Based on paragraph two of subitem 2.3 of Item 2 of the Presidential decree of the Republic of Belarus of October 18, 2022 No. 368 "About interaction of operators of telecommunication, DECIDES: service providers of telecommunication and owners of Internet resources with the bodies performing operational search activities" Council of Ministers of the Republic of Belarus

1. Approve Regulations on procedure for functioning of information system of electronic interaction of service providers of telecommunication, owners of the Internet resources and bodies performing operational search activities it (is applied).

2. This resolution becomes effective after its official publication.

Regulations on procedure for functioning of information system of electronic interaction of service providers of telecommunication, owners of the Internet resources and bodies performing operational search activities

1. This Provision determines procedure for functioning of information system of electronic interaction of service providers of telecommunication, the owners of the Internet resources and bodies performing operational search activities, determined by the Presidential decree of the Republic of Belarus of October 18, 2022 No. 368 (further - information system).

2. For the purposes of this provision terms in the values determined in article 1 of the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication", article 1 of the Law of the Republic of Belarus of July 17, 2008 No. 427-Z "About mass media" and Item 27 of the Regulations on order of interaction of operators of telecommunication, service providers of telecommunication and owners of Internet resources with the bodies performing operational search activities, No. 368 approved by the Presidential decree of the Republic of Belarus of October 18, 2022 are used.

3. Users of information system are:

Operational analytical center in case of the President of the Republic of Belarus and Committee for State Security;

service providers of telecommunication;

owners of Internet resources.

4. The main functions of information system are:

accounting and display of information on service providers of telecommunication and owners of Internet resources;

automatic creation and direction:

to the republican unitary enterprise for the supervision of telecommunication of "BELGIE" which is the operator of information system (further - the operator of information system), and to users of information system of instructions, notifications, messages, other documents provided by Regulations on order of interaction of operators of telecommunication, service providers of telecommunication and owners of Internet resources with the bodies performing operational search activities and also data on availability of the entering instructions, notifications, messages, other documents;

to the bodies performing operational search activities, data on delivery of telecommunication to service providers, owners of Internet resources of instructions, notifications, decisions on prolongation (about refusal in prolongation) terms of elimination of the violations specified in the instruction;

to service providers of telecommunication, owners of Internet resources of notifications on the expiration of terms:

implementation of technical requirements to databases, the automated systems containing information on users of Internet services, users of Internet resources the services of telecommunication, Internet services, services rendered with use of Internet resource and which are not telecommunication services, Internet services rendered to these users, and also to other equipment and program technical means used for ensuring interaction with authorized divisions and access of these divisions to databases, the automated systems of service providers of telecommunication, owners of Internet resources, including to acquisition and installation of such equipment and program technical means, subsequent their maintenance and repair;

elimination of the violations specified in the instruction.

5. Users of information system can perform mutual exchange and other data, including the messages and documents necessary for activities of users of information system, the bodies performing operational search activities, and the operator of information system.

6. Service providers of telecommunication and owners of Internet resources create and send with use of information system to the operator of information system:

messages on implementation of the specified technical requirements;

statements for prolongation of terms of elimination of the violations specified in the instruction.

7. Operator of information system:

7.1. provides functioning of information system, including:

systematizes the offers which arrived from users of information system, takes measures for enhancement of functioning of information system and its upgrade;

provides uninterrupted operation of information system in case of direct interaction with the republican unitary enterprise "Center of Digital Development";

7.2. sends with use of information system to Operational analytical center in case of the President of the Republic of Belarus and Committee for State Security created in information system:

data on registration in information system of the service provider of telecommunication, the owner of Internet resource;

notifications on elimination of the violations specified in the instruction, service providers of telecommunication, owners of Internet resources;

statements of service providers of telecommunication, owners of Internet resources about prolongation of terms of elimination of the violations specified in the instruction;

7.3. performs other functions, stipulated by the legislation.

8. The screen document form, created by users of information system, shall contain type, the name and contents of the created document, contact information of authorized representatives of users of information system taking into account requirements of the legislation on information, informatization and information security.
