About application of special economic measures in the fuel and energy sphere in connection with establishment by some marginal foreign states of price for the Russian oil and oil products

Due to the unfriendly and contradicting international law actions of the United States of America and the foreign states and the international organizations which adjoined them directed to ceiling establishment of price for the Russian oil and oil products for the purpose of protection of national interests of the Russian Federation and according to the Federal Laws of December 30, 2006 No. 281-FZ "About special economic measures and enforcement powers", of December 28, 2010 No. 390-FZ "About safety" and of June 4, 2018 No. 127-FZ "About corrective actions (counteraction) on unfriendly actions of the United States of America and other foreign states" I decide:

1. Determine that in connection with introduction by the United States of America and the foreign states of prohibition on maritime transports which adjoined them Russian oil and oil products, rendering the services connected with such transportations which is applied in case of realization Russian oil and oil products at the prices above the marginal price established by the specified foreign states (the mechanism of marginal fixing of price) deliveries Russian oil and oil products are forbidden foreign legal entities and physical persons provided that use of the mechanism of marginal fixing of price is directly or indirectly provided in contracts for these deliveries. The established prohibition is applied at all stages of deliveries to the final buyer.

1(1). Operation of this Decree does not extend to the supply of the Russian oil performed according to the contracts signed in pursuance of the international treaties of the Russian Federation existing on the date of entry into force of this Decree in the field of oil supply with the states which are not included in the list of the foreign states and the territories making concerning the Russian Federation, the Russian legal entities and physical persons unfriendly actions approved by the Government of the Russian Federation.

2. The prohibition on supply of the Russian oil established by this Decree is applied from the date of entry into force of this Decree.

3. The prohibition on supply of the Russian oil products established by this Decree is applied from the date determined by the Government of the Russian Federation, but not earlier than from the date of entry into force of this Decree.

4. Deliveries Russian oil and oil products which implementation is forbidden according to this Decree can be performed based on the special decision of the President of the Russian Federation.

5. To the government of the Russian Federation:

a) determine the list of commodity codes by the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union to which provisions of this Decree are applied;

b) determine date with which the prohibition on supply of the Russian oil products established by this Decree is applied;

c) adopt the acts directed to realization of the prohibition established by this Decree;

d) determine procedure of monitoring of execution of Item 1 of this Decree.

6. To Ministry of Energy of the Russian Federation to perform on regular basis according to the procedure, determined by the Government of the Russian Federation, monitoring of execution of Item 1 of this Decree.

7. Grant to the Ministry of Energy of the Russian Federation the right to give in coordination with the Ministry of Finance of the Russian Federation official explanations concerning application of this Decree.

8. Assign to the interdepartmental working group on the questions connected with activities in the fuel and energy sphere, control of execution of this Decree.

9. This Decree becomes effective since February 1, 2023 and is effective till December 31, 2024 inclusive.
