About some questions of use of the parcels of land located in borders of conservation zones of objects of electric grid economy

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of February 24, 2009 No. 160 "About procedure for establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones" (The Russian Federation Code, 2009, No. 10, Art. 1220; 2013, No. 24, Art. 2999; No. 35, Art. 4522; 2018, No. 53, Art. 8666).

2. Determine that:

a) from the date of entry into force of this resolution of restriction and other special conditions of use of the parcels of land in borders of conservation zones of objects of electric grid economy which were established about day of entry into force of this resolution are determined according to the order of the Government of the Russian Federation of February 24, 2009 No. 160 "About procedure for establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones" (in edition of this resolution);

b) requirements to parameters of buildings, constructions if their placement is admissible, provided by the Rules of establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones approved by the order of the Government of the Russian Federation of February 24, 2009 No. 160 "About procedure for establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones" (in edition of this resolution), are not applied in the following cases:

the building, construction were placed in borders of conservation zones of objects of electric grid economy about day of entry into force of the order of the Government of the Russian Federation of February 24, 2009 No. 160 "About procedure for establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones";

before entry into force of this resolution placement of buildings, constructions was approved by the owner of object of electric grid economy according to requirements of the regulatory legal acts operating for date of such placement.

3. This resolution becomes effective since September 1, 2023.

Changes which are made to the Order of the Government of the Russian Federation of February 24, 2009 No. 160

1. Add with Item 5 of the following content:

"5. Items 1 and 2 of this resolution are effective till January 1, 2025".

2. In Rules of establishment of conservation zones of objects of electric grid economy and special conditions of use of the parcels of land located in borders of such zones approved by the specified resolution:

a) in Item 8:

state the subitem "b" in the following edition:

"b) carry out the works menacing to damage of objects of electric grid economy, place objects and objects which can interfere with access of service personnel and the equipment to power generation facilities, without preserving and (or) creation, including according to requirements of the normative and technical documents necessary for such access of passes and entrances for the purpose of ensuring operation of the equipment, buildings and constructions of power generation facilities, work on accident elimination and elimination of their effects throughout border of power generation facility;";

add with subitems "e" - "з" the following content:

"e) remove, destroy, move, fill up and damage the warning and information signs (or the warning and information texts applied on power generation facilities);

g) make switchings and connections in power networks (the specified requirement does not extend to the workers occupied with accomplishment of the works permitted in accordance with the established procedure);

h) perform use of the parcels of land as the proving grounds, places of destruction of arms and waste disposal arising in connection with use, production, repair or destruction of arms or ammunition.";

b) add Item 9 with subitems "e" and "zh" of the following content:

"e) perform stop of vehicles on highways in places of crossing with electricity transmission air-lines with project nominal class of voltage of 330 kV and above (it is exclusive in conservation zones of air-lines of electricity transmission);

g) establish the advertizing structures.";

c) Items 10 - 12 to state in the following edition:

"10. In conservation zones placement of buildings and constructions in case of observance of the following parameters is allowed:

a) the placed building or construction does not create obstacles for access to object of electric grid economy (are created or remain, including according to requirements of normative and technical documents, the passes and entrances necessary for access to power generation facility of service personnel and the equipment for the purpose of ensuring operational, technical and corrective maintenance of the equipment, buildings and constructions of power generation facilities, works on accident elimination and elimination of their effects throughout border of power generation facility);

b) the distance across from elements of buildings and constructions to wires of air-lines of electricity transmission up to 1 kV with uninsulated wires (in case of their greatest variation) shall be at least:

Meter 1,5 - from speakers of parts of buildings, terraces and windows;

1 meter - from blank walls;

c) the distance across from elements of buildings and constructions to conducting veins of the cables (intended for operation in the air circle) over 1 kV (in case of their greatest variation) shall be at least:

1 meter - from speakers of parts of buildings, terraces and windows;

Meter 0,2 - from blank walls of buildings, constructions;

d) placement of buildings and constructions under wires of air-lines of electricity transmission up to 1 kV with the self-bearing isolated wires is allowed, at the same time the distance down from the specified buildings and constructions in case of the greatest arrow of pro-weight shall be at least 2,5 of meter;

e) the distance across from elements of buildings and constructions to wires of air-lines of electricity transmission over 1 kV (in case of their greatest variation) shall be at least:

2 meters - in case of project nominal class of tension to 20 kV;

4 meters - in case of project nominal class of voltage of 35 - 110 kV;

5 meters - in case of project nominal class of voltage of 150 kV;

6 meters - in case of project nominal class of voltage of 220 kV;
