About approval of the Regulations on the state control of compliance with law of the Russian Federation about foreign agents

Approve the enclosed Regulations on the state control of compliance with law of the Russian Federation on foreign agents.

Regulations on the state control of compliance with law of the Russian Federation on foreign agents

I. General provisions

1. This Provision establishes procedure for the organization and implementation of the state control of compliance with law of the Russian Federation about foreign agents (further - the state control).

2. For the purpose of this provision controlled persons are understood as foreign agents, and also persons specified in parts 2 and 5 of article 1 of the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence".

3. Subject of the state control is observance by controlled persons of the legislation of the Russian Federation on foreign agents, in particular the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence", other Federal Laws, other regulatory legal acts regulating activities of foreign agents (further - the legislation on foreign agents).

4. Objects of the state control are activities, actions (failure to act) of controlled persons.

5. Tasks of the state control are the prevention, identification and suppression of violations of requirements of the legislation on foreign agents.

6. The state control is exercised by the Ministry of Justice of the Russian Federation and its territorial authorities (further - state control bodies) in interaction with other bodies of the public power, the organizations of all patterns of ownership, and also their officials.

7. The officials authorized on implementation of the state control are:

a) heads of state control bodies, their deputies;

b) heads of structural divisions of state control bodies, their deputies whose official regulations provide powers on implementation of the state control;

c) other government civil servants of state control bodies which official regulations provide powers on implementation of the state control.

8. When implementing the state control state control bodies in the activities are guided by the Constitution of the Russian Federation, the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence", other Federal Laws and regulatory legal acts of the Russian Federation, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation, regulatory legal acts of the Ministry of Justice of the Russian Federation, and also this Provision.

9. The officials authorized on implementation of the state control, within the powers and within the carried-out scheduled and unscheduled inspections of observance by controlled persons of requirements of the legislation on foreign agents (further - check), visits of the events held by foreign agents, the analysis of information about the controlled persons represented according to the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence", and also intended for the unrestricted group of people of printing, audio-, audiovisual and other messages and materials (including with use of the Internet (further - Internet network), extended (placed) by controlled persons (further - control actions), have the right:

a) request from governing bodies of legal entities - controlled persons administrative documents, except for the documents containing data which can be received according to the subitem "b" of this Item;

b) request from bodies of the public power, and also from credit and other financial institutions information on financial and economic activities of controlled persons and obtain such information;

c) direct the representatives for participation in the events held by foreign agents;

d) perform observance by controlled persons of the legislation on foreign agents;

e) issue obligatory for execution in time, the constituting at least one month, the instruction about elimination of the revealed violations in accordance with the legislation of the Russian Federation, and also in case of violation of the law about foreign agents to apply to controlled persons other measures of legal reaction according to article 12 of the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence";

e) in case of receipt of information that person specified in part 5 of article 1 of the Federal Law "About Control of Activities of Persons Which Are under Foreign Influence" the actions (failure to act) promotes violation by the foreign agent of the legislation on foreign agents to issue to such person the written warning with indication of the allowed violation and term of its elimination constituting at least one month.

10. The officials authorized on implementation of the state control bear responsibility for improper execution of the powers assigned to them in accordance with the legislation of the Russian Federation.

II. Implementation of the state control

11. The state control is exercised by means of holding control actions.

12. Are performed:

a) territorial authorities of the Ministry of Justice of the Russian Federation concerning controlled persons depending on the location (for public authorities of subjects of the Russian Federation, other state bodies, territorial authorities of federal bodies of the government and other federal state bodies, local government bodies, the Russian legal entities and their officials, public associations operating without formation of legal entity, other associations of persons) or registration at the place of residence (stay) (for physical persons);

b) central office of the Ministry of Justice of the Russian Federation concerning federal bodies of the government and other federal state bodies (except for their territorial authorities), the all-Russian and international public associations, departments of the international organizations and foreign non-profit non-governmental organizations, foreign legal entities, foreign structures without formation of legal entity, other associations of persons and their officials.

13. Scheduled inspections are carried out concerning foreign agents not more often than once a year according to annual plans of conducting such checks.

14. The basis for inclusion of scheduled inspections in the annual plan of conducting planned inspections is the expiration of one year from the date of:
