About approval of the Procedure for conducting inspection of the gambling equipment

According to Item 8, parts two of article 22 of the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" and the paragraph of the twenty fifth subitem 1 of item 4 of the Regulations On the Commission on regulation of gamblings and lotteries approved by the resolution of the Cabinet of Ministers of Ukraine of September 23, 2020 No. 891, the commission on regulation of gamblings and lotteries solved 15 parts one of Article:

1. Approve the Procedure for conducting inspection of the enclosed gambling equipment.

2. To provide to department of methodology together with department of legal providing in the procedure established by the legislation submission of this decision on state registration in the Ministry of Justice of Ukraine.

3. To provide to department of documentary providing and organizational work promulgation of this decision after its state registration.

4. This decision becomes effective from the date of its official publication.

5. Control over the implementation of this decision to assign to the Chairman of KRAIL.

Procedure for conducting inspection of the gambling equipment

I. General provisions

1. This Procedure determines the procedure of conducting inspection of the gambling equipment by conformity assessment bodies (further - bodies for inspection) for the purpose of assessment and determination of compliance of the gambling equipment to technical requirements, including, established for such gambling equipment by the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings".

2. This Procedure extends to organizers of gamblings and the bodies for inspection which are carrying out inspection of the gambling equipment.

3. The gambling equipment which is subject to obligatory certification which exclusive list is approved by the Decision of the Commission on regulation of gamblings and lotteries of April 01, 2021 No. 128 "About approval of the list of the gambling equipment which is subject to certification", registered in the Ministry of Justice of Ukraine on April 06, 2021 at No. 453/36075, is subject to inspection.

4. Inspection of the gambling equipment which is subject to obligatory certification which exclusive list is approved by the Decision of the Commission on regulation of gamblings and lotteries of April 01, 2021 No. 128 "About approval of the list of the gambling equipment which is subject to certification", registered in the Ministry of Justice of Ukraine on April 06, 2021 at No. 453/36075, is carried out by bodies for inspection which list is determined by the commission on regulation of gamblings and lotteries (further - authorized body).

5. In this procedure terms are used in the values given in the Laws of Ukraine "About state regulation of activities for the organization and carrying out gamblings", "About technical regulations and assessment of conformity", "About accreditation of conformity assessment bodies" and other regulatory legal acts governing the relations in the field of the organization and carrying out gamblings, DSTU ENISO/IEC 17020:2019 "Assessment of conformity. Job requirements of different types of bodies for inspection" (ENISO/IEC 17020:2012, IDT; IDT ISO/IEC 17020:2012,) (further - DSTU ENISO/IEC 17020).

II. Organization and conducting inspection of the gambling equipment

1. Inspection of the gambling equipment is carried out by the bodies for inspection accredited by National authority of Ukraine on accreditation or accreditation of which by foreign accreditation body is recognized based on the international treaty of Ukraine on compliance to requirements of the ISO/IEC 17020 standards (DSTU ISO/IEC 17020) and ISO/IEC 17025 (DSTU ISO/IEC 17025) or other standards which they are replaced, on conducting inspection of the gambling equipment.

Inspection of the gambling equipment is carried out by authorized persons (inspectors) of body for inspection.

2. Conducting inspection of the gambling equipment is provided with the organizer of gamblings.

3. Inspection of the gambling equipment cannot be carried out by body for inspection which is resident of the foreign state recognized under the law as the state invader and/or the state aggressor in relation to Ukraine according to the legislation or person who is directly or indirectly controlled by residents of such foreign state or is effective in their interests.

4. Inspection of the gambling equipment is carried out as in rooms of gambling institutions (in special gambling zones) and in the location of the gambling equipment used by organizers of gamblings for implementation of activities for the organization and carrying out gamblings on the Internet.

5. Each unit of the gambling equipment which is operated by organizers of gamblings is subject to inspection of the gambling equipment.

6. Obligatory inspection of the gambling equipment is carried out no later than one month from the date of connection of the gambling equipment to the state system of online monitoring and at least once in two years.

7. The structure, the number of persons and terms of conducting inspection of the gambling equipment are determined by body for inspection taking into account amount of the gambling equipment and territorial placement, at the same time the term of conducting inspection of the gambling equipment cannot be more than 30 calendar days.

8. The general procedure for conducting inspection of the gambling equipment includes procedures:

application by the organizer of gamblings for inspection of the gambling equipment;

analysis of the request body for inspection of the gambling equipment;

decision making by body for inspection about conducting inspection of the gambling equipment;
