About approval of Requirements for fight against the expressed game dependence (ludomaniy)

According to Item 16 parts one of article 8 of the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings", the paragraph of the twenty sixth subitem 1 of item 4 of the Regulations On the Commission on regulation of gamblings and lotteries approved by the resolution of the Cabinet of Ministers of Ukraine of September 23, 2020 No. 891, and for the purpose of minimization of negative effects of participation of physical person in gambling the Commission on regulation of gamblings and lotteries solved creations of conditions for decrease in the social risks connected with the organization and carrying out gamblings, fight against the expressed game dependence (ludomaniy):

1. Approve the enclosed requirements for fight against the expressed game dependence (ludomaniya).

2. To provide to department of methodology together with department of legal providing in the procedure established by the legislation submission of this decision on state registration in the Ministry of Justice of Ukraine.

3. To provide to department of documentary providing and organizational work promulgation of this decision after its state registration.

4. This decision becomes effective from the date of its official publication.

5. Control over the implementation of this decision to assign to the Chairman of KRAIL.

The requirements regarding fight against the expressed game dependence (ludomaniy)

1. These requirements establish the principles of fight against the expressed game dependence (ludomaniy) and the main conditions to which organizers of gamblings when taking measures to prevention and fight against the expressed game dependence shall follow (ludomaniy).

2. Terms in these requirements are used in the values given in the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" (further - the Law) and other regulatory legal acts governing the relations in the field of the organization and carrying out gamblings.

3. These requirements extend to organizers of the gamblings, players, visitors, persons entered in the register of persons which limits access to gambling institutions and/or participation in gamblings and persons at whom game dependence (ludomaniya) is expressed.

4. The principles of fight against the expressed game dependence (ludomaniy) are:

1) ensuring prevention of emergence of the expressed game dependence (ludomaniya) at person;

2) ensuring protection of the rights of players and minimization of manifestations of the expressed game dependence (ludomaniya);

3) increase in awareness by ensuring informing the population on negative effects of the expressed game dependence (ludomaniya);

4) assistance to ensuring responsible financial behavior with physical person for the purpose of minimization of negative effects of participation of physical person in gambling by increase in financial culture of the population (prevention of forming of opinion on possibility of easy prize in gambling, participations in gamblings as alternatives of labor activity or permanent source of the income);

5) observance by organizers of gamblings of the principles of responsible game;

6) assistance to development of institutes of civil society and the healthcare institutions giving help to persons with signs of game dependence, suppliers of the social services providing social service of social psychological recovery of persons with game dependence.

5. The organizer of gamblings shall take the following measures directed to fight against the expressed game dependence (ludomaniy):

1) to adhere to the principles of responsible game approved by the decision of KRAIL of August 11, 2021 No. 483, registered in the Ministry of Justice of Ukraine on August 31, 2021 at No. 1141/36763 (further - the principles of responsible game);

2) to limit participation of person in gamblings by entering into the register of persons which limits access to gambling institutions and/or participation in gamblings;

3) in places of implementation of activities in the field of the organization and carrying out gamblings in open entry for players and visitors to place information materials on game dependence, including as factor of difficult vital circumstances, responsible game, in particular about restriction of age of the player, chances of prize, the principles of responsible game, concerning places where, according to requirements of the legislation of Ukraine, it is possible to receive the help in case of gambling dependence, the suppliers of the social services providing social service of social psychological recovery of persons with game dependence, including, the next to the appropriate place of implementation of activities in the field of the organization and carrying out gamblings, stated in state language and translated into English of the reference to the register of suppliers and receivers of social services;

To provide 4) to players information (contact information, phone of support service) on activities of healthcare institutions and/or health workers who, according to requirements of the legislation of Ukraine, treat game dependence which shall be available in printed form implementation of activities for the organization of gamblings in places or shall be available on websites in case of implementation of activities in the field of the organization and carrying out gamblings on the Internet;

5) to provide periodic briefings with personnel concerning the principles of responsible attitude to the corresponding gamblings and actions directed to prevention (prevention) of emergence of game dependence.

6. The organizer of gamblings is forbidden to accept rates in gambling at persons who cannot be players according to the law.

7. The organizer of gamblings shall enter the procedures (policy) giving the chance authentically to identify (to verify, establish data) age of the player, and also to determine persons who according to requirements of the law are not allowed to participation in gambling.
