1. Approve the enclosed Procedure for the traceability of batches of the quarantine products (quarantine freights, quarantine materials, quarantine goods) imported on customs area of the Eurasian Economic Union and moved on customs area of the Eurasian Economic Union (further - the Procedure).

2. This Decision becomes effective after 12 months from the date of its official publication, except for Procedure Item 20, but not earlier than the date of entry into force of the Protocol on introduction of amendments to the Agreement on the Eurasian Economic Union of the May 29, 2014 signed on March 31, 2022.

Item 20 of the Procedure becomes effective after 12 months from the date of the introduction of this Decision in force.

Procedure for the traceability of batches of the quarantine products (quarantine freights, quarantine materials, quarantine goods) imported on customs area of the Eurasian Economic Union and moved on customs area of the Eurasian Economic Union

I. General provisions

1. This Procedure determines the sequence of actions for ensuring traceability of batches of the quarantine products (quarantine freights, quarantine materials, quarantine goods) with high phytosanitary risk according to the list according to appendix (further - quarantine products) imported from the third countries on customs area of the Eurasian Economic Union (further - the Union) and moved on customs area of the Union, within phytosanitary quarantine control (supervision) for the purpose of ensuring quarantine phytosanitary safety on customs area of the Union.

2. Action of this Procedure extends on:

a) authorized bodies on quarantine of plants of state members of the Union (further respectively - authorized bodies, state members);

b) the legal entities and physical persons including registered as individual entrepreneurs, performing import from the third countries to customs area of the Union and movement on customs area of the Union of batches of quarantine products;

c) the legal entities and physical persons including registered as individual entrepreneurs whose activities are connected with production of quarantine products.

3. Traceability of batch of quarantine products is performed before its arrival in the destination on customs area of the Union.

4. For the purposes of this Procedure concepts which mean the following are used:

"identification batch number of quarantine products" - the alphanumeric or digital code assigned for each batch of quarantine products by the authorized body exercising primary phytosanitary quarantine control (supervision) in the place of arrival of such batch or authorized body of the exporting country (reexporter) in case of execution of the phytosanitary certificate;

"traceability of batch of quarantine products" - possibility of authorized body with use of information system documentary to identify batch of quarantine products and the place of origin of batch of quarantine products, and also to confirm arrival of such batch in the destination on customs area of the Union;

"means of identification" - marking, barcode, QR code, seal and other means applied according to acts of bodies of the Union, allowing to identify batch of quarantine products.

Other concepts used in this Procedure are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014, the international treaties and acts constituting the right of the Union.

II. Collection and information analysis

5. The legal entities and physical persons including registered as individual entrepreneurs, performing import from the third countries to customs area of the Union and movement on customs area of the Union of batch of quarantine products represent with use of the information system of authorized body providing registration and accounting of documents of phytosanitary quarantine control (supervision) (further - information system), to authorized body of the state member the following data:

a) the name of the legal entity, surname, name, middle name (in the presence) the physical person including registered as the individual entrepreneur;

b) registration or accounting (individual, identification) number;

c) location addresses and places of implementation of activities;

d) amount of batch and type of quarantine products (code (codes) of the CN FEA EEU);

e) name and address of production site of batch of quarantine products (if necessary).

6. The legal entities and physical persons including registered as individual entrepreneurs whose activities are connected with production of quarantine products represent with use of information system, to authorized body of the state member the following data:

a) the name of the legal entity, surname, name, middle name (in the presence) the physical person including registered as the individual entrepreneur;

b) registration or accounting (individual, identification) number;

c) location addresses and places of implementation of activities;

d) structure of sown areas of the current vegetative period;

e) productivity by cultures in the current vegetative period;

e) production site (country of source) of seed and landing material, name of grade.

7. Submission of the data specified in Items 5 and 6 of this Procedure is not required if such data contain in information system.

8. For the purpose of providing the proyelezhivayemost of batch of the quarantine products imported from the third countries on customs area of the Union and moved on customs area of the Union, the authorized body enters results of the quarantine phytosanitary events held concerning batch of quarantine products into information system.
