1. Approve Regulations on order of registration (removal from registration) of the radio-electronic means and (or) high-frequency devices which are source of electromagnetic radiation it (is applied).

Chapter 1. General provisions

1. This Provision is developed according to article 23 of the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication".

2. This Provision determines order of registration (removal from registration) of radio-electronic means (further - RES) and (or) the high-frequency devices (further - VChU) which are source of electromagnetic radiation, all appointments which are in the territory of the Republic of Belarus, accounting of RES and (or) VChU.

3. In this Provision are used:

terms and their determinations in the values established by the Law of the Republic of Belarus "About telecommunication", the Presidential decree of the Republic of Belarus of April 15, 2013 No. 192 "About allocation, use of radio-frequency range and introduction of amendment and changes in the Presidential decree of the Republic of Belarus of July 31, 2006 No. 473";

the term "owner of RES and (or) VChU" designating the legal entity or the citizen, including the individual entrepreneur at whom RES and (or) VChU are in property, on the right of economic maintaining, operational management.

4. RES and (or) VChU which are source of electromagnetic radiation, being in the territory of the Republic of Belarus shall be registered by their owners no later than 14 days from the date of import, the acquisitions in property, obtaining in economic maintaining or operational management which except for are not subject to registration according to legal acts.

5. RES and (or) VChU which are source of electromagnetic radiation are registered (act from registration):

civil appointment - the State inspectorate for telecommunication of the Ministry of Communications and Informatization (the republican unitary enterprise for supervision of telecommunication of "BELGIE") (further - the State inspection);

used in civil aviation, - Department on aircraft of the Ministry of Transport and Communications (further - Department);

used in the relevant networks of telecommunication of special purpose, - specialized division of the Ministry of Internal Affairs, the Ministry of Defence, Committee for State Security, Operational analytical center in case of the President of the Republic of Belarus or the Presidential Security Service of the Republic of Belarus.

6. The state inspectorate and Department for the purpose of establishment of reliability of the documents and data submitted by the interested person for issue of the documents provided by this Provision can use documents and (or) data which are available in the State inspection and Department, and also received from other state bodies, other organizations, the state registers, registers, inventories, lists, catalogs, bases and databanks.

Forms of the applications submitted by interested persons for registration (removal from registration the) of RES and (or) VChU which are source of electromagnetic radiation, civil appointment, and also form of the registration certificate RES and (or) VChU, being source of electromagnetic radiation, civil appointment (further - the registration certificate) are established by the Ministry of Communications and Informatization.

Application forms and questionnaires represented by interested persons for the registration of RES and (or) VChU which are source of electromagnetic radiation, used in civil aviation, acceptance acts in operation, flight check, the protocol of land check and setup, schedules of angles of closing, range of action and also form of permission to the right of operation of RES and (or) VChU which are source of electromagnetic radiation, used in civil aviation (further - permission), are established by the Ministry of Transport and Communications.

7. Radio-frequency services, Department shall record the registered RES and (or) VChU which are source of electromagnetic radiation.

Chapter 2. Order of registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment

8. The state inspection, having received the application and documents attached to it, checks the documents and data necessary for registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment including:

availability of decisions of the State Commission on Radio Frequencies under the Security Council of the Republic of Belarus about allocation of strips of radio frequencies, radio-frequency channels or radio frequencies for production and (or) operation of RES and (or) VChU which are source of electromagnetic radiation declared for registration;

compliance of parameters of the declared RES and (or) VChU which are source of electromagnetic radiation, to requirements of technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, obligatory for observance.

9. The state inspectorate for results of consideration of documents and data makes the decision on registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment or about refusal in their registration.

In case of decision making about registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment the State inspection grants to the interested person the registration certificate.

In case of decision making about refusal in registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment the State inspection the motivated notification on refusal sends to the interested person to their registration.

The bases for refusal in registration of RES and (or) VChU which are source of electromagnetic radiation, civil appointment are:

determination that they are not RES and (or) VChU which are source of electromagnetic radiation, civil appointment or are not subject to registration according to legal acts;
