About some questions of implementation of activities of the economic societies participating in accomplishment of the state defense order
According to article 8 of the Federal constitutional Law of January 30, 2002 "About warlike situation" I decide No. 1-FKZ:
1. Determine that in case of violation by economic societies, being head contractors of deliveries of products (performance of works, rendering services) according to the state defense order or the contractors participating in deliveries of products (performance of works, rendering services) in the state defense order, the obligations according to the public contract (contract) including rejection of measures for ensuring deliveries of products (performance of works, rendering services) according to the state defense order, until cancellation of warlike situation:
a) the rights of participants (shareholders) of such economic society and power of its governing bodies stop;
b) based on offers of the Ministry of Industry and Trade of the Russian Federation the management company which will perform powers of sole executive body of such economic society, and also in that measure in what it is necessary for the purpose of obligation fulfillment according to the state defense order, powers of general shareholder meeting or the board of directors (supervisory board) of society is determined.
2. To the government of the Russian Federation:
a) form under board of the Military-industrial commission of the Russian Federation the working group on questions of activities of the economic societies participating in accomplishment of the state defense order during action of warlike situation (further - working group);
b) approve the regulations on working group providing including that the working group performs assessment of activities of the economic societies participating in accomplishment of the state defense order creates line item on the questions connected with suspension of the rights of participants (shareholders) of such economic societies and powers of their governing bodies, determination of management company;
c) approve structure of the working group.
