JOINT ORDER OF THE MINISTER OF HEALTH OF THE REPUBLIC OF KAZAKHSTAN AND MINISTER OF NATIONAL ECONOMY OF THE REPUBLIC OF KAZAKHSTAN

About approval of criteria for evaluation of risk degree and checking sheets in the sphere of sanitary and epidemiologic wellbeing of the population

(as amended on 28-06-2024)

According to Items 5 and 6 of Article 141 and Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan PRIKAZYVAYEM:

1. Approve:

1) criteria for evaluation of risk degree in the sphere of sanitary and epidemiologic wellbeing of the population according to appendix 1 to this order;

2) checking sheets in the sphere of sanitary and epidemiologic wellbeing of the population with requirements to: to objects, irrespective of purpose and types of activity according to appendix 2 to this order;

to the health care facilities giving out-patient and polyclinic and consulting and diagnostic help according to appendix 3 to this order;

to facilities for production, production of medicines, storage, wholesale and retail sale of medicines, products of medical appointment, medical equipment according to appendix 4 to this order;

to objects of traditional and traditional medicine (healing) according to appendix 5 to this order;

to the health care facilities giving palliative care and sisterly leaving according to appendix 6 to this order;

to health care facilities, recovery treatment and medical rehabilitation according to appendix 7 to this order;

to the health care facilities giving stationary help according to appendix 8 to this order;

to the objects rendering dental services according to appendix 9 to this order;

to the health care facilities performing activities in the sphere of forensic medicine and pathological anatomy according to appendix 10 to this order;

to the health care facilities performing activities in the sphere of service of blood according to appendix 11 to this order;

to objects of preschool education and training according to appendix 12 to this order;

to children's improving and sanatorium objects (year-round, seasonal) according to appendix 13 to this order;

to objects for rendering services to the population by means of computers (personal computers, tablet personal laptops) and video terminals (computer clubs) according to appendix 14 to this order;

to objects of education according to appendix 15 to this order;

to objects of public catering with production, conversion and realization of food products according to appendix 16 to this order;

to facilities for production of food products according to appendix 17 to this order;

to objects of wholesale and retail trade according to appendix 18 to this order;

to the organizations and vehicles (railway, water, air) transporting passengers; to the organizations and vehicles (railway, automobile, water and air) performing transportation of sources of ionizing radiation, dangerous chemical and toxic goods according to appendix 19 to this order;

to objects for servicing of vehicles (air, railway, water, automobile) and passengers according to appendix 20 to this order;

to radiation-hazardous objects according to appendix 21 to this order;

to objects of public catering on transport (railway, air, water and automobile), to objects of onboard food according to appendix 22 to this order;

to objects of production, storage and realization of perfumery and cosmetic products and means of hygiene according to appendix 23 to this order;

to subjects to temporary residence of people according to appendix 24 to this order;

to objects of social infrastructure (cultural and spectacular objects, residential and office buildings, the organizations for operation of residential and public buildings, offices, the organizations managing houses, cooperatives of owners of rooms) according to appendix 25 to this order;

to sewer treatment facilities and networks (including the stormwater drainage system) according to appendix 26 to this order;

to objects for collection, storage, transportation, removal, sorting, conversion, disinfecting, utilization of production, it is firm - household and other types of waste according to appendix 27 to this order;

to subjects to sports appointment, pools, baths, saunas, laundries, dry-cleaners according to appendix 28 to this order;

to water objects 2 categories (cultural and community appointment), vacation spots (beaches) according to appendix 29 to this order;

to medical and cosmetology objects, beauty shops, the cosmetology centers, hairdressing salons according to appendix 30 to this order;

to water sources, places of water intake for economic and drinking water supply, centralized and not centralized systems of economic and drinking water supply according to appendix 31 to this order;

to subjects to funeral appointment, cemeteries, parks, public toilets, places of mass rest according to appendix 32 to this order;

to buildings, constructions and rooms of production appointment, according to appendix 33 to this order;

to the technological and accompanying objects and constructions performing oil operations according to appendix 34 to this order;

to radio engineering objects and radio-electronic means according to appendix 35 to this order;

to objects, buildings and constructions of production appointment in case of construction, reconstruction, repair and input, operation of construction objects according to appendix 36 to this order;

to objects, buildings and constructions of production purpose of the coal industry according to appendix 37 to this order;

to objects, buildings and constructions of production purpose of the chemical industry according to appendix 38 to this order;

to objects, buildings and constructions of production purpose of non-ferrous metallurgy and the mining industry according to appendix 39 to this order;

to objects, buildings and constructions of production purpose of ferrous metallurgy according to appendix 40 to this order;

to all types of laboratories according to appendix 41 to this order;

to objects of storage, transportation and use of immunological medicines (immunobiological medicine) according to appendix 42 to this order;

to the objects performing services in disinfection, disinsection, deratization according to appendix 43 to this order;

to the objects which are subject to the state sanitary and epidemiologic control and supervision in case of introduction of restrictive actions, including quarantine in case of threat of emergence of epidemics, infectious diseases according to appendix 44 to this order;

3) checking leaf in the sphere of sanitary and epidemiologic wellbeing of the population with requirements to objects to the subject state sanitary and epidemiologic control and supervision on compliance to allowing requirements, according to appendix 45 to this order.

2. Recognize invalid some joint orders of the Minister of Health of the Republic of Kazakhstan and the Minister of national economy of the Republic of Kazakhstan of the list according to appendix 46 to this order.

3. To provide to committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

5. This joint order becomes effective since January 1, 2023 and is subject to official publication.

Appendix 1

to the joint Order of the Minister of Health of the Republic of Kazakhstan and the Minister of national economy of the Republic of Kazakhstan of December 2, 2022 No. KR DSM-152, 2 of December, 2022 No. 117

Criteria for evaluation of risk degree in the sphere of sanitary and epidemiologic wellbeing of the population

Chapter 1. General provisions

1. These criteria for evaluation of risk degree in the sphere of sanitary and epidemiologic wellbeing of the population (further – criteria) are developed according to Items 5 and 6 of Article 141 and Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan (further - the Code) for reference of subjects (objects) of control and supervision to risk degrees and selection of subjects (objects) of control and supervision when carrying out preventive control with visit of subject (object) of control and the supervision and (or) check which are carried out on compliance to qualification or allowing requirements on the issued permissions, requirements for directed notifications according to the Law of the Republic of Kazakhstan "About permissions and notifications" (further – check on compliance to requirements), the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 "About approval of form of checking leaf" (it is registered in the Register of state registration of regulatory legal acts at No. 17371) and the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 No. 48 "About approval of Rules of forming by regulatory state agencies of system of assessment and risk management" (it is registered in the Register of state registration of regulatory legal acts at No. 28577).

2. In these Criteria the following determinations are used:

1) point – quantitative measure of calculation of risk;

2) normalization of data – the statistical procedure providing reduction of the values measured in various scales to conditionally general scale;

3) considerable violations – the violations of requirements of the legislation of the Republic of Kazakhstan in the sphere of sanitary and epidemiologic wellbeing of the population which are not relating to insignificant and gross violations according to subitems 2) and 3) this Item;

4) insignificant violations – violations of requirements of the legislation of the Republic of Kazakhstan in the sphere of sanitary and epidemiologic wellbeing of the population which non-compliance entailed and (or) can entail the populations which are formally allowed, but not done any notable harm to health;

5) gross violations – intentional or careless obvious and fundamental breach of the legislation of the Republic of Kazakhstan in the sphere of sanitary and epidemiologic wellbeing of the population which non-compliance entailed and (or) can entail harm of life, to health of the person and the environment, the affecting rights and legitimate interests of physical persons and legal entities;

6) objective criteria for evaluation of risk degree (further – objective criteria) – the criteria for evaluation of risk degree used for selection of subjects (objects) of control and supervision depending on risk degree in certain field of activity and which are not depending directly on separate subject (object) of control and supervision;

7) subjective criteria for evaluation of risk degree (further – subjective criteria) – the criteria for evaluation of risk degree used for selection of subjects (objects) of control and supervision depending on results of activities of specific subject (object) of control and supervision;

8) system of assessment and risk management – process of acceptance of the management decisions directed to decrease in probability of approach of adverse factors by distribution of subjects (objects) of control and supervision on risk degrees for the subsequent implementation of preventive control with visit of subject (object) of control and supervision and (or) checks on compliance to requirements for the purpose of minimum possible extent of restriction of freedom of enterprise, providing at the same time admissible risk level in the corresponding fields of activity, and also directed to change of risk level for specific subject (object) of control and supervision and (or) release of such subject (object) of control and supervision from preventive control with visit of subject (object) of control and supervision and (or) checks on compliance to requirements;

9) the checking sheet – the list of requirements imposed to activities of subjects (objects) of control and supervision which non-compliance involves threat of life and to health of the person, the environment, legitimate interests of physical persons and legal entities, the states;

10) risk in the sphere of sanitary and epidemiologic wellbeing of the population – probability of damnification as a result of activities of the checked subject (object) of life or to health of the person, the environment taking into account severity of its consequences;

11) sample (selection) – the list of the estimated subjects (objects) carried to uniform group of subjects (objects) of control and supervision according to Item 2 of article 143 of the Code;

Epidemic significant objects – objects, the made products and (or) activities of which in case of violation of requirements of the legislation of the Republic of Kazakhstan in the sphere of sanitary and epidemiologic wellbeing of the population can lead 12) to emergence of food poisonings and (or) infectious, parasitic diseases among the population, and (or) do harm to health of the population from physical factors, industrial and radioactive pollution.

3. Criteria for evaluation of risk degree for conducting check on compliance to requirements and preventive control with visit of subject (object) of control and supervision are created by means of determination of objective and subjective criteria which are performed step by step (the multicriteria analysis of decisions).

Chapter 2. Objective criteria for evaluation of risk degree

4. At the first stage by objective criteria subjects (objects) of control and supervision are distributed on three risk degrees: high, average and low according to appendix 1 to these criteria.

5. For fields of activity of subjects (objects) of the state control and supervision carried to high risk, frequency rate of conducting checks on compliance to requirements is determined by criteria for evaluation of risk degree once in half a year.

For fields of activity of subjects (objects) of the state control and supervision carried to average risk degree, frequency rate of conducting checks on compliance to requirements is determined by criteria for evaluation of risk degree every two years.

For fields of activity of subjects (objects) of the state control and supervision carried to low risk degree, frequency rate of conducting checks on compliance to requirements is determined by criteria for evaluation of risk degree once in three years.

6. Concerning subjects (objects) of control and supervision carried to high and average risk degree are carried out check on compliance to requirements, preventive control with visit of subject (object) of control and supervision, preventive control without visit of subject (object) of control and supervision and unscheduled inspection.

7. Concerning subjects (objects) of control and supervision carried to low risk degree are carried out check on compliance to requirements, preventive control without visit of subject (object) of control and supervision and unscheduled inspection.

Chapter 3. Subjective criteria for evaluation of risk degree

8. At the second stage for reference of subjects (objects) of control and supervision to risk degree and selection when carrying out preventive control with visit of subject (object) of control and supervision and (or) check on compliance to requirements, the database, information sources are applied to the identification of subjects (objects) of control and supervision violating requirements of the legislation of the Republic of Kazakhstan in the sphere of sanitary and epidemiologic wellbeing of the population.

9. Frequency rate of preventive control with visit of subject (object) of control and supervision is determined concerning the subjects (objects) of control and supervision carried to high risk once in half-year, carried to average risk degree once a year.

10. Processes of data collection and processing are fully automated and provide possibility of check of correctness of the obtained data.

For assessment of degree of risks by subjective criteria for carrying out preventive control with visit of subject (object) of control and supervision the following sources of information are used:

1) results of the previous checks and preventive control with visit of subjects (objects) of control and supervision;

2) results of preventive control without visit of subjects (objects) of control and supervision.

For assessment of degree of risks by subjective criteria for conducting check on compliance to requirements the following sources of information are used:

1) results of the previous checks;

2) availability of the adverse incidents which arose because of subject (object) of control and supervision. Treat adverse incidents registration of cases of infectious, parasitic diseases and (or) poisonings, occupational diseases and (or) poisonings;

3) analysis results of the data represented by state bodies and the organizations.

11. Based on the available sources of information and subjective criteria semi-annual lists of preventive control with visit and schedules of conducting checks on compliance to requirements of subjects (objects) of the state control and supervision are created.

In the analysis and assessment the data of subjective criteria which are earlier considered and used concerning specific subject (object) of control and supervision or data according to which the term of limitation period according to the legislation of the Republic of Kazakhstan expired are not applied.

12. Proceeding from priority of the applied information sources according to procedure of payments of general exponent of risk by subjective criteria the general exponent of risk by subjective criteria on scale from 0 to 100 is calculated.

On risk exponents the subject (object) of control and supervision belongs:

1) to high risk – in case of exponent of risk from 71 to 100 inclusive;

2) to average risk degree – in case of exponent of risk from 31 to 70 inclusive;

3) to low risk degree – in case of exponent of risk from 0 to 30 inclusive.

In case of identification of one gross violation to subject (object) of control and supervision the exponent of risk 100 is equated and concerning it it is performed on compliance to requirements or preventive control with visit of subject (object) of control and supervision.

In case of not identification of gross violations of measure definition of risk degree is calculated total indicator on violations of considerable and insignificant degree.

Subjective criteria with distribution on degree of the importance of violations in the sphere of sanitary and epidemiologic wellbeing of the population are given in appendix 2 to these criteria.

In case of measure definition of considerable violations the coefficient of 0,7 is applied and this indicator is calculated by the following formula:

SRZ = (SP2 x 100/SP1) x 0,7,

where:

SRZ – indicator of considerable violations;

SP1 – the required number of considerable violations;

SP2 – the number of the revealed considerable violations;

In case of measure definition of insignificant violations the coefficient of 0,3 is applied and this indicator is calculated by the following formula:

SRN = (SP2 x 100/SP1) x 0,3,

where:

SRN – indicator of insignificant violations;

SP1 – the required number of insignificant violations;

SP2 – the number of the revealed insignificant violations;

The general exponent of risk (SP) is calculated on scale from 0 to 100 and is determined by summing of indicators of considerable and insignificant violations by the following formula:

SP = SRZ + SRN,

where:

SP – general exponent of risk;

SRZ – indicator of considerable violations;

SRN – indicator of insignificant violations.

The received value of general indicator is the basis of reference of subject (object) of control and supervision to certain risk degree according to Item of 12 these Criteria.

13. Subjective criteria for evaluation of risk degree on information sources for determination of industry risks are given in appendix 3 to these criteria.

14. When forming system of risks assessment with use of information systems, measure calculation of risk degree by subjective criteria, and also risk exponents, is performed according to the list of subjective criteria in form according to appendix 3 to these criteria.

Measure calculation of risk degree by subjective criteria (R) is perfromed in the automated mode by summing of exponent of risk on violations by results of the previous checks and preventive control with visit of subjects (objects) of control and supervision (SP) and exponent of risk by subjective criteria (SC), with the subsequent normalization of values from 0 to 100 points this in the range.

Rprom = SP + SC, where

Rprom – intermediate exponent of risk by subjective criteria,

SP – risk exponent on violations,

SC – risk exponent by subjective criteria.

Calculation is made on each subject (object) of control and supervision of uniform group of subjects (objects) of control and supervision of each sphere of the state control and supervision. At the same time the list of the estimated subjects (objects) of control and supervision carried to uniform group of subjects (objects) of control and supervision of one sphere of the state control and supervision forms sample (selection) for the subsequent normalization of data.

Measure calculation of risk degree by subjective criteria is made on scale from 0 to 100 points and performed on the following formula:

xi – indicator of subjective criterion,

wi – specific weight of indicator of subjective criterion,

n – quantity of indicators.

The received risk degree measure value by subjective criteria joins in measure calculation of risk degree by subjective criteria.

The values calculated by subjects (objects) by indicator are normalized in the range from 0 to 100 points. Normalization of data is performed on each sample (selection) with use of the following formula:

R – risk exponent (final) by subjective criteria of separate subject (object) of control and supervision,

Rmax – the greatest possible value on risk degree scale by subjective criteria on subjects (objects) entering one sample (selection) (the upper bound of scale)

Rmin – minimum possible value on risk degree scale by subjective criteria on subjects (objects) entering one sample (selection) (the lower bound of scale)

Rprom – intermediate exponent of risk by subjective criteria.

15. Subjects (objects) of control and supervision are transferred using information system from high risk in average risk degree or from average risk degree in low risk degree in the corresponding fields of activity of subjects of control and supervision if are member of the self-regulatory organization based on voluntary membership (participation) according to the Law of the Republic of Kazakhstan "About self-regulation" taking into account the signed agreement with regulatory state agency in the sphere of sanitary and epidemiologic wellbeing of the population about recognition of results of activities of self-regulatory organization.

Chapter 4. Measures of rapid response

16. During implementation and (or) by results of the state control by control facilities and supervision in the sphere of sanitary and epidemiologic wellbeing of the population the following types of measures of rapid response are applied (further - MOR):

1) prohibition of activities for production (goods), to rendering services, performance of works of subject (object) of control and supervision or its separate types (processes, action) (further - prohibition of activities or its separate types);

2) withdrawal and response from the sales of products (goods) which is not conforming (not conforming) requirements of technical regulations and (or) Single sanitary and epidemiologic and hygienic requirements Eurasian Economic Union (further – withdrawal and response);

3) suspension of operations on production, product sales (goods), rendering services, performance of works of subject (object) of control and supervision or its separate types (processes, actions) (further - suspension of operations or its separate types);

4) temporary discharge of persons from work;

17. Terms of elimination of the revealed violations are determined taking into account the circumstances exerting impact on real possibility of its execution.

18. Effective period of MOR in the form of suspension of operations or its separate types constitutes ninety calendar days from the date of delivery of the resolution on its application.

19. The PESTILENCE in the form of prohibition of activities or its separate types is applied is termless.

20. The PESTILENCE in the form of withdrawal and response is applied according to the Rules of implementation of withdrawal and withdrawal of products (goods) which are not conforming (not conforming) requirements of technical regulations and (or) single sanitary and epidemiologic and hygienic requirements Eurasian Economic Union, approved according to subitem 24-1) of article 9 of the Code of the Republic of Kazakhstan "About health of the people and health care system".

21. The PESTILENCE in the form of temporary discharge of persons from work is applied for a period of one month.

22. The bases for application of MOR are the violations established by the legislation of the Republic of Kazakhstan of requirements in the sphere of sanitary and epidemiologic wellbeing of the population, provided by Items 24 - 62 these Chapters.

23. On the violations provided in checking leaf concerning objects irrespective of purpose and types of activity the following types of MOR are applied:

prohibition of activities or its separate types - Item 1;

suspension of operations or its separate types – Items 6, 7;

temporary discharge of persons from work – Items 14;

withdrawal and response – Item 23, 24.

24. On the violations provided in checking leaf the following types of MOR are applied to the health care facilities giving out-patient and polyclinic and consulting and diagnostic help:

suspension of operations or its separate types – Items 8, 23;

temporary discharge of persons from work – Items 10, 26, 34.

25. On the violations provided in checking leaf concerning facilities for production, to production of medicines, storage, wholesale and retail sale of medicines, products of medical appointment, medical equipment the following types of MOR are applied:

suspension of operations or its separate types – Items 2, 8.

26. On the violations provided in checking leaf the following types of MOR are applied to objects of traditional and traditional medicine (healing):

suspension of operations or its separate types – Item 7;

temporary discharge of persons from work – Item 8.

27. On the violations provided in checking leaf concerning health care facilities, giving palliative care and sisterly leaving the following types of MOR are applied:

suspension of operations or its separate types – Item 7;

temporary discharge of persons from work – Items 13, 14.

28. On the violations provided in checking leaf concerning health care facilities, recovery treatment and medical rehabilitation the following types of MOR are applied:

suspension of operations or its separate types – Item 5;

temporary discharge of persons from work – Items 11, 12.

29. On the violations provided in checking leaf concerning health care facilities, providing stationary medical care the following types of MOR are applied:

suspension of operations or its separate types – Item 7, 21;

temporary discharge of persons from work – Items 23, 31, 34.

30. On the violations provided in checking leaf the following types of MOR are applied to the objects rendering dental services:

suspension of operations or its separate types – Item 9;

temporary discharge of persons from work – Items 3, 12.

31. On the violations provided in checking leaf concerning health care facilities, performing activities in the sphere of forensic medicine and pathological anatomy the following types of MOR are applied:

suspension of operations or its separate types – Item 6.

32. On the violations provided in checking leaf concerning health care facilities, the services of blood performing activities in the sphere are applied the following types of MOR:

suspension of operations or its separate types – Item 4, 16;

temporary discharge of persons from work – Items 8, 17.

33. On the violations provided in checking leaf concerning objects of preschool education and training the following types of MOR are applied:

prohibition of activities or its separate types - Items 17, 66;

prohibition of activities or its separate types (production and realization of inadmissible dishes and food) - Item 30;

suspension of operations or its separate types – Item 76;

withdrawal and response – Item 74.

34. On the violations provided in checking leaf concerning children's improving and sanatorium objects (year-round, seasonal) the following types of MOR are applied:

prohibition of activities or its separate types - Item 12;

prohibition of activities or its separate types (production and realization of inadmissible dishes and food) - Item 27;

suspension of operations or its separate types – Item 14;

suspension of operations of the pool – Item 15;

withdrawal and response – Item 16.

35. On the violations provided in checking leaf the following types of MOR are applied to objects of education:

prohibition of activities or its separate types - Items 20, 72;

prohibition of activities or its separate types (production and realization of inadmissible dishes and food) - Item 36;

suspension of operations or its separate types – Item 71;

temporary discharge of persons from work – Item 37, 44.

36. On the violations provided in checking leaf concerning objects of public catering with production, conversion and realization of food products apply the following types of MOR:

suspension of operations or its separate types - Item 36

withdrawal and response – Items 17, 20;

temporary discharge of persons from work – Item 31.

37. On the violations provided in checking leaf the following types of MOR are applied to facilities for production of food products:

prohibition of activities or its separate types - Item 27;

prohibition of activities for pouring of separate type of alcoholic products - Item 13;

withdrawal and response – Items 29;

temporary discharge of persons from work – Item 23.

38. On the violations provided in checking leaf the following types of MOR are applied to objects of wholesale and retail trade:

withdrawal and response – Items 5, 7, 15.

39. On the violations provided in checking leaf concerning the organization and vehicles (railway, water, air) transporting passengers; the organization and vehicles (railway, automobile, water and air) the sources of ionizing radiation performing transportation, dangerous chemical and toxic goods the following types of MOR are applied:

suspension of operations or its separate types - Items 1, 2, 26.

40. On the violations provided in checking leaf the following types of MOR are applied to radiation-hazardous objects:

suspension of operations or its separate types - Items 3, 9, 13, 24.

41. On the violations provided in checking leaf concerning objects of public catering on transport (railway, air, water and automobile), objects of onboard food are applied the following types of MOR:

prohibition of activities or its separate types (realization inadmissible food staples, food products, ready dishes) - Item 10;

suspension of operations or its separate types – Item 16;

withdrawal and response – Items 9;

temporary discharge of persons from work – Item 14.

42. On the violations provided in checking leaf concerning objects of production, storages and realization of perfumery and cosmetic products and means of hygiene are applied the following types of MOR:

withdrawal and response – Item 15.

43. On the violations provided in checking leaf the following types of MOR are applied to subjects to temporary residence of people:
