About approval of standard rates of compensation of losses of flora
According to Item 2 of article 45 of the Law of the Republic of Kazakhstan "About flora" I ORDER:
1. Approve the enclosed standard rates of compensation of losses of flora.
2. To provide to committee of forestry and fauna of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.
4. This order becomes effective since March 7, 2023 and is subject to official publication.

In cases of removal of wild-growing plants (irretrievable loss) on the parcels of land of all categories of the lands transferred to other categories for the purposes of subsurface use, constructions (reconstruction) of buildings, constructions, roads, pipelines and other objects according to the project documentation on such objects which received the positive decision of the state environmental assessment, and also compulsory acquisition of the parcel of land for the state needs. |
According to base rates for calculation of the extent of the harm done by the violation of the law of the Republic of Kazakhstan in the field of protection, protection, recovery and use of flora approved by authorized body in the field of protection, protection, recovery and use of flora. |
The amount of compensation of losses includes: 1) amount of the double size basic to rates; 2) market value being on the site of plants; 3) the cost of the costs connected with protection, protection, recovery and use of flora taking into account their inflation; 4) losses, caused to the owner or the user of flora in connection with withdrawal of the parcel of land at the time of the termination of the property right or land use, including losses which they incur in connection with early termination of the obligations to the third parties. |

Losses of flora are compensated by physical persons or legal entities for the benefit of which wild-growing plants, according to these standard rates of compensation of losses of flora are removed.
Losses of flora are subject to compensation in six-months time from the moment of decision making about provision of the right to the parcel of land.
