About bodies of military police

This Law governs the public relations connected with activities of bodies of military police.

Chapter 1. General provisions

Article 1. Appointment of bodies of military police

Bodies of military police are intended to provide law and order in Armed Forces of the Republic of Kazakhstan, other troops and military forming (further - Armed Forces, other troops and military forming) within the competence established by the legislation of the Republic of Kazakhstan.

Article 2. Status of bodies of military police

1. Bodies of military police of Armed Forces are the military division which is part of special troops of Armed Forces.

Bodies of military police of Committee of homeland security of the Republic of Kazakhstan (further - bodies of military police of Committee of homeland security) are military forming as a part of Committee of homeland security.

Bodies of military police of National guard of the Republic of Kazakhstan (further - bodies of military police of National guard) are structural division of National guard.

2. The Minister of Defence of the Republic of Kazakhstan (further - the Minister of Defence), the Minister of Internal Affairs of the Republic of Kazakhstan (further - the Minister of Internal Affairs), the Chairman of Committee of homeland security of the Republic of Kazakhstan (further - the Chairman of Committee of homeland security) respectively perform management of activities of bodies of military police of Armed Forces, bodies of military police of National guard, bodies of military police of Committee of homeland security according to the legislation of the Republic of Kazakhstan, approve their structure and the number of staff, adopt regulatory legal acts and decisions on holding organizational and regular actions.

Article 3. Legal basis of activities of bodies of military police

1. The legal basis of activities of bodies of military police is constituted by the Constitution of the Republic of Kazakhstan, this Law, the international agreements ratified by the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan.

2. If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 4. Principles of activities of bodies of military police

Activities of bodies of military police are performed on the principles:

1) legality;

2) obligation of protection of rights and freedoms of man and citizen, interests of society and the state from illegal encroachments;

3) one-man management and subordination;

4) independence of activities of political parties and other public associations.

Chapter 2. Tasks, competence and powers of bodies of military police

Article 5. Tasks of bodies of military police

1. The following tasks are assigned to bodies of military police:

1) providing law and order in Armed Forces, other troops and military forming within the competence established by the legislation of the Republic of Kazakhstan;

2) prevention, the prevention, identification, suppression, consideration and investigation of offenses within the competence established by the legislation of the Republic of Kazakhstan;

3) execution of the punishment in the form of arrest, administrative detention, and also other measures of temporary isolation of the military personnel from society.

2. Accomplishment of special tasks on ensuring fighting activities of Armed Forces is also assigned to bodies of military police of Armed Forces.

3. Accomplishment of tasks is also assigned to bodies of military police of Committee of homeland security on:

1) to protection of objects of bodies of homeland security of the Republic of Kazakhstan (further - bodies of homeland security);

2) coordination of activities of bodies of homeland security for cases on administrative offenses.

4. Other tasks are assigned to bodies of military police by the laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.

Article 6. Competence of bodies of military police

1. Bodies of military police within the assigned tasks:

1) studying of the reasons and conditions promoting making of offenses perform package of measures, directed to preserving and strengthening of law and order, by identification;

2) perform package of measures for providing law and order in garrisons, military camps, military units (organizations);

3) ensure traffic safety of vehicles of bodies of homeland security, Armed Forces, National guard;

4) is performed by the prevention of corruption and identification of corruption offenses among the military personnel and faces of civil personnel (workers);

5) perform production on cases on administrative offenses;

6) perform pre-judicial investigation on cases on criminal offenses;

7) perform search of the military personnel;

8) will organize activities of guardrooms and rooms for temporarily detained, perform content in them of the military personnel, and also their convoy out of guardroom limits.

2. Bodies of military police of Armed Forces also:

1) participate in coordination of activities of Armed Forces concerning the organization of service of daily details, internal and garrison services, antidiversionary safety, anti-terrorist security, safety of military service, and also operation of technical means of protection of military units (organizations);

2) perform protection of object - the building of the Ministry of Defence of the Republic of Kazakhstan (further - the Ministry of Defence) with the territories and constructions adjoining to it, including with use of arms, special means, security systems and other technical means of protection, and also provide on the specified object access control according to the procedure and limits which are determined by the Minister of Defence.

3. Bodies of military police of Committee of homeland security also:

1) according to the procedure and the limits determined by the Chairman of Committee of homeland security coordinate activities of bodies of homeland security for cases on administrative offenses;

2) perform protection of objects of bodies of homeland security, including with use of arms, special means, security systems and other technical means, and also provide on the specified objects the throughput and inside modes according to the procedure and limits which are determined by the Chairman of Committee of homeland security;

3) perform coordination of ensuring physical and technical security of objects of bodies of homeland security.

4. Bodies of military police perform other powers provided by the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

Article 7. Powers of bodies of military police

1. Bodies of military police shall:
