About approval of the Regulations on procedure for application of the Customs convention about international delivery of loads using the book of MDP (The convention MDP, 1975)

For the purpose of realization of regulations of the Customs convention on international delivery of loads using the book of MDP (The convention MDP, 1975) which the Republic of Moldova joined the Resolution of Parliament No. 1318/1993 on accession of the Republic of Moldova to some international conventions (The monitor of Parliament of the Republic of Moldova, 1993, No. 3, of the Art. 62), the Government DECIDES:

1. Approve Regulations on procedure for application of the Customs convention on international delivery of loads using the book of MDP (The convention MDP, 1975) it (is applied).

2. To Customs Service to take necessary measures for functioning of the Regulations on procedure for application of the Customs convention about international delivery of loads using the book of MDP (The convention MDP, 1975) in the territory of the Republic of Moldova.

3. Declare invalid the Order of the Government No. 1086/1997 about approval of the Regulations on procedure for application of the Customs convention about international delivery of loads using TIR cornet (The convention TIR, 1975) (The official monitor of the Republic of Moldova, 1997, Art. No. 86-87, 879), with subsequent changes.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on procedure application of the Customs convention about international delivery of loads using the book of MDP (The convention MDP, 1975)

I. General provisions

1. The customs convention about international delivery of loads using the book of MDP (The convention MDP, 1975) (further - the Convention MDP) concerns transportation of goods without the intermediate overload performed by road vehicles, structures of vehicles or in containers with crossing of one or several borders from customs post of departure of one contracting party to customs post of appointment of other contracting party or the same contracting party provided that certain part of transportation of MDP between its beginning and completion is performed by road transport and with crossing at least one frontier. Regulations on procedure for application of the Customs convention on international delivery of loads using the book of MDP (The convention MDP, 1975) (further - the Provision) establishes conditions and procedure for use of books of MDP in transit of goods in the mode of customs transit across the territory of the Republic of Moldova.

2. Goods using the book of MDP are transported without customs payment or representation of additional guarantee on covering of customs payments on intermediate customs posts. On these customs posts collection for implementation of customs procedures when filling books of MDP is not levied.

3. The goods transported according to the MDP procedure in the sealed-up road vehicles in structures of the sealed-up vehicles or in the sealed-up containers, as a rule, are not subject to customs control on customs posts of entrance and customs posts of departure. Control can be exercised only in exceptional cases if there are bases to assume that in the sealed-up compartments there are objects which are not specified in the manifesto of the book of MDP or there are reasonable suspicions of rather potential abuses or violations of the existing rules.

Criteria of risk according to regulations of Article 192-1 of the Customs code of the Republic of Moldova No. 1149/2000 and the Order of the Government No. 1144/2005 on approval of the System concept of risk management in Customs Service are applied to decision making about implementation of customs control.

II. Conditions of application of the MDP mode

4. In the MDP mode goods are transported using the book of MDP filled according to the Convention MDP and this Provision.

5. Availability of the book of MDP properly filled with the issuing/guaranteeing consolidation and her holder testifies to guarantee availability from the guaranteeing consolidation.

6. In the MDP mode goods are transported by motor transport provided in Item and) article 3 of the Convention MDP.

7. The vehicles or structures of vehicles performing transportation of goods using the book of MDP shall be equipped in front and behind with rectangular plates with text of "TIR" so that they were visible, according to the requirements specified in appendix No. 5 to the Convention MDP. These plates can be removable or established, or designed so that they could be turned, covered, put or otherwise to show that this transportation does not belong to the MDP procedure.

8. MDP can be transported through several customs posts of departure and appointment, from the different countries provided that the total quantity of customs posts of departure and appointment shall not be more than four or more established by the Convention MDP. In similar cases the goods afterwards shipped on different customs posts are in addition brought in the manifesto of the book of MDP, and customs posts of departure specify data on the imposed new seals in column 16 of the remained detachable leaves. The book of MDP can be shown on customs posts of appointment only if all customs posts of departure accepted the book of MDP to registration.

9. Customs posts of departure/entrance establish transit term through customs area of the Republic of Moldova to customs posts of departure/appointment according to national rules, but it cannot exceed 8 days. This term shall be enough for completion of the established route taking into account climatic conditions, specifics of load (for example, transportations of heavy or bulky cargoes) and provisions of the European agreement concerning work of crews of the vehicles making the international motor transportations (ESTR) (on July 1, 1970, Geneva) which the Republic of Moldova joined the Resolution of Parliament No. 1318/1993.

10. The term of transit can be extended after giving by the holder or his representative of the request about prolongation for the next customs post, including with use of electronic means of communication, according to the procedure, established by Customs Service.
