meeting it is signed by the commission chairman or his deputy and becomes effective from the date of its acceptance.

11. With the statement for confirmation of length of service (appendix 2) the applicant (his legal representative or the representative who acts on the basis of the power of attorney issued to it certified notarially (further - his representative) can address to any territorial authority of the Pension fund of Ukraine, irrespective of the territory of servicing of this body.

For confirmation of the periods of work which are set off in length of service for award of pension on favorable terms or for long service are enclosed to the application:

documents which confirm the fact of the termination of the company, organization, organization as a result of their liquidation (including archival) concerning the companies, organizations, the organizations liquidated till July 01, 2004 and/or concerning which there are no data on carrying out registration actions in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Unified state register);

service record;

the documents (in the presence) issued by archival organizations, in particular:

certificate of the salary;

copies of documents on carrying out certification of workplaces;

copies of documents on the transfer to other work, for work with part-time, provision of leaves non-paid.
