About approval of the Regulations on conservation zones of thermal networks

Based on article 31 of the Law No. 92/2014 on heat energy and promotion of cogeneration (The official monitor of the Republic of Moldova, 2014, Art. No. 178-184, 415), with subsequent changes, DECIDES: the Government

1. Approve Regulations on conservation zones of thermal networks it (is applied).

2. To bodies of local public authority, as the party responsible for transfer of information on land cards and for informing the interested legal entities and physical persons on arrangement of thermal networks to provide creation of the mechanism of control of observance of conservation zones by the heat power companies, project organizations, owners of the lands located in conservation zones of thermal networks and the physical persons and legal entities performing construction, other works or actions in conservation zones of thermal networks in the managed territory.

3. To impose control of execution of this resolution on the Ministry of infrastructure and regional development.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on conservation zones of thermal networks

Chapter I General provisions

1. The regulations on conservation zones of thermal networks (further - the Provision) establish rules of ensuring protection and reliable functioning of thermal networks for the purpose of exception of creation of danger to persons, property and the environment by determination and establishment of conservation zones of the thermal networks and rules which are subject to observance in these zones including by regulation of some prohibitions and restrictions on the mode of building, implementation of works and access for persons to conservation zones of thermal networks.

2. This Provision is applied to the heat power companies, bodies of local public authority, project organizations, owners of the lands located in conservation zones of thermal networks to the physical persons and legal entities performing construction, other works and actions in conservation zones of thermal networks and will be applied during designing, reconstruction, upgrade, technical retrofitting, including in case of capital repairs, operation of thermal networks, and also in case of performance of works in the conservation zone of thermal networks.

3. For the purposes of this provision the following concepts are determined:

the owner of the earth - the physical person or legal entity having the property right, ownership or land use on the earth located in the conservation zone of thermal networks;

differentiating Item - the place in which installation for use of heat energy is connected to thermal network and in which the property of the consumer and property of the heat power company are differentiated by the property right, or the place in which the property of the heat power companies is differentiated by the property right;

thermal Item - set of installations through which adaptation of parameters of the water and temperature modes to requirements of consumption is performed and by means of which one or several consumers are supplied with heat energy. Thermal Items can be as individual, intended for connection of system of heating and hot water service for economic needs of the building or part of the building, and central, intended for connection of systems of heating and hot water service for economic needs of two and more buildings;

thermal network - set of pipes, pumping units, central heat distribution stations, the individual thermal Items located below differentiation Item from the heatstation, combined heat and power plants which serve for transfer and distribution of heat energy before installations on use of heat energy of the consumer;

the conservation zone of thermal networks - the expanded and space zone adjacent to thermal networks, with special conditions of use, established along the route of thermal networks and around other auxiliary objects of thermal networks within which ban or restrictions for access for persons, operation of land fund, works, the mode of building and laying of green plantings for providing normal service conditions, repair and reconstruction, for exception of possibility of damage of thermal networks, and also in order to avoid creation of danger to persons, property and the environment is imposed.

4. In the course of authorization of construction works bodies of local public authority shall order receipt of written consent of the heat power company operating thermal networks in which conservation zone accomplishment of the corresponding works, and/or observance of requirements to conservation zones of thermal networks is planned.

5. Bodies of local public authority and the heat power companies shall provide within 10 working days information on arrangement of thermal networks and the conservation zones adjoining to them, upon the demand of physical persons and legal entities which are going to perform in conservation zones of thermal networks certain works from among listed in Item 20.

Chapter II Thermal networks and conservation zones

Section 1 Thermal networks and minimum requirements to their safety

6. Thermal networks are a part of the system heat supplies and represent complex of underground and elevated thermal pipes, pumping points, thermal Items and other auxiliary installations and constructions (the central and individual thermal Items, pavilions, cameras, drainage devices) through which distribution of the heat carrier from development source to systems of heating and systems of supply of consumers with hot water for economic needs, and also circulation of the heat carrier back to development source is provided.

7. Thermal networks are designed, under construction, are technically serviced and operated so that under any operating conditions their safety and continuous heat supply of consumers in the set parameters, with observance of the construction standard rates concerning the engineering networks and the equipments relating to structures, approved by the central industry body of public management in the field of construction was ensured.
