About approval of the Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles

For the purpose of implementation of the Decision of Council of the Eurasian economic commission "About modification of the Decision of the Commission of the Customs union of December 9, 2011" of April 5, 2022 No. 45, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No. 877:

1. Approve Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles

1. General provisions

1. This Provision determines the mandatory requirements applied concerning separate wheel vehicles of the categories L, M, N and O and also the chassis made in the Kyrgyz Republic, procedure for application of these mandatory requirements, procedure for evaluating compliance of such vehicles in case of impossibility of evaluating compliance of wheel vehicles (chassis) according to requirements of the Technical regulation of the Customs union "About safety of wheel vehicles" (TR CU 018/2011) approved by the Decision of the Commission of the Customs union of December 9, 2011 No. 877 (further - the Technical regulation).

This Provision does not extend to the wheel vehicles which are in operation.

2. For the purposes of this provision terms in the values established by the Technical regulation and also the following terms are used:

test laboratory - the laboratory accredited according to the international standards ISO/IEC 17025 "General requirements to competence of test and calibrating laboratories" and/or ISO/IEC 17020 "Assessment of conformity. Job requirements of various types of bodies of inspectorate" on the right of evaluating compliance of vehicles;

the single vehicle - the wheel vehicle made in the territory of the Kyrgyz Republic in the conditions of serial production to which design in individual procedure changes before release into the stream of commerce were made, or made out of serial production in individual procedure of assembly set, or which is result of individual technical creativity;

the applicant - the manufacturer (his authorized representative) who addressed with the request for evaluating compliance like the vehicle, type of the chassis or the single vehicle;

the conclusion - the conclusion about assessment like the vehicle (for the wheel vehicle), and (or) the conclusion about assessment like the chassis (for the chassis), and (or) the conclusion about assessment of the single vehicle (for the single vehicle) which are the documents on assessment of conformity certifying compliance of the released vehicles (chassis) to the technical requirements established by this Provision;

the manufacturer - the legal entity or the individual entrepreneur of the Kyrgyz Republic making wheel vehicles of categories L, M, N, O and the chassis, and also wheel vehicles with use of basic vehicles (chassis) which underwent assessment of conformity according to this Provision or requirements of the Technical regulation;

certification body - the certification body accredited in the National accreditation system of the Kyrgyz Republic on the right of evaluating compliance of vehicles to requirements of the Technical regulation and included in national part of the Unified register of conformity assessment bodies of the Eurasian Economic Union created according to the Agreement on the Eurasian Economic Union of May 29, 2014;

the vehicle (chassis) - the wheel vehicle of categories L, M, N, O and the chassis which are object of technical regulation of the Technical regulation, made by the manufacturer including with use of basic vehicles (chassis) which underwent assessment of conformity according to this Provision or requirements of the Technical regulation.

3. Vehicles (chassis) are released and have the right to be in operation in the territory of the Kyrgyz Republic on condition of their compliance to the technical requirements in case of assessment of conformity of vehicles specified in the list according to appendix 1 (further - technical requirements) that is confirmed by the conclusion about assessment like the vehicle in form according to appendix 2 and (or) the conclusion about assessment like the chassis in form according to appendix 3.

Single vehicles are released and have the right to be in operation in the territory of the Kyrgyz Republic on condition of their compliance to the requirements provided in Sections 1-4 of appendix No. 4 to the Technical regulation that is confirmed by the conclusion about assessment of the single vehicle in form according to appendix 4.

Vehicles (chassis) made in the Russian Federation and the Republic of Belarus according to their national requirements established concerning wheel vehicles based on the Decision of Council of the Eurasian economic commission of April 5, 2022 No. 45, can be registered and be in operation in the territory of the Kyrgyz Republic.

4. Concerning types of vehicles (chassis) which underwent assessment of conformity to requirements of the Technical regulation evaluating compliance according to this Provision is not required.

5. The electronic passport of the vehicle (chassis) is drawn up based on the conclusions about assessment like the vehicle, type of the chassis and (or) the single vehicle which numbers are specified in electronic passports of the vehicle and (or) the chassis.

6. Execution of the conclusions about assessment like the vehicle, type of the chassis and (or) the single vehicle is performed on papers without use of special remedies from counterfeit or in electronic form with assignment of numbers according to structure of the document numbers certifying compliance to this Provision according to appendix 5.

Accounting of the issued conclusions is performed by the Center for standardization and metrology under the Ministry of Economy and Trade of the Kyrgyz Republic (further - TsSM).

7. As the documents confirming compliance like the vehicle (chassis) to technical requirements are recognized:

the messages on the official approval of type given by administrative authorities of member countries of the Agreement on adoption of uniform technical instructions for wheel vehicles, pieces of the equipment and parts which can be established and used on wheel vehicles, and about conditions of the mutual recognition of the official approvals issued on the basis of these instructions, concluded on March 20, 1958 in Geneva;

the existing certificates of conformity, declarations of conformity which are drawn up based on test reports, issued within the Technical regulation;

test reports, carried out by accredited test laboratory or the manufacturer (carrying out testing on the equipment of the manufacturer, or in the presence of the representative of certification body, including with use of means of remote interaction, or with video fixing of process of carrying out testing with control of geoline item of the venue of testing is allowed, at the same time record of process of carrying out testing goes to certification body for the analysis and preparation of the test report). Results of the testing conducted by the manufacturer independently are accepted only in case of assessment of conformity of small batches of vehicles (chassis);

the declarations of conformity registered according to provisions of the Technical regulation (accepted according to the scheme 7d - only in case of assessment of conformity of small batches of vehicles (chassis), except categories Sq.m and M3;

the declarations of conformity which are drawn up based on test reports of the vehicle (chassis) - the analogs made in the conditions of other production (it is allowed in case of industrial assembly).

8. As supporting documents concerning components of vehicles which assessment of conformity is carried out according to requirements of Rules of the United Nations (further - the UN) messages on the official approval of type and (or) certificates of conformity issued within requirements of the Technical regulation are recognized.

2. Procedure for evaluating compliance like the vehicle and type of the chassis

1. Assessment of conformity like the vehicle and type of the chassis is carried out by certification body in the following procedure:

1) the applicant submits to certification body the application in which are specified the name of the applicant, the address of its location, phone numbers, the e-mail address, bank details, type of the vehicle or type of the chassis, data on earlier issued approvals like the vehicle or type of the chassis with application of documents specified in Sections 1 and 2 of appendix No. 12 to the Technical regulation;
