1. Approve enclosed:

1) Rules of implementation of verification of documents and data, survey and (or) examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, according to appendix 1 to this order;

2) form of the inspection report of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union according to appendix 2 to this order;

3) form of the act of goods inspection, moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, according to appendix 3 to this order.

2. Procedure to provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the established legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General procedure

1. These rules of implementation of verification of documents and data, survey and (or) examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union (further – Rules) are developed according to Item 11 of article 28 of the Law of the Republic of Kazakhstan "About control of specific goods" (further – the Law) and determine procedure bodies of state revenues (further – OGD) verifications of the documents and data, survey and (or) goods inspection moved through Frontier of the Republic of Kazakhstan (further – Gosgranitsa) with state members of the Eurasian Economic Union (further – EEU).

Chapter 2. Procedure of verification of the documents and data moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, goods

2. The official of OGD when implementing verification of documents and data, compares the data containing in the provided physical persons and legal entities performing movement of goods, transport (transportation) and business documents:

1) with the data received from the information systems used by OGD;

2) with the data received by the methods which are not prohibited by the legislation of the Republic of Kazakhstan.

3. In the absence of the facts specifying illicit movement of specific goods, the official of OGD returns the provided documents to physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – to physical persons, managing directors of the vehicle on which goods are transported.

4. In case of identification of the specific goods moved through Gosgranitsa with state members of EEU without the permission the official of OGD accepts according to Item 2 of article 27 of the Law the decision on prohibition of export, import or transit of specific goods (further – the Decision on prohibition).
