About accreditation of conformity assessment bodies

Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of accreditation of conformity assessment bodies.

Article 2. Legislation on accreditation of conformity assessment bodies

The legislation on accreditation of conformity assessment bodies consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about accreditation of conformity assessment bodies then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

accreditation - official confirmation of competence of conformity assessment bodies by accreditation body on performance of works on assessment of conformity in certain field of activity;

the appraiser on accreditation - the physical person designated by accreditation body for assessment of conformity assessment body, performing these activities independently or as a part of group on assessment;

council on accreditation - the collegiate advisory body created for assessment of functioning of national accreditation system, monitoring of achievement of effective objectives and development of recommendations about development of national accreditation system;

the technical accreditation expert - the physical person designated by accreditation body, which is working under the leadership of the appraiser on accreditation, having special knowledge or skills in the subjected assessment of area of accreditation and not carrying out assessment independently;

accreditation body - the authorized body performing activities for accreditation of conformity assessment bodies;

the sphere of accreditation - certain field of activity in which proves to be true or is confirmed competence of the applicant on accreditation or the accredited subject;

the applicant on accreditation - the conformity assessment body which submitted the application for accreditation;

accreditation cycle - accreditation effective period since registration date of the accredited subject in the register of national accreditation system;

the accredited subject - the conformity assessment body accredited in national accreditation system;

the appeal - the written request of the applicant on accreditation or the accredited subject about review of the negative decision on accreditation made on it by accreditation body;

periodic assessment - the procedure of repeated assessment of activities of the accredited subject in accreditation cycle on compliance to the requirements established during accreditation;

assessment of conformity - activities for determination of observance of requirements imposed to object of assessment of conformity;

conformity assessment body - the legal entity performing activities for assessment of conformity.

Article 4. Main objectives of accreditation

The main objectives of accreditation are:

providing trust of concerned parties to activities of accredited subjects;

ensuring realization of single technical policy in the field of assessment of conformity;

creation of conditions for recognition and acceptance at the international level of results of activities of accredited subjects.

Article 5. Basic principles of accreditation

The basic principles of accreditation are:

voluntariness;

objectivity and impartiality;

competence;

transparency and openness of procedures of accreditation;

equality of conditions of accreditation;

non-admission of disclosure of confidential information;

inadmissibility of combination of activities for accreditation with activities for assessment of conformity.

Chapter 2. State regulation in the field of accreditation

Article 6. The main directions of state policy in the field of accreditation

The main directions of state policy in the field of accreditation are:

development and implementation of the state and other programs;

harmonization of national standards in the field of accreditation with international standards;

implementation of front lines innovative and information and communication technologies;

development and enhancement of single system of preparation, retraining and advanced training of personnel;

development of international cooperation.

Article 7. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of accreditation

Cabinet of Ministers of the Republic of Uzbekistan:

provides realization of single state policy in the field of accreditation;

coordinates activities of bodies of the public and economic board, public authorities on places in the field of accreditation;

determines the priority directions of development in the field of accreditation, provides development and implementation of the state and other programs;

takes measures for development of international cooperation in the field of accreditation.

The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.

Article 8. Powers of the Uzbek agency on technical regulation in the field of accreditation

The Uzbek technical regulation agency is specially authorized body of public administration in the field of accreditation (further - specially authorized state body).

Specially authorized state body:

performs single state policy in the field of accreditation;

develops drafts of regulatory legal acts in the field of accreditation and within the powers accepts them;

accepts the standards establishing requirements and criteria of competence of conformity assessment bodies;

will organize system of preparation, retraining and advanced training of personnel in the field of accreditation;

carries out the periodic analysis of results of consideration by accreditation body of appeals and claims, conclusions of parity assessment, financial statements, implementation of strategic and other plans on development of accreditation system;

performs monitoring of activities of accreditation body by involvement of independent consulting or auditing organizations;

makes offers on development and regulation of accreditation system in the Cabinet of Ministers of the Republic of Uzbekistan, representation to accreditation body;

approves regulations on council on accreditation and its structure.

Specially authorized state body can perform also other powers according to the legislation.

Chapter 3. National accreditation system
