1. Approve the Instruction about procedure for evaluating compliance of opportunities of the license applicant to dolitsenzionny requirements, the licensee to the licensed requirements imposed for the activities connected with office and civil weapon and ammunition to it by collecting and exhibiting of weapon and ammunition it (is applied).

2. Bring in the resolution of the Ministry of Internal Affairs of the Republic of Belarus of November 29, 2010 No. 383 "About placement of weapon, its components and components, ammunition" the following changes:

in word preamble "the paragraph of third Item 306 of the Regulations on licensing of separate types of activity approved by the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450," shall be replaced with words "the paragraph of third of article 202 of the Law of the Republic of Belarus of October 14, 2022 No. 213-Z "About licensing";

1. This Instruction determines procedure for evaluating compliance of opportunities of the license applicant to dolitsenzionny requirements, the licensee to the licensed requirements imposed for the activities connected with office and civil weapon and ammunition to it, collecting and exhibiting of weapon and ammunition (further - assessment).

2. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus of November 13, 2001 No. 61-Z "About weapon" and the Law of the Republic of Belarus "About licensing are used".

3. Assessment is carried out by territorial authority of internal affairs in the place of implementation of the licensed type of activity after receipt in the Ministry of Internal Affairs of the statement of the license applicant for provision of the license for the right of implementation of the activities connected with office and civil weapon and ammunition to it, collecting and exhibiting of weapon and ammunition (further - the license), the licensee about change of the license before decision making about provision, about refusal in provision, about change, about refusal in change of the license.

4. Evaluating begins no later than three working days after receipt in territorial authority of internal affairs from the Ministry of Internal Affairs of information on need of its carrying out and comes to the end no later than 10 working days after its beginning.

5. The license applicant (licensee) is informed by territorial authority of internal affairs on evaluating by e-mail and (or) by phone, specified in the statement of the license applicant for provision of the license, the licensee for change of the license, no later than two working days till its beginning.

6. Objects of assessment are:

availability at the license applicant (licensee) of rooms, buildings and conditions for placement of weapon, its components and components, the ammunition conforming to requirements of the legislation regulating traffic in weapons and ammunition in the territory of the Republic of Belarus;

compliance of the license applicant (licensee) - physical person, workers of the license applicant (licensee) - the legal entity to requirements, the stipulated in Clause 14 Laws of the Republic of Belarus "About weapon";

observance by the licensee of Rules of placement of weapon, its components and components, ammunition when implementing the activities connected with office and civil weapon and ammunition to it, collecting and exhibiting of weapon and the ammunition approved by the resolution of the Ministry of Internal Affairs of the Republic of Belarus of November 29, 2010 No. 383;

ensuring with the licensee accounting and storage of weapon, its components and components, ammunition according to requirements of the legislation on weapon.

7. When evaluating:

the documents which are available for the license applicant (licensee) confirming availability on the property right or other legal cause of the rooms, buildings necessary for implementation of the licensed activities, plans of such rooms, buildings are studied (for the legal entity);

availability of the agreement on rendering by Department protection of the Ministry of Internal Affairs of security services in protection of objects (property) of the license applicant (licensee) with use of means and systems of protection is checked;

examination of the rooms which are available for the license applicant (licensee), buildings and conditions for placement of weapon, its components and components, ammunition regarding their compliance to requirements of the legislation regulating traffic in weapons and ammunition in the territory of the Republic of Belarus is conducted;
