1. Approve the enclosed Rules of maintaining the State register of the control and cash equipment, and also the requirement to its structure and the scope of information.

2. Determine that the information about the control and cash technician containing in the State register of cash registers is considered included in the State register of the control and cash equipment from the date of entry into force of this resolution.

Rules of maintaining the State register of the control and cash equipment, and also requirement to its structure and scope of information

1. These rules determine procedure for maintaining the State register of the control and cash equipment, and also the requirement to its structure and the scope of information.

2. The state register of the control and cash equipment (further the State register) is the state information resource and is in federal property.

3. The basis for inclusion in the State register of data on model of the control and cash equipment, exception of the specified data and modification of them is the relevant decision of the Federal Tax Service.

4. The state register of the control and cash equipment consists of two Sections.

The first Section of the State register contains data on the models of the control and cash equipment applied by the organizations and individual entrepreneurs when implementing by them of cash cash payments and (or) calculations with use of payment cards in cases of sales of goods, performance of works or rendering services, except for data on the models of the control and cash equipment applied by credit institutions when making cash transactions.

6. The second Section of the State register contains data on models of the control and cash equipment allowed for use by credit institutions when making cash transactions and also on the software products used in them and is created based on the information provided by the Central bank of the Russian Federation.

7. The first Section of the State register contains the following data:

a) the name of model of the control and cash equipment and details printed by the provided sample of model of the control and cash equipment on the cash register receipt;

b) about person providing production, distribution of model of the control and cash equipment, and also rendering services in its commissioning, serviceability check, repair, maintenance and conclusion from operation including delivery for it spare parts (further - the supplier);

c) dates and numbers of decisions on inclusion of data on model of the control and cash equipment in the State register, about modification of the specified data and on their exception of the State register.

8. For inclusion in the first Section of the State register of data on model of the control and cash equipment the supplier represents to the Federal Tax Service:

a) sample of model of the control and cash equipment with the software;

b) the statement for inclusion in the State register of data on model of the control and cash equipment containing the following data:

name of model of the control and cash equipment;

the name of the supplier of model of the control and cash equipment with indication of form of business and the place of its stay - for the organization or surname, name, middle name, the residence and data of the identity document, - for the individual entrepreneur;

c) following documents:

the copy of the document on state registration of the organization as the legal entity - for the organization;

the copy of the certificate on state registration of a person as an individual entrepreneur - for the individual entrepreneur;

the technical documentation and the passport of model of the control and cash equipment necessary for its registration in tax authority, commissioning and application, with appendix of color photos of model of the control and cash equipment in two foreshortenings (in one photo the forward, upper and left parties and on another - the lower, back and right parties of model are represented) 18 x 24 cm in size;

the list of the details printed on the cash register receipt by the corresponding model of the control and cash equipment with samples of the cash register receipts printed by the provided sample of model of the control and cash equipment;

the copy of the certificate of conformity of the provided sample of model of the control and cash equipment to the requirements for electric safety and electromagnetic compatibility established by the legislation of the Russian Federation regarding safety of operation of devices and the equipment.

8.1. The Federal Tax Service receives the following information about the supplier:

from the Federal Tax Service - the information about the legal entity containing in the Unified State Register of Legal Entities or the information about the individual entrepreneur containing in the Unified State Register of Private Entrepreneurs;

from Federal Agency for Technical Regulation and Metrology - data on the certificate of conformity of the provided sample of model of the control and cash equipment to the requirements for electric safety and electromagnetic compatibility established by the legislation of the Russian Federation regarding safety of operation of devices and the equipment.

The specified documents can be submitted by the supplier. Non-presentation of the specified documents by the supplier is not the basis for refusal in consideration of the application.

The Federal Tax Service has no right to demand from the supplier of submission of documents and information or implementation of actions, representation or implementation of which is not provided by these rules.

9. If copies of documents are not certified by the notary, they are represented with presentation of the original.

10. For modification of the data provided by the subitem "b" of Item 7 of these rules, the supplier submits in the Federal Tax Service the application for modification of the data on model of the control and cash equipment included in the State register.

11. The sample of model of the control and cash equipment, the corresponding statement and documents specified in the subitem "v" of Item 8 of these rules are accepted by the Federal Tax Service according to the inventory which copy goes (is handed) to the supplier with indication of date of acceptance.
