About measures for ensuring protection of ozone layer and climate

Based on the paragraph of the sixth of article 6 of the Law of the Republic of Belarus of November 12, 2001 No. 56-Z "About protection of ozone layer", article 2 of the Law of the Republic of Belarus of October 13, 2022 No. 212-Z "About ratification of the amendment to the Montreal protocol on the substances destroying ozone layer" Council of Ministers of the Republic of Belarus DECIDES:

1. Establish:

1.1. annually admissible amount of consumption of the ozone-depleting substances in the Republic of Belarus included in group I of appendix C to the Montreal protocol on the substances destroying ozone layer of September 16, 1987 (further - the Montreal protocol), in 2023-2029 - no more 0,5 of percent a year from settlement level of consumption of such substances or 0,25 of metric ton taking into account ozone-depleting capability in the presence of reasons for the purposes and amounts of consumption of such substances;

1.2. admissible amounts of consumption of the substances in the Republic of Belarus included in appendix F to the Montreal protocol in the values expressed in tons of carbon dioxide equivalent (further - CO2 экв):

in 2023-2024 - no more 4,824 of one million tons of CO2 экв annually;

in 2025-2028 - no more 3,301 of one million tons of CO2 экв annually;

in 2029-2033 - no more 1,523 of one million tons of CO2 экв annually;

in 2034-2035 - no more 1,016 of one million tons of CO2 экв annually;

in 2036 and the next years - no more 0,762 of one million tons of CO2 экв annually.

2. For the purpose of ensuring maintenance and repair of the equipment and technical devices for which according to technical characteristics ozone-depleting substances are necessary subjects of managing * perform:

use of the ozone-depleting substances included in group I of appendix C to the Montreal protocol till December 31, 2035 in the presence of reasons for the purposes and amounts of their application;

consumption and use of the recovered ozone-depleting substances which are prohibited to import according to the Montreal protocol, in the absence of inventories of such substances in necessary amounts.

In case of need operation of the equipment and technical devices for which according to technical characteristics the ozone-depleting substances included in group I of appendix C to the Montreal protocol after December 31, 2035 are required use of the recovered ozone-depleting substances is allowed.

* For the purposes of this resolution subjects of managing are understood as legal entities and individual entrepreneurs to whom according to the procedure, the established legislation on licensing, are provided to the license for activities connected with impact on the environment, the constituting works and (or) services of which are transactions with ozone-depleting substances.

3. Annually till February 1 of the year following reporting to provide to the State Customs Committee in the Ministry of Natural Resources and Environmental Protection the data of customs statistics of foreign trade in goods of the Republic of Belarus with the states which are not members of the Eurasian Economic Union, and statistics of mutual trade in goods of the Republic of Belarus with state members of the Eurasian Economic Union, not containing information, distribution and (or) provision of which is limited, on the goods classified by codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, included in lists A, B, C and E of Section 1.1 and Section 2.1 of the single inventory to which measures of non-tariff regulation in trade with the third countries are applied stipulated in Item 4 Protocols on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014).

4. 1, of 2, the 5 and 6 resolutions of Council of Ministers of the Republic of Belarus of December 5, 2014 No. 1143 "About measures for implementation of the Law of the Republic of Belarus "About modification and amendments in some laws of the Republic of Belarus concerning protection of ozone layer" to exclude Items.

5. Recognize invalid resolutions of Council of Ministers of the Republic of Belarus according to appendix.

6. This resolution becomes effective after its official publication.
