About approval of the Control technique biological risks

According to the subitem 5) of Item 2 of article 10 of the Law of the Republic of Kazakhstan "About biological safety of the Republic of Kazakhstan", I ORDER:

1. Approve the enclosed Control technique by biological risks.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Finance of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Control technique biological risks

Chapter 1. General provisions

This Control technique is developed by biological risks (further – the Technique) according to the subitem 5) of Item 2 of article 10 of the Law of the Republic of Kazakhstan "About biological safety of the Republic of Kazakhstan" and determines procedure for management of biological risks when moving through Frontier of the Republic of Kazakhstan (further – state border) products which are subject to export control according to the nomenclature (list) of the products which are subject to export control, approved by the order of the Government of the Republic of Kazakhstan of February 5, 2008 No. 104 "About approval of the nomenclature (list) of products which are subject to export control" (further – the List).

1. In this Technique the following concepts are used:

1) biological risk – probability of damnification to human health, animals, to plants pathogenic biological agents, and also probability of their hit in separate components of the environment;

2) assessment of biological risks – the management system element biological risks also represents set of the organizational, analytical and practical actions directed to the prevention of emergence of negative effects of impact of dangerous biological factors, means, methods, technologies, services in the different fields of activity connected with the treatment of pathogenic biological agents;

3) the pathogenic biological agent – microorganisms, poisons of biological and plant origin (toxins), helminths, nematodes capable to cause infectious and (or) parasitic process in human body, animal or plant;

4) products – goods, technologies, works, services, information which are subject to export control.

Chapter 2. Management of biological risks

2. Bodies of state revenues carry out external assessment of biological risks within implementation according to Item 2 of article 9 of the Law of the Republic of Kazakhstan "About control of specific goods" (further – the Law) control of movement of products through state border.

3. External assessment of biological risks is performed based on documentary control by verification of presence issued by authorized state bodies on the moved products of allowing documents which submission is according to Articles 11, of 12, of 13, 16 Laws condition of movement of products through state border.

4. In the absence of allowing documents when moving the pathogenic biological agents entering the List of products whose availability is according to Articles 11, of 12, of 13, 16 Laws condition of movement of products through state border by bodies of state revenues do not allow their movement through state border.
