1. This Provision determines procedure for evaluating compliance of opportunities of the licensee to licensed requirements of implementation of activities for ensuring fire safety (further – assessment) and examinations of compliance of opportunities of the license applicant to dolitsenzionny requirements, the licensee to licensed requirements of implementation of activities for ensuring fire safety (further if other is not provided, – examination).
2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About licensing" and also the following terms and their determinations are used:
expert body – the bodies and divisions for emergency situations authorized on conducting examination;
the expert – the employee of bodies and divisions for emergency situations authorized on conducting examination.
3. Experts and employees of "The Republican Center of Certification and Examination of the Licensed Types of Activity" organization of the Ministry of Emergency Situations (further – the Republican center) provide completeness, quality of the carried-out expertize, estimates and reliability of the conclusions drawn in the conclusion by their results.
4. Expertize is carried out by experts based on the decision on purpose of examination. The decision on purpose of examination is made by the Republican center for form according to appendix and goes to the address of the expert body within two working days from the date of following behind day of registration of a statement of the license applicant about provision of the license or statement of the licensee for change of the license.
5. In case of decision making about purpose of examination the expert body which is entrusted with the conducting examination is determined.
The expert body is determined proceeding from the administrative-territorial principle of stay (registration) of the license applicant (licensee). Conducting examination can be entrusted to several expert bodies.
6. In case of receipt of the decision on purpose of examination by the relevant expert organ within five working days from the date of following behind day of receipt of the decision the agreement on conducting examination of compliance of opportunities of the license applicant to dolitsenzionny requirements, the licensee to licensed requirements of implementation of activities for ensuring fire safety which shall contain data on object of examination, terms of its carrying out according to requirements of Item 2 of article 32 of the Law of the Republic of Belarus "About licensing", expense budget on conducting this examination, procedure for its payment, responsibility of the parties and other conditions by agreement of the parties is signed with the license applicant (licensee).
7. Expertize is carried out by at least than two experts who are determined by the head (person fulfilling its duties) of expert body.
8. When conducting examination by experts observance by the license applicant of dolitsenzionny requirements, is determined by the licensee of licensed requirements for the works and (or) services constituting activities for ensuring fire safety declared by the license applicant (licensee) of the list.
9. Expertize is carried out on the following stages:
studying of availability on the property right or other legal cause of the equipment, devices (gages) and tools necessary for performance of works and (or) rendering the services constituting activities for ensuring fire safety for the list of the equipment, devices (gages) and tools necessary for performance of works and (or) rendering the services constituting the licensed activities for the ensuring fire safety established by the resolution of the Ministry of Emergency Situations of the Republic of Belarus of December 9, 2022 No. 75 "About the list of the equipment, devices (gages) and tools";
studying of availability in staff of three and more workers (technical leads, specialists, workers) with necessary according to the legislation for implementation of activities for ensuring fire safety with qualification, the performed works which were trained (advanced training) taking into account profile and assessment of knowledge according to the procedure, established by the Instruction about procedure for training (advanced training) and assessment of knowledge of workers of license applicants on implementation of activities for ensuring fire safety, the licensees performing activities for ensuring the fire safety approved by the resolution of the Ministry of Emergency Situations of the Republic of Belarus of December 14, 2022 No. 79, for which this work is not part-time job;
