Article 1. Subject of regulation of this Federal Law

This Federal Law determines features of legal regulation of the relations connected with implementation in the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region of payments for compulsory social insurance on case of temporary disability and in connection with motherhood and payments for compulsory social insurance from labor accidents and occupational diseases to the citizens of the Russian Federation living or living in the specified territories and also the foreign citizens and persons without citizenship who are living or earlier living in the specified territories and left the specified territories in other subjects of the Russian Federation (further - citizens).

Article 2. Right to payments for compulsory social insurance

1. Realization of the right to payments for compulsory social insurance on case of temporary disability and in connection with motherhood and payments for compulsory social insurance from labor accidents and occupational diseases is performed by citizens since March 1, 2023 according to the procedure of, the sizes, amount and on conditions which are stipulated by the legislation the Russian Federation, taking into account the features established by this Federal Law.

2. In case of realization by citizens of the right to payments for compulsory social insurance on case of temporary disability and in connection with motherhood and payments for compulsory social insurance from labor accidents and occupational diseases the documents constituted in Ukrainian are accepted without the translation into Russian.

3. In case of calculation of payments for compulsory social insurance on case of temporary disability and in connection with motherhood and payments for compulsory social insurance from labor accidents and occupational diseases the earnings specified in national monetary unit of Ukraine - hryvnias, and also the payments which are earlier appointed to the citizen which amount was established in national monetary unit of Ukraine - hryvnias are converted into rubles on the official rate of the Central bank of the Russian Federation established for September 30, 2022.

Article 3. Features of legal regulation of the relations on compulsory social insurance on case of temporary disability and in connection with motherhood

1. Citizens who had the right to temporary disability benefit, maternity allowances according to the acts of the Donetsk People's Republic and the Luhansk People's Republic existing till March 1, 2023 and who have temporary disability maternity leave proceed after February 28, 2023, from March 1, 2023 have the right to providing with temporary disability benefit, maternity allowance according to the Federal Law of December 29, 2006 No. 255-FZ "About compulsory social insurance to case of temporary disability and in connection with motherhood". If the size of the benefit estimated to such citizens according to the specified Federal Law does not reach the size of the benefit estimated according to the acts of the Donetsk People's Republic and the Luhansk People's Republic existing till March 1, 2023, the benefit is paid in former size.

2. The citizens who are engaged in business, professional, other activity, providing themselves with work independently who as of December 31, 2022 were insured persons on obligatory social insurance on case of temporary disability and in connection with motherhood according to acts of the Donetsk People's Republic or on obligatory national social insurance on temporary disability and in connection with motherhood according to acts of the Luhansk People's Republic during the period have from March 1 to December 31, 2023 the right to insurance coverage for compulsory social insurance to case of temporary disability and in connection with motherhood in the sizes established by the Federal Law of December 29, 2006 No. 255-FZ "About compulsory social insurance on case of temporary disability and in connection with motherhood" for persons voluntarily entered legal relationship on compulsory social insurance on case of temporary disability and in connection with motherhood (taking into account the features established by part of 1 this Article), can also continue these legal relationship on the conditions provided by the specified Federal Law.

3. Temporary disability benefits, maternity allowances on the insured events which came till March 1, 2023 are appointed and paid based on the leaf of disability issued in the form established according to the acts of the Donetsk People's Republic and the Luhansk People's Republic existing till March 1, 2023.

4. Temporary disability benefits, maternity allowances on the insured events which came during the period from March 1, 2023 to January 1, 2026 are appointed and paid based on the leaf of disability issued by the medical organization in the document form on paper or created by the medical organization and placed in information system of Fund of the pension and social insurance of the Russian Federation in electronic form signed with use of the strengthened qualified digital signature by the health worker and the medical organization.

5. To the insured persons which are as of March 1, 2023 in child care leave from the specified date for child care leave before achievement of one and a half years by the child of age the monthly allowance on child care according to the Federal Law of December 29, 2006 is granted and paid to No. 255-FZ "About compulsory social insurance on case of temporary disability and in connection with motherhood".

6. In insurance years of service for determination of the sizes of temporary disability benefits, maternity allowances along with the periods of work and (or) other activities of insured person included in insurance years of service according to the Federal Law of December 29, 2006 in No. 255-FZ "About compulsory social insurance on case of temporary disability and in connection with motherhood" the periods of work and (or) other activities during which insured person was subject to obligatory social insurance on case of temporary disability and in connection with motherhood according to the acts of the Donetsk People's Republic existing till March 1, 2023, and the periods of work and (or) other activities are set off, during which insured person was subject to obligatory national social insurance on temporary disability and in connection with motherhood according to the acts of the Luhansk People's Republic existing till March 1, 2023, and also the periods of work of insured person on the employment contract, replacements of the state and municipal positions, positions of the public and municipal service in the territories of the Zaporizhia region and Kherson region during the period from September 30, 2022 to March 1, 2023.
