About approval of the State program "Available country" for persons with disability and other handicapped national groups in the Kyrgyz Republic for 2023-2030

For the purpose of support of persons with disability and other handicapped national groups in compliance to regulations of the Convention of the UN on the rights of disabled people accepted by the General Assembly of the United Nations according to the Law of the Kyrgyz Republic "About ratification of the Convention of the UN on the rights of disabled people accepted by the General Assembly of the United Nations on December 13, 2006 and signed on September 21, 2011" articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

- The state program "Available country" for persons with disability and other handicapped national groups in the Kyrgyz Republic for 2023-2030 (further - the State program "Available country") according to appendix 1;

- the actions plan for 2023-2026 on realization of tasks of the State program "Available country" according to appendix 2;

- the financial plan for 2023-2026 on implementation of the State program "Available country" according to appendix 3;

- matrixes of indicators of the State program "Available country" according to appendix 4;

- forms of the reporting under execution of the State program "Available country" according to appendix 5.

2. To the ministries and other state bodies, local public administrations and local government bodies (in coordination):

- take necessary measures for execution of the State program "Available country" at the scheduled time;

- provide following the results of half-year and year, to the 10th following the accounting period, information on execution of the State program "Available country" in the Ministry of Labour, social security and migration of the Kyrgyz Republic;

- enable the realization of the State program "Available country" within approved budgets for the corresponding year, and also other sources which are not forbidden by the legislation of the Kyrgyz Republic.

3. To the Ministry of Labour, social security and migration of the Kyrgyz Republic to provide summary information on the course of accomplishment of the State program "Available country" in Administration of the President of the Kyrgyz Republic following the results of half-year and year, no later than the 25th following the accounting period.

4. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

The state program "Available country" for persons with disability and other handicapped national groups in the Kyrgyz Republic for 2023-2030

1. Introduction

The state program "Available country" for persons with disability and other handicapped national groups in the Kyrgyz Republic for 2023-2030 (further - GP "Available Country") is aimed at providing the rights of persons with disability and handicapped national groups, and also in realization of regulations of the Convention of the UN on the rights of disabled people, on the basis of long-term strategic objectives of development of the country with orientation per capita and emphasis on the fundamental obligation "not leave anybody behind" Sustainable development goals.

GP "Available Country" determines the main directions and actions for providing the available circle for handicapped national group (further - MGN) which persons with disability constituting about 3% of the population, elderly citizens - about 5%, children up to 12 years - about % 29,2 treat, and others. Taking into account requirements of the Convention of the UN about the rights of disabled people (further - KPI) ratified by the Kyrgyz Republic in 2019 and also provisions of the International classification of functioning, restrictions of activity and health (further - MKF), the available circle is provided by the removal of obstacles and barriers arising at the individual or group of people taking into account their special needs, to physical environment, transport, information and communication.

KPI determines that the State Parties take proper measures for providing to disabled people of access on an equal basis with others to physical environment, transport, information and communication, including information and communication technologies and systems, and also to other objects and services opened or provided for the population.

These measures including the identification and removal of obstacles and barriers disturbing availability shall extend, in particular:

a) on buildings, roads, transport, other internal and external objects, including schools, apartment houses, medical institutions, workplaces, etc.;

b) on information, communication and other services, including electronic services and the emergency services;

c) on social programs and social services, including the rehabilitation and abilitation causing possibility of effective social adaptation of persons with disability in society.

According to "Standard rules of providing equal opportunities for the disabled people" accepted by the resolution 48/96 of the United Nations General Assembly of December 20, 1993, the states follows:

a) perform the action programs to make material environment available to disabled people;

b) take measures for providing information access and communication with it.

For the purpose of sustainable development of the UN (further - TsUR) the subject of disability is touched in seven tasks, as a part of five purposes, six more purposes contain the tasks connected with the inclusive development considering interests of persons with disability.

TsUR - set is more whole for international cooperation from 2015 to 2030. Document TsUR "Transformation of our world: The agenda in the field of sustainable development for the period till 2030" contains 17 global purposes and 169 corresponding tasks which imply taking measures, the limited resources directed to optimum use and use of eco-friendly technologies, preserving stability of social and cultural systems, ensuring integrity of biological and physical natural systems.

Availability of the circle is one of the major prerequisites and conditions of providing human rights and freedoms and is determined by the level of its possible use by the corresponding national group.

Ensuring availability of the circle to persons with disability and other MGN is one of the major social and economic tasks which need of the decision follows both from requirements of the national legal system, and from KPI and other international obligations of the Kyrgyz Republic.

For the solution of this task the Cabinet of Ministers of the Kyrgyz Republic implements GP "Available Country" for persons with disability and other handicapped national groups in the Kyrgyz Republic for 2023-2030.

2. Basic concepts and determinations

social infrastructure - set of the industries, the companies and organizations which are functionally providing normal activity of the population, it: housing, its construction, subjects to welfare appointment, all sphere of housing and communal services, company and organization of health care systems, educations, preschool education; the companies and the organizations connected with rest and leisure; retail trade, public catering, service industry, sports organizations; passenger transport and communication on servicing of the population; system of the organizations rendering services of legal, financial and credit nature (legal advice bureaus, notary offices, savings banks, banks), etc.;

universal design - the design of objects, situations, programs and services designed to make them in the greatest possible degree suitable for use for all people without the need for adaptation or special design. "The universal design" does not exclude assistivny devices for specific groups of disabled people where it is necessary;
