1. Approve:
1) Regulations on procedure for compensation of consumption of natural gas to not residential customers for the first 500 m 3, according to appendix No. 1;
2) Regulations on procedure for compensation of consumption of natural gas to not residential customers who perform certain core activities, according to appendix No. 2.
2. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
3. I reserve control of execution of this order.

to the Order of the Ministry of Economic Development and digitalization of the Republic of Moldova of March 9, 2023 No. 27
The regulations on procedure for compensation of consumption of natural gas to not residential customers for the first 500 m3 (further - the Provision) are developed for the purpose of execution of Item 1 of the Order No. 59/2023 of the Commission on emergency situations of the Republic of Moldova.
2. This Provision regulates the mechanism of partial compensation of consumption of natural gas to not residential customers for the first monthly consumed 500 m3.
3. Compensation for the first monthly consumed 500 m3 of natural gas, in the amount of leu 12,27 excluding VAT for each cubic meter of natural gas, is provided in cold season from January 1, 2023 to March 31, 2023.
4. For the purpose of this provision the following concepts are determined:
not residential customer - the physical person or legal entity acquiring natural gas at suppliers of natural gas for other purposes than own domestic needs, except for public bodies and organizations;
the supplier of natural gas - the gas company, the owner of the license for supply of natural gas delivering natural gas according to the Law No. 108/2016 on natural gas.
5. Compensation is paid on one not residential customer irrespective of whether he has one delivery agreement of natural gas to several places of consumption or several delivery agreements of natural gas to different places or regions of the Republic of Moldova. Compensation is paid on each not residential customer once a month irrespective of with how many suppliers of natural gas he signs delivery agreements of natural gas.
6. If at not residential customer delivery agreements of natural gas are signed with JSC Moldovagaz and along with other suppliers of natural gas, the company of JSC Moldovagaz, as the supplier as a last resort, it is appointed for charge to not residential customer of compensation in limits to 500 m 3, consumed monthly.
7. Compensation in the amount of leu 12,27 excluding VAT on each not residential customer is calculated proceeding from gas consumption amount in all places of consumption (counters) of not residential customer, since the greatest amount of consumption and further in the decreasing procedure.
8. Monthly, no later than the 4th of current month, the supplier of natural gas determines compensation amount for the natural gas delivered within a month, preceding month under report.
9. In the invoices on payment which are written out to not residential customers total amount for the delivered natural gas according to the prices which are regulated/approved by NARE, the amount of compensation excluding VAT and the amount which is subject to payment by each not residential customer after recalculation separately is specified.
10. Compensations are provided to not residential customers at whom delivery agreements of natural gas, by suppliers of natural gas are signed with entering into the invoice on payment of special record which forms for the legal entity the basis for inclusion of this amount of financial accounting.
11. The compensation amount is subtracted from the amount on the payment calculated by the supplier of natural gas and brought in the invoice on the payment sent to not residential customers.
12. The financial resources provided on compensation of the price for natural gas are paid to suppliers of natural gas and not issued to not residential customers.
13. The report on the financial resources necessary for financing of compensations, on number of beneficiaries - not residential customers and amount of consumption of natural gas, according to the established regulations, is constituted and it is represented monthly according to appendix No. 1 to this Provision, accompanied by the detailed information on each consumer according to appendix No. 2 to this Provision. Appendix No. 2 is represented in electronic format - in the Excel file and PDF to the address e-mail: compensatiegaz@me.gov.md. The version of PDF shall be certified by the digital signature person who is responsible for its creation or the authorized person.
14. Compensation is provided for the last month.
15. After verification of information on compensation amount, suppliers of natural gas monthly represent, to the 10th following after month of consumption to Financial classified service of the Ministry of Economic Development and digitalization, on the e-mail address given above, summary reports on the financial resources necessary for financing of compensations, on number of beneficiaries - not residential customers and amount of consumption of natural gas, according to the established regulations, according to appendix No. 1 and, respectively, appendix No. 2 to this Provision.
16. In addition to summary reports suppliers of natural gas submit also the Detailed report about the financial resources necessary for financing of compensations for the natural gas delivered to not residential customers within consumption amount to 500 m3.
