About development of micro, small and medium entrepreneurship

This Law according to Item 10 of part I of article 94 of the Constitution of the Azerbaijan Republic governs the relations in the field of development of micro, small and medium entrepreneurship, determines forms and methods of encouragement of the state support of subjects of micro, small and medium entrepreneurship.

Chapter 1. Basic provisions

Article 1. The basic concepts used in this Law

1.1. The basic concepts used in this Law have the following values:

1.1.1. subjects of micro, small and medium entrepreneurship - the commercial legal entities and individual entrepreneurs carried based on article 4-1 of the Law of the Azerbaijan Republic "About business activity" to subjects of micro, small and medium entrepreneurship;

1.1.2. competent structure - the body (structure) determined by relevant organ of the executive authority, keeping development of micro, small and medium entrepreneurship, participating in regulation of micro, small and medium entrepreneurship, protection of interests of the specified subjects of entrepreneurship and the solution of their problems, rendering them services which list affirms the body (structure) determined by relevant organ of the executive authority coordinating the services rendered by state bodies (structures) and private structures to subjects of micro, small and medium entrepreneurship;

1.1.3. the unified register of subjects of micro, small and medium entrepreneurship - the collection of electronic information about the legal entities and individual entrepreneurs carried to subjects of micro, small and medium entrepreneurship, the services and measures of support given them by the state, results of assessment of their activities;

1.1.4. the structures constituting infrastructure of support of subjects of micro, small and medium entrepreneurship - the commercial and non-commercial legal entities performing activities in the field of development of subjects of micro, small and medium entrepreneurship, increase in their investment and innovative activity, distribution of the goods made by them (the performed works, the rendered services), results of intellectual activities in the internal and external markets;

1.1.5. business incubator - the legal entity having in the property or use specially equipped rooms and the corresponding property for production of goods (performance of works, rendering services) providing support to persons interested to begin business activity and to the beginning subjects during initial stage of development by rendering incubatory services, the stipulated in Article 11.2 presents of the Law.

1.2. Other concepts used in this Law express the values determined by regulatory legal acts of the Azerbaijan Republic.

Article 2. The legislation in the field of development of micro, small and medium entrepreneurship

2.1. The legislation in the field of development of micro, small and medium entrepreneurship consists of the Constitution of the Azerbaijan Republic, international treaties which participant is the Azerbaijan Republic, the Civil code of the Azerbaijan Republic, this Law, the Law of the Azerbaijan Republic "About business activity" and other regulatory legal acts.

2.2. The relations connected with development of micro, small and medium entrepreneurship in the free economic zone Alyat are regulated according to requirements of the Law of the Azerbaijan Republic "About the Alyatsky free economic zone".

Chapter 2. State policy in the field of development of micro, small and medium entrepreneurship

Article 3. The purposes, the principles and the main directions of state policy in the field of development of micro, small and medium entrepreneurship

3.1. Main objectives of state policy in the field of development of micro, small and medium entrepreneurship in the Azerbaijan Republic are:

3.1.1. creating favorable conditions for development of micro, small and medium entrepreneurship;

3.1.2. increase in competitiveness of subjects of micro, small and medium entrepreneurship;

3.1.3. stimulation of investment and innovative activity of subjects of micro, small and medium entrepreneurship;

3.1.4. ensuring sustainable development of micro, small and medium entrepreneurship;

3.1.5. assistance to exit of the goods made by subjects of micro, small and medium entrepreneurship (the performed works, the rendered services), results of their intellectual activities on the domestic and foreign market;

3.1.6. employment of the population and development of self-employment by support of entrepreneurial initiative of citizens;

3.1.7. increase in share of subjects of micro, small and medium entrepreneurship of gross domestic product and not oil export.

3.2. The principles of state policy on development of micro, small and medium entrepreneurship in the Azerbaijan Republic are:

3.2.1. assessment of possible influence of projects of regulatory legal acts on regulation of business activity on business activity of subjects of micro, small and medium entrepreneurship;

3.2.2. increase in efficiency of services and state support of subjects of micro, small and medium entrepreneurship;

3.2.3. availability of infrastructure of support of subjects of micro, small and medium entrepreneurship to all subjects of micro, small and medium entrepreneurship;

3.2.4. creation of equal opportunities for subjects of micro, small and medium entrepreneurship concerning participation in the state, regional, local development programs, and also in development programs on priority industries of economy and receipt of the state support;

3.2.5. openness and transparency of procedures of rendering the state support;

3.2.6. forming of mechanisms of the state support according to the legislation on unfair competition.

3.3. The main directions of state policy in the field of development of micro, small and medium entrepreneurship in the Azerbaijan Republic are:

3.3.1. the organization through competent authority of services in the territories where subjects of micro, small and medium entrepreneurship directly perform the activities, for increase in knowledge of subjects of micro, small and medium entrepreneurship of the services and support rendered to subjects of micro, small and medium entrepreneurship, the solution of the arisen difficulties which they meet, and supports of development of their activities;

3.3.2. enhancement of the mechanism of participation of subjects of micro, small and medium entrepreneurship in public procurements;

3.3.3. realization of tax policy which will help business and investing activities of subjects of micro, small and medium entrepreneurship;

3.3.4. forming of infrastructure of support of micro, small and medium entrepreneurship and ensuring its constant development;
