About the status of senator of the Russian Federation and the status of the deputy of the State Duma of Federal Assembly of the Russian Federation

2. 3. Article 2. Senator of the Russian Federation, the deputy of the State Duma in system of the state positions of the Russian Federation

1. The status of senator of the Russian Federation, the status of the deputy of the State Duma are determined by the Constitution of the Russian Federation and this Federal Law.

2. On amount of social guarantees senators of the Russian Federation and deputies of the State Duma are equated to the federal minister, the Chairman of the Federation Council and the Chairman of the State Duma - to the Russian Prime Minister, the Deputy Chairman of the Federation Council and the Deputy Chairman of the State Duma - to the Deputy Prime Minister of Russia.

2.1. In cases if other legal acts for senator of the Russian Federation - the President of the Russian Federation who stopped execution of the powers and also for members of his family provide other regulations establishing higher level of their legal protection, material and social security provisions of these acts are applied to specified persons.

a) the monthly monetary reward, cash encouragement and other payments provided by this Federal Law and (or) regulations of chambers of Federal Assembly of the Russian Federation within the means provided by the Federal Law on the federal budget for the corresponding year on functioning of the Federation Council, State Duma;

b) annual paid leave;

c) transfer of time of implementation of powers of senator of the Russian Federation, the deputy of the State Duma in years of service of the public civil service;

d) medical, sanatorium attendance of senator of the Russian Federation, deputy of the State Duma and members of their families;

e) provision of pensions, including provision of pensions of members of their families in case of the death of senator of the Russian Federation, the deputy of the State Duma;

e) compulsory national insurance of senator of the Russian Federation, the deputy of the State Duma on damnification case to their health and property;

g) compulsory national social insurance of senator of the Russian Federation, the deputy of the State Duma on case or disabilities during execution by senator of the Russian Federation, the deputy of the State Duma of the powers;

h) domestic providing senator of the Russian Federation, the deputy of the State Duma who do not have living space in the city of Moscow;

i) other social guarantees provided for federal ministers.

4. Officials of federal bodies of the government and their territorial authorities, public authorities of subjects of the Russian Federation, local government bodies within the competence shall provide to senator of the Russian Federation, the deputy of the State Duma of condition for implementation of the powers established by the Constitution of the Russian Federation, this Federal Law by them.

5. Additional terms for implementation by senator of the Russian Federation, the deputy of the State Duma, the being disabled people of the I group, the powers are determined by the resolution of the relevant chamber of Federal Assembly of the Russian Federation.

Article 3. Term of office of senator of the Russian Federation, deputy of the State Duma

1. The procedure for establishment of term of office of senator of the Russian Federation and procedure for establishment of terms of the beginning and the termination of implementation by senator of the Russian Federation of the powers are determined according to the Constitution of the Russian Federation and the Federal Law on procedure for forming of the Federation Council of Federal Assembly of the Russian Federation.

2. The term of office of the deputy of the State Duma begins from the date of election as his deputy of the State Duma and stops from the date of the beginning of work of the State Duma of new convocation, except as specified, provided by parts one, third and fifth article 4 of this Federal Law.

Article 4. Early termination of powers of senator of the Russian Federation, deputy of the State Duma

1. Powers of senator of the Russian Federation, the deputy of the State Duma stop ahead of schedule in cases:

a) the written application of senator of the Russian Federation, the deputy of the State Duma about addition of the powers;

b) elections of senator of the Russian Federation, deputy of the State Duma as the deputy of legislative (representative) public authority of the subject of the Russian Federation or representative body of the municipality, elected official of other public authority or elected official of local self-government, and equally in appointment of senator of the Russian Federation, deputy of the State Duma to other state position of the Russian Federation, state position of the subject of the Russian Federation, arrival of senator of the Russian Federation, deputy of the State Duma to the public or municipal service;

c) participations of senator of the Russian Federation, the deputy of the State Duma in activities for management of economic society or other commercial organization in case, stipulated in Item "" of part two of article 6 of this Federal Law, implementation of business or other paid activity by them, except teaching, scientific and other creative activities which financing does not contradict requirements, stipulated in Item "in" part two of article 6 of this Federal Law;

century 1) entries of senator of the Russian Federation, the deputy of the State Duma into structure of governing bodies, trustee or supervisory boards, other bodies of foreign non-profit non-governmental organizations and their structural divisions operating in the territory of the Russian Federation if other is not provided by the international treaty of the Russian Federation or the legislation of the Russian Federation;

century 2) opening (availability) of accounts (deposits), storage of cash and values in the foreign banks located outside the territory of the Russian Federation, ownership and (or) use of foreign financial instruments of senator of the Russian Federation, the deputy of the State Duma, their spouses and minor children. concerning the deputy of the State Duma - when he was registered as the candidate on elections of deputies of the State Duma;

century 4) non-presentation or untimely representation by senator of the Russian Federation, the deputy of the State Duma of data on the income, about the property and obligations of property nature provided by the Federal Law of December 25, 2008 No. 273-FZ "About anti-corruption" and data on the expenses provided by the Federal Law of December 3, 2012 No. 230-FZ "About control of compliance of expenses of persons replacing the state positions, and other persons to their income";

d) the terminations of citizenship of the Russian Federation senator of the Russian Federation, the deputy of the State Duma or acquisition by senator of the Russian Federation, the deputy of the State Duma of nationality (citizenship) of foreign state or receipt of the residence permit or other document confirming the right to permanent residence of the citizen of the Russian Federation in the territory of foreign state;

e) introductions in legal force of conviction of court against person who is senator of the Russian Federation, the deputy of the State Duma;

e) introductions in legal force of the judgment about legal incapacity of senator of the Russian Federation, the deputy of the State Duma or about recognition by their incapacitated;

g) recognitions of senator of the Russian Federation, the deputy of the State Duma it is unknown absent or announcements their dead based on the judgment which took legal effect;
