Approve the enclosed Rules of accession and interaction of communication networks for distribution of programs of television broadcasting and (or) broadcasting and to enact them since March 1, 2007.

Rules of accession and interaction of communication networks for distribution of programs of television broadcasting and (or) broadcasting

I. General provisions

1. These rules determine procedure for accession of communication networks for distribution of programs of television broadcasting and (or) broadcasting (further - TV and radio broadcasting) and their interactions, procedure for accession of communication networks for distribution of programs of TV and radio broadcasting (further - TV and radio broadcasting communication network) and their interactions with communication network of TV and radio broadcasting of the operator of communication network of the TV and radio broadcasting which is the operator holding essential position in public communication network (further - the operator of communication network of TV and radio broadcasting holding essential position), and also essential conditions of accession of such networks and their interaction.

2. The communication network of TV and radio broadcasting is part of the public communication network determined by technology of realization of communication services provision and includes:

a) networks of land on-air TV and radio broadcasting;

b) networks of cable TV and radio broadcasting;

c) networks of satellite TV and radio broadcasting;

d) networks of wire broadcasting.

3. The concepts used in these rules designate the following:

a) "broadcaster" - the user communication services for the purposes of TV and radio broadcasting who constitutes TV programs and (or) radio programs for their acceptance by the indefinite group of people and based on the license for broadcasting extends them or provides their distribution in complete and invariable form by the third party;

b) "accession of communication networks of TV and radio broadcasting" - establishment of technical and technological interaction of means of communication of two communication networks of TV and radio broadcasting in case of which there is possible omission of signals of TV programs and (or) radio programs between these networks, passing other communication networks;

c) "teleradio program signal" - electric signal of the program of television broadcasting and (or) broadcasting which technological parameters are determined by the broadcaster according to technical regulations and standards;

d) "the accession point" - the means of communication which are part of one communication network of TV and radio broadcasting by means of which physical connection of means of communication of other communication network of TV and radio broadcasting is performed and is provided possibility of the omission of signals of teleradio programs between these networks.

II. Procedure for accession of communication networks of TV and radio broadcasting

4. Accession of communication networks of TV and radio broadcasting and their interaction is performed based on the Treaty of Accession of such networks signed by operators of these communication networks (further - the Treaty of Accession) and with observance of the requirements established by the legislation of the Russian Federation, including these rules.

5. Operators of communication networks of TV and radio broadcasting render services of accession to operators of any communication networks of TV and radio broadcasting specified in Item 2 of these rules.

6. Operators of communication networks of TV and radio broadcasting shall organize accession points with observance of requirements to creation of communication networks of TV and radio broadcasting.

7. The service of accession of communication networks of TV and radio broadcasting rendered by the operator of communication network of TV and radio broadcasting includes:

a) approval of the design estimates necessary for other operator of communication network of TV and radio broadcasting for realization of the conditions of accession of communication network of TV and radio broadcasting and the omission of signals of teleradio programs established by the Treaty of Accession;

b) mounting and adjustment of the means of communication forming accession point;

c) accession of communication network of TV and radio broadcasting;

d) servicing of the means of communication forming accession point, during the term of the agreement about accession.

8. In the Treaty of Accession consent concerning all essential conditions of accession of the communication networks of TV and radio broadcasting and their interaction provided in the Section IV of these rules shall be reached.

9. To the relations of operators of communication networks of TV and radio broadcasting according to the conclusion of the Treaty of Accession, except as specified, when one of them is the operator of communication network of TV and radio broadcasting holding essential position the rules of the direction of the offer and receipt of the acceptance provided by the civil legislation of the Russian Federation are applied.

10. During the commissioning of new means of communication, implementation of new technology solutions in the communication network of TV and radio broadcasting, output from operation or upgrade of obsolete means of communication that significantly influences conditions of accession of other communication networks of TV and radio broadcasting and the omission of signals of teleradio programs, the relevant operator of communication network of TV and radio broadcasting shall notify on it operators of the interacting networks beforehand.

11. The operator of communication network of TV and radio broadcasting shall provide possibility of the omission of signals of teleradio programs from the broadcaster to the operator of the interacting TV and radio broadcasting communication network with preserving technological parameters of signals of teleradio programs.

12. Operators of communication networks of TV and radio broadcasting record services in the omission of signals of teleradio programs proceeding from amount of the transferred information or value of bandwidth of the communication line connecting the interacting networks.
