About approval of the Regulations on procedure for provision of soft credits to citizens on gasification of the housing stock operated by them

The Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure for provision of soft credits to citizens on gasification of the housing stock operated by them.

2. To the Ministry of Finance to provide funds for compensation to open joint stock company "Belarusbank savings bank of the losses connected with provision to citizens of soft credits in compliance item 4 of the Presidential decree of the Republic of Belarus of June 2, 2006 No. 368 "About measures for relations management in case of gasification of the operated housing stock of citizens" (The national register of legal acts of the Republic of Belarus, 2006, No. 89, 1/7643) on the financing of designing and construction of facilities of gas-distributing and intra house systems established:

subitem 2.1 of Item 2 of this Decree - by preparation of regulatory legal act about refining of separate indicators of the republican budget for 2006;

subitems 2.1 and 2.2 of Item 2 of this Decree - when forming the draft of the republican budget for 2007 and the next financial (budget) years.

3. This resolution becomes effective from the date of its official publication.

Regulations on procedure for provision of soft credits to citizens on gasification of the housing stock operated by them

1. This Provision is developed based on the Presidential decree of the Republic of Belarus of June 2, 2006 No. 368 "About measures for relations management in case of gasification of the operated housing stock of citizens" (The national register of legal acts of the Republic of Belarus, 2006, No. 89, 1/7643) and establishes procedure for provision of soft credits to citizens on financing of designing and construction of gas pipelines from the place of accession to the operating street gas distribution pipeline to the disconnecting device on input to the apartment house (further - the gas pipeline input) and intra house gas supply system, new street gas distribution pipelines with gas pipelines inputs for gasification of the housing stock operated by citizens (further - soft credits).

2. Soft credits are granted to the citizens needing their obtaining for gasification of the operated housing stock belonging to them on the property right, including disabled in the presence of guarantee agreements on accomplishment of obligations by them on these credits, according to the lists of citizens approved by the Gorispolkoms or district executive committees in form according to appendix 1, with observance of priority according to date of the address of the citizen.

3. For acceptance for accounting of persons in need in receipt of this credit the citizen submits the application to the Gorispolkom (administration of the district of Minsk) or district executive committee in the location of premises with submission of the document confirming the property right to premises which copy certified by the called state bodies is enclosed to the application. If representation by the citizen of the specified document is impossible, then according to its order the Gorispolkom (administration of the district of Minsk) or district executive committee requests this document according to the legislation.

4. The Gorispolkoms and district executive committees agree on issue of possibility of gasification of the operated housing stock of the citizen with the gas supplying organization and make the decision on its inclusion in the list of the citizens needing receipt of soft credit on these purposes.

5. For determination of the size of money which is necessary for the citizen for gasification of the housing stock operated by it the gas supplying organizations based on requests of the Gorispolkoms and district executive committees prepare the list of costs for performance of works on designing and construction of facilities of gas-distributing and intra house systems for gasification of the operated housing stock (further - the list of costs) according to Item of 1 this provision providing including the gas equipment (the gas stove, heating coppers, water heaters, devices for accounting of consumption of gas (counters), devices for regulation of pressure of gas (pressure regulators), gas contamination signaling devices, electromagnetic and thermolocking valves which producers are the companies of the Republic of Belarus and the organization of state members of the Eurasian Economic Union if they are provided by the project.

6. Citizens join in lists on receipt of soft credit according to the procedure, determined in Items 2-4 of this provision, with observance of priority depending on date of the address of citizens within the funds allocated for the purposes of preferential crediting for the corresponding year taking into account accepted by open joint stock company "Belarusbank savings bank of obligations under the signed agreements. The basis for the conclusion of the credit agreement on receipt of soft credit at citizens arises after approval by the Gorispolkoms and their district executive committees in lists on receipt of soft credits. Approved lists of the citizens needing receipt of soft credit with the list of costs in form according to appendix 2 are represented by the Gorispolkoms and district executive committees to open joint stock company "Belarusbank savings bank not later than month prior to accomplishment of the called works.

7. In the terms established annually for preparation of the draft of the republican budget for the next financial (budget) year:

The Department of Energy together with open joint stock company "Belarusbank savings bank, regional executive committees and the Minsk Gorispolkom determines amount of the credit resources necessary for gasification of the operated housing stock of citizens, with distribution of these resources by areas and Minsk;

the open joint stock company "Belarusbank savings bank represents to the Ministry of Finance calculation of the budgetary funds necessary for compensation for this society of the losses connected with provision of soft credits.

8. The Ministry of Finance monthly compensates to open joint stock company "Belarusbank savings bank at the expense of means of the republican budget of loss, connected with provision to citizens of soft credits, based on written requests of this joint-stock company.

9. Soft credits are granted to citizens by open joint stock company "Belarusbank savings bank at the rate to 70 percent of cost of works according to the list of costs. The maximum term for which these loans are granted shall not exceed two years.
