ORDER OF THE GOVERNMENT OF THE REPUBLIC OF TAJIKISTAN

About measures for implementation of the Presidential decree of the Republic of Tajikistan of March 20, 2006 No. 1716

(as amended on 25-09-2015)

In pursuance of the Presidential decree of the Republic of Tajikistan of March 20, 2006 "About measures for strengthening of level of social security of the population and increase in minimum wage, the operating official pay rates of employees of budgetary institutions and the organizations, pensions and grants" the Government of the Republic of Tajikistan decides No. 1716:

1. To the ministries and departments of the Republic of Tajikistan, local executive bodies of the government, the companies, the organizations and organizations irrespective of patterns of ownership and types of activity since April 1, 2006 to perform salary accrual not below the established minimum wage in the amount of 20 somoni a month.

2. Establish since April 1, 2006 the scheme of official pay rates the government employee of public authorities, local executive bodies of the government, salaries on military (special) ranks the serviceman, to faces of the private and the commanding structure of law-enforcement bodies and the staff of other law enforcement agencies, courts, prosecutor's offices according to appendices No. No. 1-39 of the Presidential decree of the Republic of Tajikistan of March 20, 2006 No. 1716.

3. Establish since April 1, 2006 official pay rates to the workers performing maintenance and providing activities of public authorities, local executive bodies of the government, military, law enforcement agencies, courts, prosecutor's offices which list is approved by the order of the Government of the Republic of Tajikistan of March 31, 2003 No. 148, on the basis of the employment contract (contract) at least than the operating minimum wage and no more official pay rate of the specialist of relevant organ of the government.

To the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan in coordination with the Ministry of Finance of the Republic of Tajikistan and the Ministry of Justice of the Republic of Tajikistan to develop and approve rules of determination of regulation of work and amount of work on each unit of the worker of service personnel.

To drivers of office cars to establish the allowance for irregular working hours at the rate to 25 percent having the first class - 25 percent, second class - 10 percent from official pay rate.

4. To the ministries, the state committees, departments, organizations of the Republic of Tajikistan, local executive bodies of the government since April 1, 2006:

a) increase the operating official pay rates and the tariff charges of employees of the organizations and organizations financed from the Government budget in the following sizes:

- to workers of branch of science for 40 percent, at the same time to equate compensation of employees of Academy of agricultural sciences of the Republic of Tajikistan and Academy of pedagogical sciences of the Republic of Tajikistan to employees of Academy of Sciences of the Republic of Tajikistan;

- the operating official pay rates of directors and associate directors of comprehensive schools, boarding schools, orphanages and heads of preschool institutions for 50 percent, to other workers of industry of education for 40 percent, at the same time to equate Compensation of tutors of preschool institutions for payment work of elementary school teachers;

- to employees of organizations of primary health care on average for 60 percent, to other employees of organizations of industry of health care for 40 percent;

- to workers of industry of social protection for 40 percent;

- to workers of industry of culture for 40 percent;

- to workers of other budget industries for 40 percent;

b) increase the operating sizes of Presidential grants, grants of graduate students by 40 percent and grants of students of organizations of the higher and secondary professional education for 50 percent.

5. To the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan:

- since April 1, 2006 to perform charge of the minimum size of old-age pension taking into account the general working life necessary for charge of full pension in the amount of 20 somoni a month and the maximum size of old-age pensions of 180 somoni a month;

- increase since April 1, 2006 the sizes of work pensions by indexation of earnings from which pensions using the raising coefficients are granted and counted, retired during the period:

till 1994 139,3 coefficient

in 1994 - 111,4 coefficient

in 1995 - 42,4 coefficient

in 1996 - 13,2 coefficient

in 1997 - 7,9 coefficient

in 1998 - 4,2 coefficient

in 1999 - 3,3 coefficient

in 2000 - 2,5 coefficient

in 2001 - 1,7 coefficient

in 2002 - 1,6 coefficient

in 2003 - 1,3 coefficient

in 2004 - 1,06 coefficient

in 2005 - 1,03 coefficient

- increase since April 1, 2006 pensions to lonely women and widows in the amount of 50 percent from minimum pension;

- develop and approve the instruction about procedure for recalculation of earnings from which pensions using the raising coefficients established by this resolution are granted and counted;

- in coordination with the Ministry of Finance of the Republic of Tajikistan to develop and provide to the Government of the Republic of Tajikistan rules of calculation of average earnings for payment of labor leaves, temporary disability benefits, dismissal wages, benefits paid according to the procedure of compensation of the caused damage to health and in other cases connected with payment of the average salary;

- together with the State agency of social insurance and pension and Government savings bank of the Republic of Tajikistan of Amonatbonk to provide payment of the operating pensions taking into account their recalculation.

6. Ceased to be valid according to the Order of the Government of the Republic of Tajikistan of 25.09.2015 No. 590

7. To heads of public authorities, military, law enforcement agencies, prosecutor's office and courts in a month:

- provide offers on modification of the operating regulatory legal acts regulating procedure and payment terms of work of government employees, military personnel, faces of the private and the commanding structure of law-enforcement bodies, other law enforcement agencies, bodies of prosecutor's office and courts, taking into account the made changes to the legislation of the Republic of Tajikistan;

- bring structure of number and staff lists of divisions of central office and subordinated bodies into compliance with provision of "Standard requirements to structural divisions of offices of the central authorities and public administration of the Republic of Tajikistan" approved by the order of the Government of the Republic of Tajikistan of December 3, 2005 No. 478-14 and taking into account the made changes by this resolution.

8. To the Ministry of Health of the Republic of Tajikistan in coordination with the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan and the Ministry of Finance of the Republic of Tajikistan:
