1. Approve the enclosed Storage precautions and realization (shipments, acceptance) ethyl alcohol.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Ergozhin of E.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and information system of law of Adilet;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Storage precautions and realization (shipments, acceptance) ethyl alcohol

Chapter 1. General provisions

1. These rules of storage and realization (shipment, acceptance) ethyl alcohol (further – Rules) are developed according to the subitem 7) of Item 2 of article 4 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of ethyl alcohol and alcoholic products" and determine procedure for storage and realization (shipment, acceptance) ethyl alcohol.

2. Storage and realization of ethyl alcohol are performed in the presence of the license for production of ethyl alcohol which form is approved by the order of the Minister of national economy of the Republic of Kazakhstan of January 6, 2015 No. 3 "About approval of forms of statements for obtaining and renewal of the license and (or) appendix to the license, forms of licenses and (or) appendices to licenses" (it is registered in the Register of state registration of regulatory legal acts at No. 10195), from storage facilities of the producer of ethyl alcohol.

The license for production of alcoholic products (except brewing products) allows to the producer storage of the ethyl alcohol intended for production of alcoholic products in storage facilities in the location of the production of alcoholic products specified in the license.

3. Realization of ethyl alcohol is allowed:

1) to the organizations for production of medicines, products of medical appointment and the state organizations of health care in the presence of the license for the corresponding type of activity, within allocated quotas;

2) to producers of alcoholic products on which development ethyl alcohol is used;

3) to the organizations using ethyl alcohol in the technical purposes for laboratory needs or in case of production of not alcoholic products.

4. Realization of the confiscated ethyl alcohol is allowed only by producers of ethyl alcohol and alcoholic products.

Chapter 2. Procedure for storage of ethyl alcohol

Storage of ethyl alcohol is performed in the storage facilities of the producer intended only for storage, acceptance and leave of the ethyl alcohol meeting the qualification requirements approved by the order of the Minister of Finance of the Republic of Kazakhstan of January 30, 2015 No. 60 "About approval of qualification requirements and the list of the documents confirming compliance to them for implementation of activities in spheres of production of ethyl alcohol, production of alcoholic products, storage and wholesale of alcoholic products, except for activities for storage and wholesale of alcoholic products in the territory of its production, and also storage and retail sale of alcoholic products except for activities for storage and retail sale of alcoholic products in the territory of its production" (it is registered in the Register of state registration of regulatory legal acts at No. 10422) and the production specified in the passport which list of data is approved by the order of the Minister of Finance of the Republic of Kazakhstan of February 11, 2015 No. 82 "About approval of the list of necessary data for the passport of production of ethyl alcohol and alcoholic products" (it is registered in the Register of state registration of regulatory legal acts at No. 10461).

6. Ethyl alcohol is stored in steel reservoirs of different capacity and form with the compulsory provision of possibility of measurement of alcohol availability in them on amount and established in the specialized stationary rooms and platforms (opened, closed).

7. In storage of ethyl alcohol to each reservoir the open entry from all directions for survey of the reservoir with ethyl alcohol, with installation of ladders and platforms for work on reservoir cover (sampling, measurement of level of alcohol) is provided.

8. For observation of alcohol level in reservoirs the explosion-proof automatic signaling devices of limit preventing overflow of reservoirs are established.

Chapter 3. Procedure for realization of ethyl alcohol within allocated quotas to the organizations for production of medicines, products of medical appointment and the state organizations of health care in the presence of the license for the corresponding type of activity and also which notified on the beginning of the activities in accordance with the established procedure

9. Realization of ethyl alcohol to the organizations for production of medicines, products of medical appointment and the state organizations of health care in the presence of the license for the corresponding type of activity and also which notified on the beginning of the activities in accordance with the established procedure (further – the Receiver 1), is performed within allocated quotas.

10. The subject having the right to perform activities for production and realization of ethyl alcohol (further – the Supplier) implements ethyl alcohol to Receivers 1 according to the list in form according to appendix 1 to these rules.
