According to the Law of the Republic of Belarus of January 5, 2024 No. 344-Z "About insurance activity", Item part four 87, Item 161 and the paragraph the eleventh Item 208 of the Regulations on compulsory insurance approved by the Presidential decree of the Republic of Belarus of March 18, 2025 No. 108, Council of Ministers of the Republic of Belarus DECIDES:

1. Approve:

The regulations on procedure and the directions of use of means of funds of precautionary (preventive) actions for types of voluntary insurance (are applied);

The regulations on fund of insurance guarantees for obligatory civil liability insurance of owners of vehicles of the Belarusian bureau on transportation insurance (are applied);

The regulations on fund of protection of the victims in the road accidents on obligatory civil liability insurance of owners of vehicles of the Belarusian bureau on transportation insurance (are applied);

The regulations on procedure for transfer by insurance company of obligations assumed according to insurance contracts (reinsurance), insurance reserves and remaining balance of means of funds of precautionary (preventive) actions of other insurance company (are applied);

Regulations on procedure for creation of separate divisions of insurance companies, insurance brokers in the Republic of Belarus (are applied);

Regulations on procedure for creation of separate divisions of insurance companies, insurance brokers outside the Republic of Belarus, participations in creation outside the Republic of Belarus of insurance companies and (or) insurance brokers or share acquisition (share in authorized funds) of such organizations (are applied);

The regulations on procedure for reclamation of the data and (or) documents necessary for decision making on purpose of insurance payments for compulsory insurance from labor accidents and occupational diseases (are applied);

The list of diseases (conditions) in case of which rendering emergency medical service to the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Republic of Belarus is required (is attached);

The regulations on order of registration (re-registration) of insurers on compulsory insurance from labor accidents and occupational diseases (are applied);

The regulations on payment procedure to the insurer of insurance premiums on compulsory insurance from labor accidents and occupational diseases (are applied);

The regulations on procedure for providing with temporary disability benefits in connection with labor accidents and occupational diseases (are applied);

The regulations on payment procedure of the additional expenses connected with damage of health insured on compulsory insurance from labor accidents and occupational diseases (are applied);

The regulations on surcharge procedure to average earnings of the insured, temporarily transferred to easier below-paid work in connection with damage health as a result of insured event (are applied);

The regulations on payment procedure of expenses on burial of the dead insured on compulsory insurance against labor accidents and occupational diseases which death was caused by insured event (are applied);

The regulations on procedure of insurance payments for compulsory insurance from labor accidents and occupational diseases to the persons having the right to their obtaining and who left on the permanent residence of the Republic of Belarus (are applied);

The regulations on procedure for creation and submission of the report on means on compulsory insurance from labor accidents and occupational diseases (are applied).

1-1. Establish report form about means on compulsory insurance from labor accidents and occupational diseases according to appendix 1.

2. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. Item 1 of the resolution of Council of Ministers of the Republic of Belarus of June 20, 2002 No. 817 "About implementation of insurance activity at check points through Frontier of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2002, No. 73, 5/10656; 2004, 144, 5/14829) after the words which are "temporarily staying" to add No. with the words "or temporarily living";

2.2. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 29.08.2019 No. 575

2.12. in the resolution of Council of Ministers of the Republic of Belarus of January 15, 2004 No. 30 "About investigation and accounting of labor accidents and occupational diseases" (The national register of legal acts of the Republic of Belarus, 2004, No. 8, 5/13691):

2.12.1. in word preamble "with the Decree of the President of the Republic of Belarus of July 30, 2003 "About compulsory insurance from labor accidents and occupational diseases and" to replace No. 18 with the word "with";

2.12.2." to exclude registrations from Item 1 of Rules about investigation and accounting of the labor accidents and occupational diseases approved by this resolution, the word";

2.13. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 18.09.2025 No. 513

3. Recognize invalid resolutions of Council of Ministers of the Republic of Belarus according to appendix 2.

4. To the Ministry of Finance to take measures for implementation of this resolution.

5. This resolution becomes effective from the date of its official publication.

Regulations on procedure and directions of use of means of funds of precautionary (preventive) actions for types of voluntary insurance

1. This Provision is developed according to part six of Item 1 of article 33 of the Law of the Republic of Belarus "About insurance activity" and determines procedure and the directions of use of means of funds of precautionary (preventive) actions for types of voluntary insurance, except for voluntary insurance of medical expenses.

2. Funds of precautionary (preventive) actions have purpose and are created by insurers by each type of voluntary insurance for financing of the actions directed to decrease in possible losses from insured events and their prevention.

3. Funds of precautionary (preventive) actions are created by insurers in Belarusian rubles due to monthly assignments from the arrived insurance premiums by each type of voluntary insurance depending on amount of the used means of these funds in sizes according to appendix. Funds of these funds are accumulated in single fund of precautionary (preventive) actions for voluntary types of insurance (further - single fund).

4. Financing of the actions directed to decrease in possible losses by types of voluntary insurance is performed by the insurer according to the plan of the prevention of insured events approved by the insurer.

Upon termination of financial year the insurer shall provide to the Ministry of Finance:

the report on accomplishment of this Item of the plan and on use of means of single fund specified in part one;

analytical information with indication of the reasons of non-use of means of single fund if the share of the used means of single fund of the created means of single fund (taking into account remaining balance of unused means of previous period) in three prior calendar years constitutes less than 70 percent.

5. Means of single fund are used for purpose and go for participation in financing:

the actions connected with creation and providing necessary material and technical resources for implementation of the state technical inspection of vehicles;

acquisitions, installation and repair of means of communication, the equipment, the equipment, stock over the amounts which are subject to financing in accordance with the established procedure for the prevention of road and transport and other emergencies, accidents, and also accomplishment of actions for control of the marked transport for the purpose of its detection;

constructions, reconstruction and repair of stations on fight against diseases of animal, veterinary clinics;

acquisitions of veterinary means by veterinary services (biological, vegetable, chemical, pharmaceutical veterinary medicines and other diagnostic aids and prevention of diseases and treatment of sick animals, and also special devices, tools, materials and the equipment, vehicles) for the prevention and treatment of infectious and noninfectious diseases of animals, holding actions for fight against epizooty, and also actions connected with creation and ensuring functioning of system of identification of animals (including birkovaniye of animals, creation of system of electronic passports);

acquisitions of remedies of plants from wreckers and diseases;

acquisition and repair over the amounts which are subject to financing in accordance with the established procedure, special vehicles of emergency medical service, veterinary help, rescue services, bodies and divisions on emergency situations, law-enforcement bodies;

holding antiflood and antimudstone actions;

constructions, repair of meliorative systems, installations for artificial watering of agricultural holdings;

acquisitions, constructions, repair of snegozaderzhatel;

actions for the device, enhancement, maintenance and repair of systems of the fire and security alarm, television systems of video surveillance, systems of protection, heating systems (gas coppers), means ensuring safety of objects of insurance;

acquisitions of the fire fighting and rescue equipment, fire-fighting structures, fire extinguishing means, devices of protection of respiratory organs, equipment and the equipment ensuring safe functioning in the conditions of the fires and accidents;

acquisitions of individual protection equipment, and also the medicines used for first-aid treatment and emergency medical service, medical products;

improvements of material and technical resources of sanepidemstantion and condition of water and drinking resources;

designings, acquisitions, installation and putting into operation of the equipment and systems of control and surveillance over safety of production processes on hazardous production facilities and subjects to use of atomic energy, and also carrying out maintenance of such equipment and systems;

actions for enhancement of the equipment of cleaning constructions, filters at the companies with harmful emissions, other nature protection objects;

holding sanitary and anti-epidemic actions for public health care and actions for decrease in injury rate (obligatory medical examinations, preventive inoculations);

acquisitions of medicines, the dietary supplements containing minerals, vitamins or vitamin and mineral complex;

acquisitions by insurers which workers undergo obligatory prereplaceable and (or) preraid medical examinations, devices for determination of availability and level of content of alcohol (breathalyzers or alkometra);

acquisitions, installations of processing equipment, spare parts, component parts and other means for maintenance in technically serviceable condition of vehicles, agricultural machinery;

acquisitions of evident propaganda on traffic safety, pickings of classes on traffic safety the necessary equipment, acquisitions of light-reflective elements (flickers);

carrying out the repair of buildings (constructions) aimed at providing fire safety on the prevention of penetration of water, accidents of heating system, water supply and sewer systems, accidents of internal drains, sudden destruction of the main designs;

acquisitions and installations of remedies (protection) of vehicles, including satellite security search engines, drawings anticreeping marking on vehicles and its registration;

holding actions for ensuring fire safety in settlements in apartment houses of citizens and apartment apartment houses, including on repair of oven heating, electrical wiring, acquisition and installation of systems of lightning protection of apartment houses and economic constructions, autonomous fire announcers;

acquisition and production of the information boards, show-windows, stands, brochures, posters, booklets, instruction sheets necessary for informing on measures for accident prevention, illegal actions of the third parties, emergency situations and operations procedure in case of their origin, and also propagandizing healthy lifestyle;

actions for promoting in mass media of traffic safety, to informing on measures for accident prevention, illegal actions of the third parties, emergency situations and operations procedure in case of their origin, and also propagandizing healthy lifestyle;

acquisitions, installations of technical means of the organization of traffic, the means informing on change and features of road and climatic conditions;

acquisitions of technical means of the organization of traffic for the purpose of decrease in injury rate and accidents in organizations of education;

acquisitions of specialized periodic printing editions, reference books, professional literature, creation and acquisition of information databases about the organizations for accumulating and information analysis about partners (business partners) of the insurer, receivers of credit resources;

the services rendered by third parties in receipt of information on financial condition and goodwill of the partner (business partner) of the insurer, receiver of credit resources;

actions for collateral security of safety and safety of loads in case of their transportation, loading, storage;

designings, acquisitions and installations of systems of protection of the production facilities creating the increased danger to people around, and subjects to use of atomic energy, systems of the prevention of origin on them of emergencies and also carrying out maintenance of such systems;

acquisitions of the equipment, computers and the software in classes (offices) for occupational retraining and advanced training of employees of insurer in the field of traffic, aircraft and navigation;

actions for reconstruction of landing strips of the airports, drawing the warning (marking) marking light-reflective paint, replacement of covering;

acquisitions, enhancement and installation of systems of detection of leak, grounding of water vessels;

acquisitions of additional navigation equipment, emergency radio beacons, early warning systems of proximity of the earth for the purpose of prevention of approach of insured events and decrease in weight of their effects;

transportation and warehouse expenses of the insurer on return on the territory of the Republic of Belarus or realization to other nonresident buyer irrevocably for the territory of the Republic of Belarus delivered, but unrealized (not paid in time) products under earlier signed export contract under which risks are accepted on insurance according to the insurance contract of export risks with support of the state or according to the insurance contract of export risks according to the Regulations on insurance (reinsurance) of export risks approved by the Presidential decree of the Republic of Belarus of August 25, 2006 No. 534;

acquisitions of the software for training of employees of insurer in the field of safe conducting production processes on hazardous production facilities and subjects to use of atomic energy;

actions for liquidation of dangerously growing trees;

the actions directed to training of health workers in new acceptances and methods of treatment and diagnostics;

acquisitions and installations of means of additional protection of portable devices for prevention of their damage, death as a result of unexpected mechanical impact or plunder, and also actions for their search and return in case of plunder;

accomplishment of research and development works in the field of increase in safety and reliable operation of nuclear power plant;

actions for ensuring nuclear and radiation safety when transporting, loading, unloading, storage of nuclear and radioactive materials;

actions for ensuring physical protection of subjects to use of atomic energy;

the services in installation and equipment maintenance, installation and support of the software intended for receipt of information on condition of separate objects indoors, conducting the round-the-clock video control of certain rooms, buildings, constructions, apartment houses and the territory adjoining to them;

the actions directed to improvement of material and technical resources of State Healthcare Institutions, state medical scientific organizations, public institutions of social servicing, including acquisition of means, the equipment for rehabilitation and the organization of care of citizens, maintenance of their personal hygiene;

acquisitions of the equipment, computers and the software in computer classes, offices of physics, chemistry of public institutions of education for providing healthy and safe conditions of training, and also stock and remedies to gyms and classes of work for decrease in injury rate, maintenance of sanitary standards and training in skills of healthy lifestyle;

the actions connected with creation and strengthening of material and technical resources for support of the Olympic and Paralympic movements of the Republic of Belarus, game sports, carrying out physical culture and sport by the organizations, labor unions, their organizational structures, associations of such unions and their organizational structures of sports and improving, sports and mass work, sporting and (or) sports and mass events and participations in them, including training of athletes (their teams);

analytical maintenance of work of the commissions on traffic safety;

developments of regulatory legal acts in the field of traffic;

carrying out research works on increase in traffic safety;

developments and implementations of actions on increase in traffic safety;

maintenances of monitoring system of traffic;

developments of the software for system of safety of traffic;

examination (audit) of traffic safety.

The receiver of means of single fund or the subject of holding precautionary (preventive) actions at the expense of means of this fund:

can be the insurer who signed the agreement of voluntary insurance, the state bodies, state-financed organization, the organizations performing operation of housing stock and (or) providing housing and communal services, partnerships of owners and the organization of builders performing servicing of apartment houses independently, the organizations performing maintenance and repair of the gas-using equipment, the organizations for installation and equipment maintenance, installation and support of the software intended for receipt of information on condition of separate objects indoors, conducting the round-the-clock video control of certain rooms, buildings, constructions, apartment houses and the territory adjoining to them, the sanatorium and improving organizations, the organizations of physical culture and sport, labor unions (their associations) and organizational structures of labor unions (their associations), federations (the unions, associations) by the form (types) of sport;

on insurance of export risks with support of the state and to the insurance of export risks performed according to Regulations on insurance (reinsurance) of export risks can also be the organization realizing the goods (works, services) specified in paragraphs the twenty ninth and thirtieth to part one of this Item, export credit agency, merging of export credit agencies, other legal entity providing information on financial condition, goodwill of subjects of managing which are in the territory of the Republic of Belarus or beyond its limits – nonresidents of the Republic of Belarus.

6. Means of single fund are stored on the current (settlement) bank account and (or) liquidities, diversifications according to the legislation are placed in bank deposits (deposits) and (or) in government securities on the terms of recoverability, profitability.

7. The means of single fund which are not spent within financial year are used by insurers next year.

8. Control of forming and target use of means of single fund is performed by the Ministry of Finance.

Regulations on fund of insurance guarantees for obligatory civil liability insurance of owners of vehicles of the Belarusian bureau on transportation insurance

1. This Provision is developed according to part four of Item 87 of the Regulations on compulsory insurance and determines procedure for forming, investment, placement and use by the Belarusian bureau by transportation insurance (further – the Belarusian bureau) fund of insurance guarantees on obligatory civil liability insurance of owners of vehicles (further – fund).

2. The fund is created for the account:

2.1. the fees paid by the insurers entering in complete members of the Belarusian bureau, in the amount of, established by the legislation;

2.2. monthly assignments (to the 22nd) insurers – complete members of the Belarusian bureau in the amount of percent 0,05 from the amounts of the insurance premiums received within the last month under agreements of the international insurance;

2.3. penalty fee of insurers – complete members of the Belarusian bureau for untimely payment of assignments by them from the arrived insurance premiums under agreements of the international insurance in the amount of, defined by the agreement signed between the Belarusian bureau and its members;

2.4. additional contributions of insurers – the complete members of the Belarusian bureau brought based on the agreement signed between the Belarusian bureau and its complete members for:

accomplishment of the action provided by subitem 3.1-1 of Item 3 this provision;

accomplishment of the actions provided by subitems 3.2-3.5 of Item 3 this provision in case of insufficiency of fund;

2.5. share of the deposit award contributed based on the agreement signed between the Belarusian bureau and its complete members, the insurer – the complete member of the Belarusian bureau under the agreement of reinsurance of the Belarusian agreements of the international insurance;

2.6. the loans granted by members of the Belarusian bureau according to legal acts;

2.7. other states of the amounts of insurance indemnity, the penalty fee added for untimely payment of the exposed requirements, and expenses of the Belarusian bureau on document creation for payment of insurance indemnity for the insured events which occurred in the territory of the Republic of Belarus, for insurance contracts, signed with insurance company of the state with which authorized organization the Belarusian bureau signs the agreement on cooperation (further – the international insurance contracts), to the insurance contracts signed within the international (interstate) system of insurance of the Union State with insurance company of the Russian Federation compensated by authorized organizations (further – insurance contracts of system of the Union State);

2.8. compensated by insurers in cases, stipulated by the legislation and international treaties, the amounts paid for them to the Belarusian bureaus according to warranty requirements in connection with failure to carry out at the scheduled time of insurance bonds by the insurer – the complete member of the Belarusian bureau;

2.9. the amounts in the amount of the payment made by the Belarusian bureau from fund according to the obligations following from international treaties of insurance, insurance contracts of system of the Union State received from authorized organizations of other states with which the Belarusian bureau signed agreements on cooperation;

2.9-1. assignments of part of profit in the amount of 30 percent of difference between the net profit and expenses from net profit included in the estimate on content of the Belarusian bureau;

2.10. other sources which are not prohibited by the legislation.

3. Fund is used on:

3.1. indemnification by the victim and fee on settlement of the insured events which occurred in the territory of the Republic of Belarus, according to international treaties of insurance, insurance contracts of system of the Union State, made by the Belarusian bureau according to the agreements on cooperation signed with authorized organizations of state members of the international systems of insurance and (or) the states which are not members of the international systems of insurance;

3.1-1. the calculations perfromed by the Belarusian bureau for accomplishment of the obligations following from the agreements of the international insurance signed by insurers – complete members of the Belarusian bureau, in the amount of and procedure, defined by the agreement between the Belarusian bureau and its complete members, except for accomplishment of such obligations in the cases established by subitems 3.2 and 3.3 of this Item;
