Approve the enclosed features of determination of the starting (maximum) price of the contract which subject is performance of works on construction, reconstruction, capital repairs of the capital construction projects located in the territory of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region or the Kherson region, the price of such contract signed with the single supplier (the contractor, the contractor) and also feature of acceptance and payment of the specified works.

2. This resolution becomes effective since May 1, 2023, is applied when implementing purchases of goods, works, services to ensuring the state and municipal needs, notices on which implementation are placed in unified information system in the sphere of purchases or the invitation to take part in determination of the supplier (the contractor, the contractor) on which are directed after day of entry into force of this resolution, and is effective till January 1, 2028.

1. Determination of the starting (maximum) price of the contract which subject is performance of works on construction, reconstruction, capital repairs of the capital construction projects located in the territory of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region or the Kherson region, the price of such contract signed with the single supplier (the contractor, the contractor) (further respectively - the contract, the starting (maximum) price of the contract, the price of the contract signed with the single supplier) is performed in the following procedure:

a) in case of availability of the project documentation approved by the customer including estimate documentation or the estimate on capital repairs of capital construction project determination of the starting (maximum) price of the contract, the price of the contract signed with the single supplier is performed by means of application of project and estimate method according to Item 1 of part 9 of article 22 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - the Federal Law on contractual system);

b) in case of lack of the project documentation approved by the customer including estimate documentation or the estimate on capital repairs of capital construction project determination of the starting (maximum) price of the contract, the price of the contract signed with the single supplier is performed according to the procedure, approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation according to part 59 of article 112 of the Federal Law on contractual system.

2. In case of execution of the contract the following features of acceptance and payment of the works specified in Item 1 of this document are applied:

a) for the purposes of implementation of acceptance and payment for work the document on acceptance provided by part 7 of article 94 of the Federal Law on contractual system is constituted, signed and goes without use of unified information system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs. The procedure and terms of creation, signing and direction of such document on acceptance are established by the customer in the contract;

b) payment for work under the contract is performed according to the estimate of the contract taking into account the works which are actually performed by the contractor and the costs which are actually incurred by the contractor within the finished limits of the budget obligations.
