Regulations on federal state control (supervision) in the sphere of identification and (or) authentication

I. General provisions

1. This Provision establishes procedure for the organization and implementation of federal state control (supervision) in the sphere of identification and (or) authentication (further - the state control (supervision).

3. The state control (supervision) is exercised by the Ministry of digital development, communication and mass communications of the Russian Federation (further - monitoring body).

4. The officials authorized on implementation of the state control (supervision) are:

a) the head of monitoring body, deputy managers of monitoring body who supervise according to distribution of obligations activities of structural divisions of monitoring body within which scope of maintaining questions of the organization and implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall;

b) heads of structural divisions of monitoring body within whose scope of maintaining questions of the organization and implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall;

c) officials of structural divisions of monitoring body to whose job responsibilities according to official regulations implementation of powers on implementation of the state control (supervision) belongs.

5. The officials authorized on decision making about holding control (supervising) actions are:

a) the head of monitoring body, deputy managers of monitoring body who supervise according to distribution of obligations activities of structural divisions of monitoring body within which scope of maintaining questions of the organization and implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall;

b) heads of structural divisions of monitoring body within whose scope of maintaining questions of the organization and implementation of the state control (supervision) which official regulations provide powers on implementation of the state control (supervision) fall.

6. The officials authorized on implementation of the state control (supervision), specified in item 4 of this provision (further - authorized officers), when holding control (supervising) action within the powers and in volume of the carried-out control (supervising) actions have the rights established by part 2 of article 29 of the Federal law "About the State Control (Supervision) and Municipal Control in the Russian Federation".

7. Provisions of the Federal Law "About the State Control (Supervision) and Municipal Control in the Russian Federation" are applied to the relations connected with implementation of the state control (supervision).

8. Objects of control of monitoring body within the state control (supervision) are activities, actions (failure to act) of controlled persons concerning which the mandatory requirements imposed to controlled persons and also results of activities, actions (failure to act) of controlled persons concerning which the mandatory requirements imposed to controlled persons shall be observed (further - objects of control) shall be observed.

9. Accounting of objects of control is performed by maintaining the list of accredited controlled persons posted on the official site of monitoring body on the Internet (further - Internet network).

Change of information containing in the specified list is provided with authorized officers in the following cases:

receipt in monitoring body of information provided by controlled persons according to regulatory legal acts;

receipt in monitoring body of information obtained within interdepartmental interaction, or office information;

receipt in monitoring body of public information;

adoption by monitoring body of decisions on suspension or early termination of accreditation of controlled persons.

II. Risk management of damnification (damage) to the values protected by the law when implementing the state control (supervision)

10. When implementing the state control (supervision) the system of assessment and risk management of damnification (damage) to the values protected by the law when implementing the state control (supervision) is applied (further - risk).

11. The monitoring body when implementing the state control (supervision) refers objects of control to categories of high, average and low risk.

12. Reference of objects of control to categories of risk is performed based on comparison of their characteristics to criteria of reference of objects of control to categories of risk according to appendix.

13. Planned control (supervising) events concerning objects of control depending on the appropriated categories of risk are held with the following frequency:

a) concerning the objects of control referred to category of high risk - 1 time in 2 years inspection visit, either exit check, or documentary check;

b) concerning the objects of control referred to category of average risk - 1 time in 2,5 of year inspection visit, either exit check, or documentary check.
