the commitment form of employers, customers of works (services), including the foreign citizens registered as individual entrepreneurs, about manpower requirement for replacement of the vacant and created workplaces with foreign workers and procedure for its filling;

form of representation by subjects of the Russian Federation of offers on the need for involvement of foreign workers and on amounts of quotas for implementation by foreign citizens of labor activity in the Russian Federation, and also requirements to reasons for these offers.

3. To the Ministry of Health and Social Development of the Russian Federation with participation of the Ministry of Economic Development and Trade of the Russian Federation till March 1, 2007 to approve technique of efficiency evaluation of use of foreign labor power.

4. To make to the Ministry of Labour and Social Protection of the Russian Federation explanations on application of the Rules approved by this resolution.

5. Recognize invalid Items 2 - 4 orders of the Government of the Russian Federation of October 30, 2002 as N782 "About Approval of Quota for Issue to Foreign Citizens of Invitations to Entry into the Russian Federation for the purpose of Implementation of Labour Activity" (The Russian Federation Code, 2002, N 44, the Art. 4394).

6. This resolution becomes effective since January 15, 2007.

Rules of determination by executive bodies of the government of the need for involvement of foreign workers and forming of quotas for implementation by foreign citizens of labor activity in the Russian Federation

I. General provisions

1. These rules regulate procedure for determination by federal executive bodies and executive bodies of the government of subjects of the Russian Federation of the need for involvement of foreign workers and forming of quotas for implementation by foreign citizens of labor activity for the Russian Federation which are understood as quotas for issue to foreign citizens of invitations to entry into the Russian Federation for the purpose of implementation of labor activity and quota for issue to foreign citizens of work permits (further - quotas).

2. Determination of the government of subjects of the Russian Federation by executive bodies of the need for involvement of foreign workers and forming of quotas are performed with participation of the interested territorial authorities of federal executive bodies based on proposals of employers and customers of works (services), including the foreign citizens registered as the individual entrepreneurs (daleerabotodatel) attracting for the purpose of implementation of labor activity of foreign citizens.

The need for involvement of foreign workers is determined taking into account types of economic activity, professions, specialties and qualification, and also country of source (the state of civil accessory) of foreign workers.

3. The need for involvement of foreign workers determined by executive bodies of the government of subjects of the Russian Federation is used by federal executive bodies for determination in general across the Russian Federation:

the needs for involvement of foreign workers, including on priority vocational groups;

quotas for issue to foreign citizens of invitations to entry into the Russian Federation for the purpose of implementation of labor activity;

quotas for issue to the foreign citizens who arrived to the Russian Federation according to the procedure, not requiring receipt of a visa, work permits.

4. Methodical ensuring activities of executive bodies of the government of subjects of the Russian Federation by determination of need for involvement of foreign workers and preparation of offers on amounts of quotas is performed by the Ministry of Labour and Social Protection of the Russian Federation.

II. Procedure for determination in subjects of the Russian Federation the needs for involvement of foreign workers and preparation of offers on amounts of quotas

For the purpose of the organization and coordination of work on determination of the need for involvement of foreign workers and preparation of offers on amounts of quotas in subjects of the Russian Federation the solution of management officials of subjects of the Russian Federation (heads of the supreme executive bodies of the government of subjects of the Russian Federation) determines authorized bodies of the executive authority of subjects of the Russian Federation (daleeupolnomochenny bodies of subjects of the Russian Federation).

6. Authorized bodies of subjects of the Russian Federation with participation of local government bodies and tripartite commissions on regulation of the social and labor relations of subjects of the Russian Federation inform employers on procedure for preparation of offers on the need for involvement of foreign workers.

7. Employers annually, till May 1, submit to authorized bodies of subjects of the Russian Federation the request about manpower requirement for replacement forthcoming year of the vacant and created workplaces with foreign workers (further - the request of employers).

The commitment form of employers and procedure for its filling affirm the Ministry of Labour and Social Protection of the Russian Federation.

8. Requests of employers are submitted to authorized bodies of subjects of the Russian Federation in the territory of which implementation by foreign citizens of labor activity is provided.

9. Authorized bodies of subjects of the Russian Federation annually, till June 1, generalize requests of employers and send them for consideration:
