1. Approve the enclosed Rules of certification of physical persons on the right of carrying out construction supervision in the course of construction, reconstruction and capital repairs of capital construction projects in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region.

2. Determine that:

a) certification of physical persons on the right of carrying out construction supervision in the course of construction, reconstruction and capital repairs of capital construction projects in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region is performed by Federal Service for Environmental, Technological and Nuclear Supervision (its territorial authorities);

b) till January 1, 2025 certification of physical persons on the right of carrying out construction supervision in the course of construction, reconstruction and capital repairs of capital construction projects in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region is performed only in presentia of holding certification session.

3. This resolution becomes effective since September 1, 2023 and is effective till January 1, 2028.

Rules of certification of physical persons on the right of carrying out construction supervision in the course of construction, reconstruction and capital repairs of capital construction projects in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region

1. These rules establish procedure for certification of physical persons on the right of carrying out construction supervision in the course of construction, reconstruction and capital repairs of capital construction projects in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region (further respectively - certification, construction supervision), including requirements to such physical persons, effective period of the competence certificate on the right of carrying out construction supervision (further - the competence certificate), procedure for cancellation of the competence certificate, and also procedure for maintaining the register of the physical persons certified on the right of carrying out construction supervision (further respectively - the certified persons, the register).

2. Certification is carried out concerning the physical persons having intention to acquire the right of carrying out construction supervision (further - applicants).

3. Certification is carried out following the results of examination of the applicant, these rules provided by the subitem "v" of item 4, in the form of the certification session including testing and written examination (further - certification session).

4. The applicant can be certified on the right of carrying out construction supervision on condition of compliance of set of the following requirements:

a) availability of the higher education in the specialty or to the direction of preparation in the field of construction;

b) availability of general working life in the specialty or to the direction of preparation in the field of construction at least than 2 years;

c) availability of knowledge in the field of the legislation of the Russian Federation on town-planning activities, the legislation of the Russian Federation on technical regulation (including requirements to ensuring safe operation of capital construction projects), legislations of the Russian Federation on anti-corruption.

5. For certification passing the applicant represents to territorial authority of Federal Service for Environmental, Technological and Nuclear Supervision (further - the certifying body) in electronic form or on paper:

a) the statement for passing of certification on the right of carrying out construction supervision (further - the application for certification passing) signed by the applicant with indication of surname, name, middle name (in the presence), birth dates, identification taxpayer number, the residential address, the insurance number of the individual ledger account, data on the identity document, contact phone number, the e-mail address, place of employment and post, data on the job responsibilities and (or) functions performed on position, preferable form of holding certification session (full-time or remote form) and also with confirmation of consent with organizational specifications of holding certification session in remote form (in case of specifying in the statement for passing of certification of remote form of holding certification session as preferable);

b) the consent of the applicant for processing of its personal data which is drawn up according to article 9 of the Federal law "About Personal Data";

c) the copies of the documents confirming the applicant's compliance to the requirement provided by the subitem "an" of item 4 of these rules, certified in accordance with the legislation of the Russian Federation;
