1. Approve the enclosed Method of calculation of infrastructure charges.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Method of calculation of infrastructure charges

Chapter 1. General provisions

1. This Method of calculation of infrastructure charges (further - the Technique) is developed according to subitem 41-78) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

2. The purpose of the Technique is determination of the mechanism of calculation of the infrastructure collection levied by the operator of the airport (airfield) for use of infrastructure facilities, the equipment and technical means of the airport from the service providers of ground handling operations and airlines which are independently servicing the air vehicles, passengers, baggage, load and mail.

The list of the services of ground handling operations which are part of airport activities to which access for service providers of ground handling operations and independent ground handling operations of airlines is open is established in appendices 6, of 7 Rules of implementation of ground handling operations at the airports approved by the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of October 2, 2019 No. 750 (it is registered in the Register of state registration of regulatory legal acts for No. 19433).

The operator of the airport (airfield) does not levy from the airline performing independent ground handling operations, other payments for use of property, including infrastructure facilities, the equipment and technical means of the airport if the airline pays infrastructure collection for use of this property.

3. In this Technique the following concepts are applied:

1) the service provider of ground handling operations - the physical person or legal entity rendering services of ground handling operations on airport site (airfield), except for the operator of the airport (airfield) and the airline which is independently servicing the air vehicles, passengers, baggage, load and mail;

2) independent ground handling operations (self-service) - implementation of one or several types of service of ground handling operations by airline for own needs and/or air vehicles, passengers, baggage, load and mail of airlines, fifty and more percent of voting shares of which belong to it, without the conclusion of the contract with the third parties;

3) infrastructure facility - the property of the airport intended for rendering airport activities, including for provision of services of ground handling operations on airport site (airfield);

4) infrastructure collection - the collection levied by the operator of the airport (airfield) from the service providers of ground handling operations and airlines performing independent ground handling operations for use of infrastructure facilities, the equipment and technical means of the airport.

Other terms and concepts used in this Technique are applied according to the legislation of the Republic of Kazakhstan in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation.

Chapter 2. The mechanism of calculation of the infrastructure collection levied by the operator of the airport (airfield) for use of infrastructure facilities, the equipment and technical means of the airport

When forming infrastructure collection by the operator of the airport (airfield) in its costly part expenses on the infrastructure facilities which are directly used by service providers of ground handling operations and the airlines which are independently servicing the air vehicles, passengers, baggage, load and mail when rendering services of ground handling operations of open access at the airport and services of ground handling operations of limited access at the airport (platform servicing) are considered including:

1) material costs;

2) expenses on repair work (the routine maintenance and overhaul repairs which is not leading to value addition of fixed assets) in need of their carrying out;

3) expenses on compensation of personnel of the operator of the airport (airfield), including payments of surcharges and allowances for the working conditions provided by wages system according to the labor law of the Republic of Kazakhstan;

4) the depreciation charges directed to carrying out the capital repair work leading to value addition of fixed assets, realization of investing programs (projects), acquisition of the fixed assets and intangible assets which are directly used in rendering services of ground handling operations of open access at the airport and services of ground handling operations of limited access at the airport (platform servicing);

5) payment for emission to the environment;

6) obligatory types of insurance, taxes, charges and other obligatory payments in the budget;
