About the territories of traditional environmental management of indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation

This Federal Law establishes the legal basis of education, protection and use of the territories of traditional environmental management of indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation for maintaining by them in these territories of traditional environmental management and traditional conduct of life.

Chapter I. General provisions

Article 1. Basic concepts

In this Federal Law the following basic concepts are used:

the territories of traditional environmental management of indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation (further the territories of traditional environmental management) - especially protected territories formed for conducting traditional environmental management and traditional conduct of life by indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation;

traditional environmental management by indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation (further traditional environmental management) - the methods of use of objects of animal and flora, other natural resources by indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation which historically developed and providing inexhaustible environmental management;

customs of indigenous ethnic groups of the North, Siberia and the Far East of the Russian Federation (further - customs of the small people) the North which traditionally developed and widely applied by indigenous ethnic groups, Siberia and the Far East of the Russian Federation (further the small people) rules of conducting traditional environmental management and traditional conduct of life.

Article 2. Legal regulation of the relations in the field of education, protection and use of the territories of traditional environmental management

Legal regulation of the relations in the field of education, protection and use of the territories of traditional environmental management is performed by this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, and also the laws and other regulatory legal acts of subjects of the Russian Federation.

If the international treaty of the Russian Federation establishes other rules, than those which are stipulated by the legislation the Russian Federation about the territories of traditional environmental management are applied rules of the international treaty of the Russian Federation. The decisions of interstate bodies made based on provisions of international treaties of the Russian Federation in their interpretation contradicting the Constitution of the Russian Federation are not subject to execution in the Russian Federation. Such contradiction can be established according to the procedure, determined by the Federal constitutional Law.

For the purposes of this Federal Law legal regulation of the specified relations can be performed by customs of the small people if such customs do not contradict the legislation of the Russian Federation, the legislation of subjects of the Russian Federation.

Article 3. The relations regulated by this Federal Law

This Federal Law governs the relations in the field of education, protection and use of the territories of traditional environmental management for maintaining in these territories of traditional environmental management and traditional conduct of life by persons belonging to the small people, and the communities of the small people, and also persons who are not belonging to the small people, but which are constantly living in places of their traditional accommodation and traditional economic activity, leaders the same, as well as small people, traditional environmental management and traditional conduct of life, according to the procedure, established by the laws of subjects of the Russian Federation.

Article 4. Purposes of this Federal Law

The purposes of this Federal Law are:

protection of the primordial habitat and traditional conduct of life of the small people;

preserving and development of original culture of the small people;

preserving in the territories of traditional environmental management of biological diversity.

Chapter II. Formation of the territories of traditional environmental management

Article 5. Types of the territories of traditional environmental management

Taking into account features of legal regime of the territories of traditional environmental management such territories belong to especially protected territories of federal, regional and local importance.

Article 6. Procedure for formation of the territories of traditional environmental management of federal importance

Formation of the territories of traditional environmental management of federal importance is performed by decisions of the Government of the Russian Federation in coordination with public authorities of appropriate subjects of the Russian Federation based on addresses of persons belonging to the small people and communities of the small people or their authorized representatives.

Article 7. Procedure for formation of the territories of traditional environmental management of regional value

Formation of the territories of traditional environmental management of regional value is performed by decisions of executive bodies of subjects of the Russian Federation based on addresses of persons belonging to the small people and communities of the small people or their authorized representatives.

Formation of the territories of traditional environmental management of regional value which are in the territories of several subjects of the Russian Federation is performed by decisions of executive bodies of appropriate subjects of the Russian Federation.

Article 8. Procedure for formation of the territories of traditional environmental management of local value

Formation of the territories of traditional environmental management of local value is performed by decisions of local government bodies based on addresses of persons belonging to the small people and communities of the small people or their authorized representatives.

Formation of the territories of traditional environmental management of local value which are in the territories of several municipalities is performed by decisions of local government bodies of the respective municipalities.

Article 9. Sizes and borders of the territories of traditional environmental management

The sizes of the territories of traditional environmental management are determined taking into account the following conditions:
