About approval of Aviation rules of the organization of investigation of the aviation events which happened to the national air vehicles of the Republic of Belarus, their classification and accounting

Based on the paragraph of the fifth of part one of Article 6, No. 1617 "About implementation of the Air code of the Republic of Belarus" the Ministry of Defence of the Republic of Belarus DECIDES: parts two of article 81 of the Air code of the Republic of Belarus and Item 1 of the resolution of Council of Ministers of the Republic of Belarus of December 4, 2006

1. Approve Aviation rules of the organization of investigation of the aviation events which happened to the national air vehicles of the Republic of Belarus of their classification and accounting (are applied).

2. Declare invalid the resolution of the Ministry of Defence of the Republic of Belarus of December 31, 2010 No. 54 "About approval of Aviation rules of the organization of investigation of the aviation events which happened to the national air vehicles of the Republic of Belarus, their classification and accounting".

3. This resolution becomes effective after its official publication.

Aviation rules of the organization of investigation of the aviation events which happened to the national air vehicles of the Republic of Belarus, their classification and accounting

Section I. General provisions

Chapter 1. Basic provisions

1. In these Aviation rules are determined procedure for the organization of investigation of the aviation events (further – AS) which happened to the national air vehicles of the Republic of Belarus (further – AF), their classification and procedure for their accounting.

2. For the purposes of these Aviation rules terms in the values established in the Air code of the Republic of Belarus and also the following terms and their determinations are applied:

accident – aviation non-fatality accident;

aviation system – set jointly acting in the environment of aviation engineering, crews of AF, forces and controls and the flight servicings integrated structurally and functionally for the benefit of accomplishment of flights;

air unit (the aviation organization) – the military unit or the organization which is under supervision of republican state body, other state body and organization, republican state public association "Volunteer Society for Cooperation with the Army, Aviation, and Fleet of the Republic of Belarus" (further if other is not determined, – ROGU), and having legally the state aircraft and directly using it for implementation military, boundary, Customs Service, law-enforcement activities, the prevention and liquidation of emergency situations of natural and technogenic nature, the solution of tasks in the field of mobilization preparation, and also for the solution of other national objectives connected using this aircraft, determined by the President of the Republic of Belarus;

aviation division – aviation link, aviation group, aviation squadron or airmobile group, flight-test division of the organization manufacturer or repair organization, and also other regular primary aviation structure of air unit (the aviation organization);

aviation incident (further – AP) – AS connected with flight operation of AF which led to loss of life, and (or) loss of this AF. AF is considered lost when: there was final fracture of AF; location of AF (its fragments) is not established and official searches are stopped; evacuation of AF from the place of its forced landing is impossible or inexpedient irrespective of the received injuries; recovery of AF is impossible or economically inexpedient;

aviation incident (further – AI) – AS connected with flight operation of AF which could create or created threat of integrity of AF and (or) life of persons which are on its board, but AP did not end;

the state of the place of event – the state in the territory of which took AP place;

State of Registry of AF – the state in which registers it is registered by AF;

the state – the operator of AF – the state in the territory of which there is the main place of activities as a part of the organization in which are operated by AF, or if the organization in which are operated by AF does not take such place of activities (the permanent place of stay of this organization);

the interested states – the state of the place of event, State of Registry of AF, the state – the operator of AF, the state having jurisdiction concerning the organization responsible for final assembly of AF, design of the AF type, and also the state which citizens died or sustained bodily harms under AP;

aviation engineering service (further – IAS) – service of control aircraft, air unit or division which service employees (which) perform actions for content of aviation engineering, means of its operation and repair in permanent LOC ARM to use, IAS of flights, providing technical aviation safety (further – BZP) and also will organize and carry out technical training of aeronautical personnel;

technical engineer personnel (further – ITS) – aeronautical personnel of IAS;

catastrophic crash – AP with the human victims and (or) loss without message of passengers or crew members of AF;

the commission on investigation of AS (further – the commission) – specially appointed group of specialists, representatives to perform investigation of AS;

flight operation – for AF, – the process of their operation covering the period from the beginning of carrying out from flight personnel of pre-flight inspection of AF and till the moment when all persons which were onboard AF with objective of the flight left AF, except for persons which are carrying out post-flight preparation; for the unmanned aerial vehicle (further – BLA), – the period from the beginning of carrying out from the operator of BLA of pre-flight inspection of BLA and until landing of BLA with use of parachute method or engine shutdown (engines) when landing BLA in an aircraft way (in a helicopter way);

land incident – the event which is not connected with flight operation of AF, took place in holding time, storages or transportations of AF in case of whom there was its damage or loss. The damages eliminated by means of replacement of aggregates and which are not requiring use of the technologies which are not provided in management (instruction) for technical operation of AF do not belong to land incidents;

dangerous factor (further – OF) – the potential reason (factor) which manifestation brought (brings or can bring) to origin and (or) development of special situation;

body of BZP – service BZP or specially authorized (representatives) official (official) person (persons) on who, (whom) obligations on accomplishment of functions of service BZP are assigned;

control flights – groups of management of flights (further – GRP), calculations of direction posts on duty of aircraft and duty shift of the 570th center of air traffic management, and also the calculations of other control centers intended for direct transfer to crew of AF (the operator of BLA) of flight conditions, teams and information;

controls aircraft – controls and structural divisions of ROGU which forces perform the organization of activities for purpose and operational management by the state aircraft;

special situation – the situation which arose in the course of flight operation of AF as a result of manifestation (impact) of OF;

the reasons (factors) of AS – actions, failure to act, circumstances, conditions or their combination which led to AS;

serious AI (further – SAI) – AI connected with emergence of the conditions which are characterized by substantial increase of probability of AP which prevention requires accomplishment from crew members of AF (the operator of BLA) and (or) the service employee of the control flights performing management and flight control of AF, the difficult and (or) emergency actions which are not applied in the conditions of normal flight of AF;

SAI with damage of AF (further – SAIP) – AI, in case of which recovery of AF who sustained damage, perhaps and economically reasonablly. The damages eliminated by means of replacement of aggregates and which are not requiring use of the technologies which are not provided in management (instruction) for technical operation of AF do not belong to serious aviation incidents with damage of AF;

the adviser to the authorized representative – the person having the corresponding qualification and giving help to the authorized representative in conducting investigation of AP;

structural division – the structural division of Armed Forces intended for implementation of functions of the Ministry of Defence as specially authorized body in the field of defense on state regulation of activities for purpose of the state aircraft;

bodily harm from the death (only for the purpose of uniformity of statistical data) – bodily harm as a result of which within 30 days from the moment of incident there came death;

BZP authorized body of the state aircraft – The Ministry of Defence authorized in regulatory legal acts of the Republic of Belarus to make investigations of AP with AF, to consider and classify AS with AF, and also to exercise interdepartmental control of activities of aeronautical personnel of the state aircraft in the part concerning BZP;

the authorized representative – person to whom the head of the BZP authorized body of the state aircraft charged to be involved in the investigation of AS made by other state;

the human victims – persons which were onboard AF whose death followed as a result of AP, including the bodily harms which sustained as a result of this incident from the death;

emergency – the event which is not relating to AP connected with operation of AF in case of whom there came one of the following effects:

loss of AF or death of the people who were on its board during operational flight, as a result of act of terrorism, stealing or attempt of stealing of AF;

death of the people who were onboard AF as a result of adverse effects of external environment after its forced landing out of airfield;

loss of AF or death of the people who were on the earth as a result of AP with other AF;

loss of AF or death of the people who were on its board in case of accomplishment of special tasks in zones of emergency state;

operation of AF – the stage of lifecycle of AF from the moment of its acceptance in air unit (the aviation organization) from the organization manufacturer or the repair organization which is set of commissioning, reduction in the established LOC ARM degree to proper use, maintenance in the established LOC ARM degree to this use, proper uses, storages and transportations. Test flights (flights) which are carried out by forces of flight-test divisions of the repair organizations on AF which underwent assembly and adjustment after completion (at the final stage) repair or upgrade belong to operation.

3. Each AS in the state aircraft is subject to obligatory investigation by forces of the commission.

4. Investigation of AS is made for the purpose of establishment of its reasons and taking measures to their prevention in subsequent. Establishment of someone's fault and responsibility is not the purpose of investigation of AS.

5. In case of AP with foreign AF in the territory of the Republic of Belarus from the BZP authorized body of the state aircraft without delay information on AP in accordance with the established procedure goes to the BZP authorized bodies of the state aircraft of State of Registry of AF, the state – the operator of AF, and if necessary – to the BZP authorized bodies of the state aircraft of other interested states according to international treaties.

6. When carrying out by forces of law enforcement agencies of investigative actions upon AS the commission chairman coordinates with them work of the commission.

Chapter 2. Classification of aviation events

7. The EXPERT are subdivided into AP, AI, with participation of AF: emergencies, land incidents.

8. AP depending on their effects are subdivided into catastrophic crashes and accidents.

9. AI depending on degree of their danger and effects are subdivided into AI, SAI and SAIP.

10. The following cases belong to AI with piloted by AF:

10.1. SAI:

collision of AF;

collision of AF with land (surface) obstacle;

hit in AF of weapons of destruction (splinters);

unauthorized or extra polygon use of aviation weapons of destruction;

defeat of AF discharge of atmospheric electricity;

hit of AF in the dangerous phenomena of weather;

weeds AF with the configuration which is not corresponding to the flying mission;

conclusion of AF to the drop mode, loss of controllability of AF;

exceeding of operational restrictions of AF with emergence of permanent distortions of design;

loss at crew members of AF of space or visual orientation;

forced landing of AF out of airfield (site of particular mission), except for landings to the landing site which is picked up from air in case of meeting with the dangerous phenomena of weather or in case of orientation loss;

violation of loading rates of AF, transportation of the prohibited loads, shift of loads;

sharp decrease or loss of efficiency of the pilot (crew member);

the fire onboard AF;

engine failure, and also the engine shutdown in flight which is not provided in task (including switching off owing to emergence of phantom signal about its refusal);

the failures of the system of management of AF referred to particular cases of flight and which led to difficulty of piloting of AF;

spontaneous release of the brake parachute on take-off or on prelanding planning;

destruction (emergency opening, failure) of lamp (shutter, the movable blister, the illuminator) AF in flight;

separation or spontaneous opening of doors, hatches, ladders, cowls or fairing;

not release of one or more landing gear legs from the main system. Spontaneous (wrong) release or cleaning of the landing gear;

flight on icy AF (in the presence of ice on the surfaces protected by anti icing system). Flight in the icing conditions on AF which are not equipped with anti icing system;

violations of safe height of flight, statutory rules of vertical, longitudinal and side separation;

violation of the established weather minimum in case of take off and landing;

accomplishment of landings to the platforms which are picked up from air which do not meet the requirements established is aware fighting (flight, educational and flight) of preparation of aviation category;

accomplishment of the landings which are not provided in task. Landing outside the boundaries of landing strip (landing site), except for gliders, rolling-out out of its limits in case of take-off or landing;

AF gas station substandard fuels and lubricants, liquids and gases;

acceptance and release of AF from unprepared landing strips;

the refusal of the main and duplicative communicating device and radio engineering flight servicing which influenced accomplishment of the flying mission;

other events which led to emergence of difficult situation or to damnification to health of crew members (passengers) of AF.

10.2. AI:

takeoff rejection;

attempt of taking-off (landing) of AF with the configuration which is not conforming to the requirements stated in flight manual of AF;

landing with the overload exceeding the most admissible for AF of this type. Landing strip contact with tail bumper;

hit in wake trace on take-off or on glide path of descent to landing, and also in the cases which are followed by essential change of flight parameters;

go-around from height, less admissible in flight manual of AF;

landing with the fuel remaining balance which is not providing accomplishment of repeated landing approach;

not release or break of the brake parachute on run;

collision of AF with birds;

exceeding of operational restrictions of AF;

violation of the set minimum safe parameters of fighting procedure for AF;

the rapprochement of AF with other AF which is not provided in task excluding them separate observation from the available radar stations;

violation of restrictions of use of aviation weapons of destruction;

hit of AF in defeat zone (scattering of splinters) of the applied aviation weapons of destruction;

cracks initiation on load-bearing elements of glider, windshields in flight;

crew departure without preflight health control. Disease state of crew members in case of flight execution;

flight execution without the special equipment of crew members corresponding to flight conditions;

exceeding of regulations of raid for crew in flight change, violation of the mode of work and regulations of rest before flights;

crew departure on flight with not completed documentation;

non-compliance with conditions of accomplishment of the flying mission;

fuel leak in fire-dangerous places of AF;

unauthorized (without identification) accomplishment of air-to-air attack;

change of specified height of flight without the permission of (notification) from body of air traffic maintenance;

submission of the executive command to the commander of crew in case of wrong fix of AF;

issue to crew of the wrong data on the place of AF;

issue to crew of the wrong data on takeoff conditions, landing approach and landing;

temporary loss of control at crew of AF;

hit of crew in conditions in which for flight his members are not prepared;

task performance for the crew which is not corresponding to training level of his members;

exceeding of normative terms of transition to standby facilities of communication and radio engineering flight servicing in case of refusal of the main or on autonomous electric power supplies in case of electricity outage;

the termination of issue of GRP or to calculations of control centers (further – KP) information on air picture in responsibility zone;

complete or manned partial radio communication failure in flight;

issue from the operator of radar station of height with the mistake exceeding tactical specifications;

giving on flights of unprepared ground servicing equipments of common application;

dazzle of the pilot (crew member) of AF light of headlights of road or special transport on taxiways and near landing strip at night;

accomplishment of flights from landing strip (site) which is not meeting the established requirements;

untimely development and finishing storm warning;

release in flight of AF with incomplete maintenance;

the refusals of aviation engineering which led to the termination (failure to carry out) of the flying mission;

other events under the organization, management, accomplishment, or flight servicing which led to violations of the requirements stated in regulatory legal acts by rules of carrying out flights and preparation for them and could create or created threat of integrity of AF and life of persons which are on its board.

11. The following cases belong to AI with BLA:

11.1. SAI with BLA:

collision of BLA;

collision of BLA with land (surface) obstacle;

hit in BLA of weapons of destruction (splinters);

unauthorized or extra polygon use of aviation weapons of destruction;

defeat of BLA discharge of atmospheric electricity;

hit of BLA in the dangerous phenomena of weather;

weeds BLA with the configuration which is not corresponding to the flying mission;

conclusion of BLA to the drop mode, loss of controllability of BLA;

exceeding of operational restrictions of BLA with emergence of permanent distortions of design;

forced landing of BLA out of airfield (site of particular mission), except for landings to the landing site which is picked up from air in case of meeting with the dangerous phenomena of weather or in case of orientation loss;

the loss at the operator of BLA of control of management of BLA which entailed failure to carry out of the flying mission;
