About creation of courts of the Russian Federation in the territory of the Kherson region and about modification of separate legal acts of the Russian Federation

Article 1

According to the Federal constitutional Law of October 4, 2022 No. 8-FKZ "About acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation the new subject - the Kherson region" and with article 17 of the Federal constitutional Law of December 31, 1996 No. 1-FKZ "About judicial system of the Russian Federation":

To create 1) in the territory of the Kherson region:

Kherson regional court;

Arbitration Court of the Kherson region;

Aleshkinsky district court;

Belozersk district court;

Berislavsky district court;

Velikoaleksandrovsky interdistrict court;

Velikolepetikhsky interdistrict court;

Genichesky district court;

Golopristansky district court;

Kakhovsky district court;

Novokakhovsky city court;

Novotroitsk interdistrict court;

Skadovsky district court;

Kherson city court;

Chaplynsky interdistrict court;

Kherson garrison military court;

To determine 2) that jurisdiction of the Kherson regional court and Arbitration Court of the Kherson region, created according to Item 1 of this Article, extends to the territory of the Kherson region in the limits set by part 1 of article 3 of the Federal constitutional Law of October 4, 2022 No. 8-FKZ "About acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation of the new subject - the Kherson region";

To determine 3) that jurisdiction of the city, district and interdistrict courts created according to Item 1 of this Article extends to the territories of the following administrative-territorial formations of the Kherson region:

Aleshkinsky district court - on the territory of Aleshkinsky district;

The Belozersk district court - on the territory of the Belozersk district;

Berislavsky district court - on the territory of Berislavsky district;

Velikoaleksandrovsky interdistrict court - in the territory of Velikoaleksandrovsky, High-Polish and Novovorontsovsky municipal districts;

Velikolepetikhsky interdistrict court - in the territory of Velikolepetikhsky, Gornostayevsky, Nizhneserogozsky and Verkhnerogachiksky municipal districts;

Genichesky district court - on the territory of Genichesky district;

Golopristansky district court - on the territory of Golopristansky district;

Kakhovsky district court - on the territory of Kakhovsky district;

Novokakhovsky city court - on the territory of the Novokakhovsky city district;

Novotroitsk interdistrict court - in the territory of Novotroitsk and Ivanovo municipal districts;

Skadovsky district court - on the territory of Skadovsky district;

The Kherson city court - on the territory of the Kherson city district;

Chaplynsky interdistrict court - in the territory of Chaplynsky and Kalanchaksky municipal districts;

4) to Judicial department under the Supreme Court of the Russian Federation to perform the organizational actions connected with execution of this Federal Law.

Article 2

1. The decision on day of the beginning of activities of the court created according to article 1 of this Federal Law accepts the Plenum of the Supreme Court of the Russian Federation and officially informs on it.

2. The courts operating on the date of acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation of the new subject - the Kherson region, continue to perform justice on behalf of the Russian Federation in the specified territory prior to the Plenum of the Supreme Court of the Russian Federation of day of the beginning of activity of the courts determined according to the decision, created according to article 1 of this Federal Law.

Article 3

1. The cases and claims accepted to production by the general courts operating in the territory of the Kherson region on the date of the beginning of activity of the courts, created according to article 1 of this Federal Law, determined according to the decision of the Plenum of the Supreme Court of the Russian Federation, and not considered this day, are transferred for consideration in accordance with the established procedure to the specified courts taking into account their territorial jurisdiction and provisions of the Federal constitutional Law of October 4, 2022 to No. 8-FKZ "About acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation the new subject - the Kherson region".

2. The cases accepted to production of the first instance by economic courts operating in the territory of the Kherson region on the date of the beginning of activity of the courts, created according to article 1 of this Federal Law, determined according to the decision of the Plenum of the Supreme Court of the Russian Federation, and not considered this day, are transferred for consideration in accordance with the established procedure to the Arbitration Court of the Kherson region created according to article 1 of this Federal Law taking into account provisions of the Federal constitutional Law of October 4, 2022 to No. 8-FKZ "About acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation the new subject - the Kherson region".

3. The petitions for appeal accepted to production by the Economic Courts of Appeal operating in the territory of the Kherson region on the date of the beginning of activity of the courts, created according to article 1 of this Federal Law, determined according to the decision of the Plenum of the Supreme Court of the Russian Federation, and not considered this day, are transferred for consideration in accordance with the established procedure to the Twenty first Arbitration Appeal Court.

4. The cases accepted to production of the first instance by administrative courts operating in the territory of the Kherson region on the date of the beginning of activity of the courts, created according to article 1 of this Federal Law, determined according to the decision of the Plenum of the Supreme Court of the Russian Federation, and not considered this day, according to the rules of cognizance established by the procedural legislation of the Russian Federation are transferred for consideration in accordance with the established procedure to the courts of law, Arbitration Court of the Kherson region created according to article 1 of this Federal Law taking into account their subject and territorial jurisdiction and provisions of the Federal constitutional Law of October 4, 2022 to No. 8-FKZ "About acceptance to the Russian Federation of the Kherson region and education as a part of the Russian Federation the new subject - the Kherson region".
