About counteraction of extremist activities

Chapter 1. General provisions

Article 1. Legal basis of counteraction of extremist activities

The legal basis of counteraction of extremist activities is constituted by the Constitution of the Kyrgyz Republic, this Law and other regulatory legal acts of the Kyrgyz Republic, the conventional principles and rules of international law, and also the international agreements which became effective according to the legislation of the Kyrgyz Republic.

Article 2. Tasks of this Law

Tasks of this Law are determination and establishment of legal and organizational basis for:

1) preventions, identifications, suppression of extremist activities and elimination of the reasons and conditions promoting making of these acts;

2) enhancement of interstate interaction of subjects of counteraction of extremist activities;

3) developments of international cooperation in the sphere of counteraction of extremist activities.

Article 3. Basic principles of counteraction of extremist activities

Counteraction of extremist activities is based on the principles:

1) supremacy of law;

2) legality;

3) providing and protection of rights and freedoms of man and citizen;

4) nondiscriminations on the basis of sex, races, language, disability, ethnic origin, religion, age, political or other convictions, education, origin, property or other status;

5) public, including interethnic, interethnic and interfaith concord;

6) priority of the measures directed to the prevention (prevention) of extremist activities;

7) cooperation of the state with legal entities and physical persons, and also the international and other organizations in counteraction of extremist activities.

Article 4. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) extremist activities:

a) actions for planning, the organization, preparation and making of the acts directed on:

- forcible seizure of power;

- public calls for the forcible seizure of power;

- separatist activities;

- armed rebellion;

- excitement of racial, ethnic, race, religious or interregional hatred (discord);

- creation of the extremist organization and (or) participation in its activities;

- financing of the extremist organization or extremist activities;

- production, distribution of extremist materials;

- use of attributes and symbolics of the extremist organization;

b) making of other acts for extremist motives integrated to violence or leading to the violent acts recognized by those the penal legislation of the Kyrgyz Republic;

2) extremist organization:

a) the organized group aiming at implementation of extremist activities;

b) the legal entity or other organization on whom the judgment of the Kyrgyz Republic is made on liquidation and (or) you will lock activities in connection with implementation of extremist activities, taken legal effect;

3) extremist materials - the information materials intended for distribution on any carriers, calling, proving or justifying need of implementation of extremist activities, recognized by court those;

Attributes and symbolics of the extremist organization - attributes and symbolics of the organization concerning which the court passes the decision on its liquidation or you will lock 4) activities in connection with implementation of extremist activities. 6) counteraction of extremist activities - the activities of state bodies aimed at providing national security, protection of rights and freedoms of man and citizen, bases of the constitutional system against extremist activities, the prevention, identification and suppression of extremist activities and liquidation of its consequences;

7) caution - the official document which is taken out by authorized state body on counteraction of extremist activities concerning physical persons and legal entities, other organizations, specifying inadmissibility of distribution of extremist materials and implementation of extremist activities in the absence of signs of crimes of extremist orientation. The form and procedure for removal of caution are determined by the Cabinet of Ministers of the Kyrgyz Republic.

Article 5. International cooperation in the sphere of counteraction of extremist activities

The state bodies of the Kyrgyz Republic performing counteraction of extremist activities interact with law enforcement agencies of foreign states, and also the international organizations according to the national legal system and on the basis of the international treaties which became effective according to the legislation of the Kyrgyz Republic.

Chapter 2. Bases of the organization of counteraction of extremist activities

Article 6. Subjects of counteraction and prevention of extremist activities and their competence

1. Subjects of counteraction of extremist activities in the Kyrgyz Republic are the state and its bodies.

2. The president of the Kyrgyz Republic heads and directs activities of executive bodies in the sphere of counteraction of extremist activities.

3. Cabinet of Ministers of the Kyrgyz Republic:

1) will organize development and approves programs (plans) in the sphere of counteraction of extremist activities and takes necessary measures for their realization;

2) determines competences of state bodies by counteraction of extremist activities;

3) will be organized by interaction of state bodies and local government bodies according to the prevention of extremist activities;

4) will be organized by ensuring activities of state bodies for counteraction of extremist activities with necessary forces, means and resources;

5) is approved by regulations on the interdepartmental commission on counteraction of extremist activities.

4. State bodies perform counteraction and prevention of extremist activities within the competences determined by the Cabinet of Ministers of the Kyrgyz Republic.

5. Local government bodies:

1) together with the state bodies performing counteraction of extremist activities participate in holding actions for general prevention of extremist activities, and also minimization and (or) mitigation of consequences of its manifestations;
