ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About features of the description of the test strips for determination of content of glucose in blood which are subject to purchase for ensuring the state and municipal needs about standard conditions of the contracts which are subject to use by customers when implementing purchases for delivery of such test strips and about modification of the list of separate types of the medical products coming from foreign states concerning which restrictions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs are set

According to part 5 of Article 33 and part 11 of article 34 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" Government of the Russian Federation decides:

1. Establish the following features of the description of the test strips for determination of content of glucose in blood which are subject to purchase for ensuring the state and municipal needs and intended for the analyzer of level of the sugar of blood portable corresponding to codes 300680, of 300690, 344110 types of medical product according to nomenclature classification of medical products (further respectively - test strips, purchases, the analyzer):

a) in the description of subject to purchase the additional information and additional consumer properties which are not provided in the line item of the catalog of goods, works, services for ensuring the state and municipal needs created concerning subject to purchase are not specified;

b) in the description of subject to purchase are specified:

the words "or equivalent" accompanying specifying on the trademark of test strips if the description of subject to purchase contains specifying on the trademark of test strips;

the name of the analyzer for which test strips, its trademark intend (in the presence at the trademark analyzer);

possibility of voluntary conveyance to the customer of the new analyzers compatible to the delivered test strips if the supplier in case of application for participation in purchase offered to delivery of test strip, corresponding to the indicators specified in the description of subject to purchase according to part 2 of article 33 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", but being incompatible with the analyzer specified in the description of subject to purchase according to the paragraph to third this subitem;

the number of the analyzers which are subject to voluntary conveyance to the customer by the supplier in the case provided by the paragraph the fourth this subitem, corresponding to the number of patients for whose providing procurement of test strips is conducted;

c) in the description of subject to purchase requirements can be specified:

to training of workers of the customer in use of analyzers in the case provided by the paragraph the fourth the subitem "b" of this Item;

to the warranty obligations provided by part 4 of article 33 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" concerning the analyzer which is subject to voluntary conveyance to the customer in the case provided by the paragraph the fourth the subitem "b" of this Item.

2. Establish the following standard conditions of contracts which are subject to use by customers when implementing purchases:

a) if the subject of the contract is delivery of the test strips incompatible with the analyzer provided in the description of subject to purchase, the supplier shall donate along with delivery of such test strips to the customer new analyzers, compatible to them, in the quantity provided in the description of subject to purchase;

b) if according to the contract new analyzers are donated to the customer, the supplier shall provide training of workers of the customer in use of such analyzers;

c) if according to the contract new analyzers are donated to the customer, the supplier shall provide execution of the warranty obligations provided in the description of subject to purchase concerning such analyzers.

3. Determine that:

a) provisions of Items 1 and 2 of this resolution are applied also when implementing purchases which subject in addition to test strips according to the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" includes other medical products;

b) the standard conditions of contracts provided by the subitem "b" of Item 2 of this resolution are subject to use when implementing purchases if in the description of subject to purchase the requirements provided by the paragraph the second the subitem "v" of Item 1 of this resolution are specified;

c) the standard conditions of contracts provided by the subitem "v" of Item 2 of this resolution are subject to use when implementing purchases if in the description of subject to purchase the requirements provided by the paragraph third the subitem "v" of Item 1 of this resolution are specified.

4. Approve the enclosed changes which are made to the list of separate types of the medical products coming from foreign states concerning which restrictions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs, No. 102 approved by the order of the Government of the Russian Federation of February 5, 2015 "About restrictions and conditions of the admission of separate types of the medical products coming from foreign states for the purposes of implementation of purchases for ensuring the state and municipal needs" (The Russian Federation Code, 2015, No. 6, Art. 979 are set; 2016, No. 18, Art. 2630; No. 50, Art. 7091; 2019, No. 27, Art. 3578).

5. This resolution does not extend to implementation of the purchases necessary for realization of provisions of the Program of experimental legal regime in the field of digital innovations in the direction of medical activities using technologies of collection and processing of data on the state of health and diagnoses of citizens concerning realization of initiative of social and economic development of the Russian Federation "Personal medical assistants" approved by the order of the Government of the Russian Federation of December 9, 2022 No. 2276 "About establishment of experimental legal regime in the field of digital innovations and approval of the Program of experimental legal regime in the field of digital innovations in the direction of medical activities using technologies of collection and processing of data on the state of health and diagnoses of citizens concerning realization of initiative of social and economic development of the Russian Federation "Personal medical assistants".
